El 23 de enero de 2015, el abogado del presidente Rafael Correa, Caupolicán Ochoa, advirtió que podría iniciar un nuevo proceso contra Carlos Figueroa, quien recuperó su libertad el pasado 17 de enero de 2015, tras cumplir una condena de seis meses en prisión por injurias contra el Jefe de Estado, junto con el exasambleísta Cléver Jiménez y su asesor Fernando Villavicencio.
En declaraciones recogidas por diario El Universo y diario El Tiempo, Ochoa aseguró que, tras analizar las últimas declaraciones dadas por Figueroa a la prensa, en torno a los hechos del 30 de septiembre de 2010, estas constituirían otro delito distinto que, según el jurista, podrían llevar a que el activista sea enjuiciado por reincidencia, según lo tipificado en el artículo 57 del Código Orgánico Integral Penal. “El hecho de que se haga una nueva afirmación calumniosa en contra de la honra de cualquier ciudadano significa que se está configurando nuevamente una acción penal. Ciertamente esta situación sería más delicada por cuanto estaríamos al frente de un caso de reincidencia”, explicó Ochoa.
Tras su liberación, el activista ha insistido en que el 30 de septiembre de 2010, día de la revuelta policial, no existió un golpe de Estado y el Presidente Correa no estuvo secuestrado esto a raíz de la circulación de un libro escrito por el General Ernesto González, quien dirigió el operativo militar de rescate del Presidente quien afirma que el Presidente no estuvo secuestrado pues hablaba con sus colaboradores y daba órdenes desde el hospital de la Policía, pero sí estuvo retenido y que inteligencia militar no detectó que hubiera ninguna conspiración para dar un golpe de Estado ese día .
La primera condena a Carlos Figueroa es consecuencia de un pedido de investigación a la Fiscalía que presentaron Jiménez, Villavicencio y Figueroa para que se esclarezca la participación del Presidente Correa en los hechos del 30 de septiembre del 2010. Esta denuncia fue desechada por el Fiscal General del Estado y luego fue calificada de maliciosa y temeraria por un juez.
President´s attorney threatens Carlos Figueroa to field a new trial for «backsliding» in injuries
On January 23, 2015, President Rafael Correa´s counsel, Caupolicán Ochoa warned that could initiate a new trial against Carlos Figueroa, who was let free last January 17, 2015, after serving six months in prison for insulting the head of state, along with the former assemblymen Cléver Jiménez and his adviser Fernando Villavicencio.
Quoted by newspaper El Universo and El Tiempo, Ochoa said that, after analyzing the latest statements made by Figueroa to the media about the events of September 30th 2010, these constitute a different offense, according to Ochoa´s lawyer, this could lead for the activist to be trialed on offense, as defined in Article 57 of the Penal Code of. «The fact that a new slanderous claim has been made against the honor of any citizen means is made again setting a criminal action. Certainly this would be more delicate because we would be in front of a case of recurrence», Ochoa said.
Upon his release, the activist has insisted that on September 30th 2010, the day of the police riot, there was not a military coup and President Correa was not kidnapped after following the circulation of a book written by General Ernesto Gonzalez, who led a military operation to rescue the President; Gonzalez states that the President was not kidnapped because he spoke with colleagues and gave orders from the police hospital, but was detained and military intelligence did not detect that there was any conspiracy to give a military coup that day.
The first sentence for Carlos Figueroa is the result of an investigation request to the attorney who filed Jiménez, Villavicencio and Figueroa for the participation of President Correa in the events of September 30th, 2010. This request was discarded by the State´s Attorney General of the and then was qualified as malicious and reckless by a judge.
