El miércoles 31 de agosto de 2011, Alembert Vera, abogado del presidente Rafael Correa en la querella contra diario El Universo, solicitó al agente fiscal de lo penal de Guayaquil que inicie acciones contra ese rotativo por ser «los presuntos responsables de los delitos de odio, falsedad y asociación ilícita».
El pedido, que se realiza previo a un proceso judicial, es consecuencia de la publicación, el 21 de agosto, de una nota titulada «Juez Gamboa compartió aulas con el abogado del presidente», la cual fue graficada con fotografías del juez Stevie Raúl Gamboa, y el abogado del Presidente, abrazados y en actitud amistosa durante una fiesta. Las fotografías habían sido publicadas anteriormente en las redes sociales.
Esto sucedió luego del anuncio de que ese magistrado, sería uno de los encargados de juzgar la apelación del caso. Actualmente Gamboa se excusó y fue reemplazado por Henry Morán. En total, se han contabilizado cinco cambios de jueces en la composición de la sala de la Corte Provincial del Guayas, encargada de conocer la apelación en el Caso de Diario El Universo.
Para Vera, la publicación de El Universo «contiene palabras y frases dolosas, maliciosas y temerarias» y que forman parte de «una campaña mediática, infame que irrespeta el derecho al buen nombre, el honor, el prestigio, la intimidad y la propiedad intelectual».
Con todo ello, Vera pide al agente fiscal que remita el original del artículo informativo, el nombre de su autor, reproductor o responsable y que «proponga las acciones penales de acción privada; civiles, por reparación de daño moral y otras pertinentes, porque estos actos dolosos y malintencionados no se pueden permitir ya que crean injustamente, un criterio de odio», concluye el pedido .
Con este, ya suman dos pedidos que remite Vera a la Fiscalía, a título personal. El primero, fue por un artículo escrito por el periodista Diego Oquendo en el que aseguraba, podría ser injurioso.
En tanto, la audiencia en el juicio por injurias que sigue el Presidente en contra de El Universo, sus tres directivos y el ex articulista Emilio Palacio fue fijada para el 13 de septiembre. En ella, se revisará la sentencia dictada en primera instancia por un juez temporal, por la que se pidió prisión de tres años para los implicados y el pago indemnizatorio de $40 millones.
President’s attorney requests investigation of newspaperel universo for the alleged crimes of hatred, misrepresentation and illicit association
On Wednesday 31 August 2011, Alembert Vera, President Rafael Correa’s counsel in the trial against the newspaper El Universo, requested Guayaquil’s public prosecutor to initiate proceedings against the paper because they are «allegedly responsible for the crimes of hatred, misrepresentation and illicit association».
The request, which precedes a judicial process, is the consequence of the publication on 21 August of a piece with the title «Judge Gamboa shared classrooms with president’s attorney», accompanied by photographs of Judge Stevie RaúlGamboa and the president’s attorney hugging and showing a friendly attitude towards each other during a party.The photographs had been previously published in the social networks.
This took place after the announcement that Gamboa would be one of the judges’ in charge of the case’s appeal.The judge has now excused himself and has been replaced by Henry Morán.There have been a total of five changes in the composition of the Guayas Provincial Court’s Division in charge of settling the appeal in the case against the newspaper El Universo.
According to Vera, El Universo’s article «includes deceitful, malicious and brash words and phrases» which are part of «an infamous media campaign that disrespects the right to a good name, honor, prestige, intimacy and intellectual property».
Vera requests the prosecutor to refer to the original article, its author’s name, the person who reproduced or was responsible for it and «propose the relevant criminal actions for private injury; civil actions for the reparation of moral damage and other relevant actions, because these deceitful and malicious acts cannot be allowed as they unjustly induce hatred»
This is the second request presented by Vera to the prosecutor’s office.The first concerned an article written by journalist Diego Oquendo, which he assured could be offensive.
Meanwhile, the hearing for the trial for slander initiated by the president against El Universo, its three directors and its former feature writer Emilio Palacio, has been set for 13 September.The first instance ruling issued by a temporary judge, requesting a three year prison sentence for those involved and the payment of S40 million in damages, will be reviewed in it.
