El 13 de julio de 2011, el abogado del presidente Rafael Correa, Alembert Vera hizo un pedido a la fiscalía para que se remita el nombre del autor del artículo de opinión «Fregando la Pita», escrito por Diego Oquendo y publicado el pasado 27 de junio, en diario Hoy, lo que constituye una acción previa al inicio de un nuevo proceso legal en contra de un periodista.
Marlon Puertas, editor general de diario Hoy confirmó a Fundamedios que el periódico recibió un oficio de la fiscalía el 26 de julio, por el cual la Unidad de Actuaciones Administrativas, bajo la firma del fiscal de Pichincha Jorge Nogales, pidió al medio que, en el plazo de tres días, remitan el nombre del autor del artículo. Esta petición fue solicitada por el abogado Alembert Vera, quien defiende al Presidente en el juicio por injurias en contra de diario El Universo, sus directivos y su ex articulista .
Por su parte, el abogado Alembert Vera dijo a Fundamedios que, en efecto, hizo el pedido como una exhibición previa, que es un requisito de procedimiento para poder iniciar acciones por injurias si es que, tras analizar el texto, encuentran motivos para hacerlo.
El artículo publicado por Diego Oquendo bajo el título de «Fregando la Pita» hace referencia a las ganancias que podría generar, en honorarios para sus abogados, la demanda de $80 millones que planteó el Primer Mandatario en contra de diario El Universo.
President’s counsel could initiatelegal actions against journalist for opinion article
On 13 July 2011, President Rafael Correa’s lawyer, Alembert Vera, requested the prosecutor’s office to initiate proceedings against Diego Oquendo, author of the opinion article «Fregando la Pita», published on 27 June 2011 by the newspaper Hoy, in what constitutes the beginning of a new legal process against a journalist.
Marlon Puertas, Hoy’s chief editor, confirmed to Fundamedios that the newspaper received a notification from the prosecutor’s office on 26 July, signed by the prosecutor of Pichincha, Jorge Nogales, through which the Administrative Actions Unit requests that the name of the article’s author should be delivered within three days.This petition was requested by lawyer Alembert Vera, who represents the president in the trial for slander against the newspaper El Universo, its directors and its former feature writer.
Meanwhile, lawyer Alembert Vera told Fundamedios that he did present the request as a prior exhibition, a requisite of the proceedings to initiate actions against slander if motives to do so are found after analyzing the text.
The article published by Diego Oquendo titled «Fregando la Pita» (slang for bugging someone), mentions the earnings in lawyers’ fees that the lawsuit for $80 million presented by the Chief of State against the newspaper El Universo could generate.
