Tras las protestas desarrolladas el pasado 17 de septiembre de 2014 -en la que sindicatos obreros y diversas organizaciones sociales se manifestaron en contra de algunas políticas del gobierno- más incidentes ocurrieron en los días posteriores.
Según varios reportes de prensa, en la tarde y noche del jueves 18 de septiembre, aproximadamente 126 jóvenes fueron inicialmente detenidos en las cercanías del colegio Mejía, en Quito mientras que otros 38 fueron aprehendidos al día siguiente en protestas que continuaron en el centro y sur de la capital. En Ibarra, ciudad ubicada al norte del país, también se detuvo a ochos jóvenes por las protestas registradas el 18 de septiembre, pero ya recobraron su libertad.
En diálogo con Fundamedios, Verónica Yuquilema, asesora legal de la organización de derechos humanos INREDH aseguró que hasta el momento han contabilizado 100 personas que han sido encausadas con procesos penales derivados de las protestas, de las cuales 54 todavía permanecen en prisión preventiva.
Carlos Sánchez, del Centro de Asesoramiento Legal e Investigación Social (CALIS) y abogado de algunos jóvenes detenidos en las inmediaciones del colegio Mejía confirmó que son 54 detenidos, y que 60 que están siendo procesados bajo el delito de “Daño al bien ajeno”, tipificado en el artículo 204 del Código Orgánico Integral Penal, sancionado con prisión de uno a tres años. Otro grupo de manifestantes está siendo procesado bajo el delito de “Ataque o resistencia”, tipificado en el artículo 283 del mismo Código, que contempla penas de prisión de seis meses a dos años.
Sánchez denunció, además, que los jóvenes han sido víctimas de agresiones físicas y vejaciones en el interior de los centros de detención y que estos casos ya fueron expuestos por ellos mismo durante la audiencia de flagrancia desarrollada en días anteriores. Yuquilema también aseguró que desde INREDH acompañarán la denuncia del caso de un menor de edad que está hospitalizado por agresiones recibidas en las manifestaciones del pasado 17 de septiembre.
En cuanto a los menores de edad se conoce que habrá sanciones administrativas. La semana pasada el ministro de Educación Augusto Espinosa, anunció que se expulsaría a los estudiantes de los colegios Mejía y Montúfar que se movilizaron, aunque esto no ha ocurrido aún. Asimismo, el Ministerio de Educación, a través de un comunicado público divulgado por la prensa, afirmó que se está identificando a quienes calificó como “instigadores” de las protestas de la semana anterior y a los estudiantes que se unieron por desconocimiento . Recordó además que aquellos que participaron en estas protestas incurrieron en faltas contempladas en la Ley Orgánica de Educación Intercultural, entre ellas, ocasionar daños a la infraestructura física y al equipamiento del establecimiento educativo, y a la propiedad pública o privada e intervenir en actividades tendientes a promover la paralización del servicio educativo con sanciones que podrían ir desde acciones educativas disciplinarias hasta la separación definitiva del estudiante de la institución para ser reubicado en otro establecimiento.
El 17 de septiembre, Fundamedios reportó incidentes que dejaron un saldo inicial de 47 detenidos, 15 policías heridos, un camarógrafo agredido y un ataque cibernético a la página del medio digital LaRepública.ec.
At least 100 people have criminal process after protests
After protests developed last September 17, 2014-in which labor unions and several social organizations protested against some of the government policies- more incidents continued occurring in the following days.
According to several media reports, in the afternoon and evening of Thursday 18th, about 126 young people were initially detained around the high school Mejia in Quito while 38 others were arrested the next day in protests that continued in central and southern of the capital. In Ibarra, a city located in the north of the country, eight young man were also arrested because the protests on September 18th, but they already regained their freedom.
Veronica Yuquilema spoke with Fundamedios, Mrs. Yuquilema is the legal adviser of the Human Rights organization INREDH said that so far have been counted 100 people who have been prosecuted with criminal process because of the protests, of which 54 students are still in custody.
Carlos Sanchez from the Center for Legal Advice and Social Research (CALIS) and lawyer of some of the young man arrested near the high school Mejia confirmed that there are 54 detainees, and 60 are being prosecuted under the crime of «Damage to private property» defined in article 204 of the Integral Criminal Code, felony punished with imprisonment of one to three years. Another group of protesters is being prosecuted under the offense of «Assault or resistance», defined in article 283 of the Code, which stablishes prison sentences between six months and two years.
Sanchez also reported that young men have been victims of physical assault and abuse inside of the detention centers and that all these cases were already told by themselves during the hearing of conduct developed in previous days. Yuquilema also held that he will follow closely from INREDH the complaint of the case of a minor who is hospitalized for aggression received in the protests last September 17th.
As far is known the minors will be having administrative penalties. Last week the Educational Minister Mr. Augusto Espinosa, announced that the students from High schools Mejia and Montúfar will be expelled, although this has not occurred yet. The Ministry of Education, through a public statement issued by the press, held there is an investigation going on to identify who will be qualified as «instigators» of the protests from the previous week and which are the students who joined unknowing what was happening. Mr. Espinosa also recalled that those who participated in the protests incurred in faults contemplated in the Organic Law of Intercultural Education, including damage of the physical infrastructure and the equipment of the educational establishment, and public or private property, also to participate in activities to promote the cessation of educational services could range penalties from educational disciplinary actions until the final separation of the student from the institution to be relocated in another facility.
On September 17, Fundamedios reported incidents that left an opening balance of 47 detainees, 15 policemen injured, one cameraman assaulted and a cyber-attack to the web site LaRepública.ec. Subsequently PlanV digital magazine released a video that shown how the Police assaulted an entire team from a television newscast to prevent the registration of the events in the streets around the high school Mejia. One officer hits with his helmet against a video camera, while others place their hands and push the camera lens.
