El 05 de enero de 2012, el presidente de la República, Rafael Correa, se negó por tercera vez, a entregar su historia clínica y la de su familia, solicitado como prueba, por la Jueza Quinta de lo Civil de Pichincha, María Portilla; en el juicio por daño moral que sigue en contra de los periodistas Juan Carlos Calderón y Christian Zurita por la publicación del libro ‘El Gran Hermano’ y donde pide USD 10 millones como indemnización al asegurar que con la emisión del texto, se le causó daño moral.
La jueza Portilla había solicitado documentación clínica que demuestre el supuesto sufrimiento y angustia que habría generado el contenido del libro en él y su familia, como consta en la demanda impuesta por el mandatario.
En respuesta al pedido realizado por la Jueza, Alembert Vera, abogado del primer mandatario, entregó ayer, último día de plazo, un escrito donde argumenta su negativa al señalar que lo solicitado “es improcedente y no tiene razón de ser”, afirma además que los demandados quieren “vender la idea –mediáticamente- que para demostrar daño moral debe presentarse exámenes médicos” .
Vera, en representación de Correa, aseguró, además, que “las afirmaciones vertidas por los demandados en su libro “El Gran Hermano”, son injuriosas, ofensivas, fueron hechas con toda mala fe y para causarme escarnio público”, y que para demostrar aquello no se necesita prueba adicional .
Por su parte, Ramiro Aguilar, abogado de los periodistas, manifestó que esta respuesta no fue ninguna novedad que tal negativa solo evidencia que en ningún momento el libro ‘El Gran Hermano’ causó daño moral al presidente Correa y “ahora están metidos en una callejón sin salida porque no pueden presentar lo que no tienen” y si lo reconocen sería afirmar “que el presidente nunca sufrido depresión o angustia y que eso valga USD 10 millones”, agregó
Aguilar aseguró que el próximo lunes solicitará a la Jueza que se exhiban los documentos bajo “apremio personal”, es decir con la fuerza pública o que afirmen que no tienen la historia clínica en cuyo caso quedará demostrado que jamás existió daño moral, de tal forma “no puede ganarse un juicio sin pruebas” .
President of the republic refuses to hand over evidence of moral damage caused by book being published
On 5 January 2012, President of the Republic Rafael Correa refused for the third time to hand over his and his family’s clinical records, requested as evidence by the Fifth Civil Judge of Pichincha, María Portilla, in the trial for moral damage involving journalists Juan Carlos Calderón and Christian Zurita for the publication of the book ‘El Gran Hermano’. The president has asked for USD 10 million in damages stating that the book has caused him moral damage.
Judge Portilla has requested clinical documentation that is proof of the alleged suffering and anguish generated by the contents of the book in him and his family, as stated in the lawsuit filed by the chief of state.
As a reply to the request made by the judge, Alembert Vera, one of the president’s lawyers, delivered yesterday, the last possible day, a written text arguing that the request «is unfounded and has no real reason». The text also states that the accused want «to sell the idea – through the media – that medical records are necessary to show moral damage”.
Representing Correa, Vera also assured that “the asseverations presented by the accused in their book ‘El Gran Hermano’, are slanderous, offensive, were made with ill will to cause public ignominy», and that to prove this, no additional evidence is required.
Meanwhile, Ramiro Aguilar, the journalists’ lawyer, declared that this response was not unexpected; that the refusal is only evidence that the book ‘El Gran Hermano’ never caused President Correa any moral damage. He also stated that “now they are stuck in a one way alley because they cannot present what they have not got” and that to acknowledge this would be to state “that the president never suffered depression or anguish worth USD 10 million”, he added.
Aguilar declared that next Monday he will file a suit for collection of the documents. Otherwise, the president should declare he does not have a medical record, in which case the lack of moral damage would be proven. “A trial cannot be won without evidence”, he said.
