El 23 de abril de 2014, el Tribunal Undécimo Penal del Guayas declaró inocentes a cuatro de los cinco procesados por el crimen del periodista Fausto Valdiviezo, asesinado el 11 de abril de 2013. Estas personas habían sido acusadas como cómplices y encubridores. El quinto procesado aún se encuentra prófugo y el trámite de su causa se encuentra suspendido. El Tribunal llegó a esta decisión tras tres días de audiencia y luego de desechar las pruebas de la Fiscalía, que a criterio de los jueces, no pudo sustentar las acusaciones contra los presuntos implicados.
Julio César Cueva, abogado de la familia del comunicador dijo en rueda de prensa que “los jueces hicieron lo que hubiera hecho cualquier juez ante la falta de contundencia probatoria de la Fiscalía”. Reprochó la actuación de la Fiscalía por la manera en cómo llevó las investigaciones y por haber apresurado el juicio cuando, a su criterio, se pudo haber aprovechado el sigilo y el tiempo de la indagación previa para tener elementos de convicción más contundentes contra estas u otras personas. «Ese apresuramiento le pasó factura a la Fiscalía y es lo que nos decepciona, porque un año después estamos como al día siguiente del asesinato de Fausto, sin indicios, sin presunciones, sin pruebas, sin procesados, sin absolutamente nada, en un estado absoluto de impunidad”, apuntó el abogado.
En tanto Alfredo Valdiviezo, hermano del comunicador asesinado, expresó su malestar y cuestionó la actuación de la Fiscalía. También se refirió a una rueda de prensa anterior que dio el Ministro del Interior José Serrano, en la que habló de una supuesta relación inusual entre el comunicador y los hoy declarados inocentes, pues nunca se esclareció ningún nexo entre ellos y el periodista asesinado. “Nos sentimos desamparados, decepcionados, sentimos como que a Fausto lo mataron ayer, no tenemos nada, es desesperante y preocupante (…) Faltan los dos culpables principales, el que disparó y mentalizó todo esto”, declaró. La defensa de Valdiviezo anunció que enviará un nuevo escrito a la Fiscalía solicitando que reabra la investigación y que investigue con seriedad.
En declaraciones públicas, el agente fiscal Víctor Altamirano, encargado del proceso, aseguró que apelará la decisión judicial, pues el grado de participación de los acusados estaba claramente determinado y el móvil del crimen fue debidamente expuesto ante el Tribunal .
Fundamedios ha expresado reiteradamente a las autoridades judiciales que este caso no puede ser una muestra más de impunidad. La semana pasada, a propósito del aniversario de la muerte de Fausto Valdiviezo, Fundamedios envió una carta al fiscal general Galo Chiriboga en donde se cuestionó que al año del lamentable crimen existan más interrogantes que certezas y se solicitó seguir investigando para que se llegue a los verdaderos culpables y a las verdaderas causas del asesinato del periodista.
The court declared acquitted of homicide to the people that were involved on a journalist murder

In the main time, Alfredo Valdiviezo, brother of the murdered journalist, expressed his discomfort and questioned the performance of the Prosecutor Office. He also referred to a press conference gaved by Interior Minister José Serrano, in which the Minister spoke about an unusual relationship between the journalist and the suspects that were founded not guilty today; sincethere was never clarified anyconnection between them and the slain journalist. «We feel helpless, disappointed, we feel like Fausto was killed yesterday, we have nothing, it’s a desperate and concern feeling (…) missing the two main suspects, the one who shot and who had organized the crime,» he said. Valdiviezo’s Defender said he will issue another requestasking the Prosecutor to reopen the case with a serious investigation.
In public statements, the prosecutor Victor Altamirano, incharged with leading the process, said he would appeal the court’s decision, since the degree of the suspectsparticipation was clearly identified and the motive was properly presented before the Court.
Fundamedios has repeatedly expressed to the judicial authorities that this case cannot be an example of impunity. Last week, referring to the anniversary of Fausto Valdiviezo’s death, Fundamedios sent a letter to General Attorney Galo Chiriboga, questioning that has been a year since the pity crime and there are more questions than answers, Fundamedios requested that theresearch must continue and find the real criminals and the real causes of the murder of the journalist.
