El 12 de septiembre de 2014, la Sala Única de Esmeraldas, ratificó la inocencia del periodista Juan Alcívar, corresponsal de diario La Hora en La Concordia, provincia de Esmeraldas, ubicada a 318 kilómetros al noroccidente de Quito, quien fue acusado de “agresión terrorista en contra de funcionarios públicos” por supuestamente haber lanzado una bomba con gas lacrimógeno al interior de un recinto ferial donde se encontraba de visita el presidente Rafael Correa, el pasado 19 de julio de 2010.
Los jueces aseguraron, en su fallo de segunda instancia que “la Fiscalía no ha logrado demostrar y probar fehacientemente dicha participación en la audiencia de juicio, pues los policías que participaron en el operativo no testificaron en el proceso. Por lo tanto se niega el recurso de apelación planteado por la Fiscalía”.
El pasado 27 de agosto de 2013, el Tribunal Primero de Garantías Penales de Esmeraldas declaró la inocencia del periodista al no haber encontrado elementos probatorios en su contra.
Anteriormente, Alcívar había denunciado que la acusación que pesaba en su contra respondía a una persecución política por parte del alcalde de La Concordia de quien el periodista admitió haber sido muy crítico cuando trabajaba en la radio El Nuevo Sol .
Igualmente, durante el tiempo en que duró su proceso, el periodista afrontó varias agresiones verbales y físicas, amenazas y hasta tuvo que permanecer un tiempo en la clandestinidad porque temía por su vida. En agosto de 2010 el periodista también afrontó una orden de prisión preventiva dictada por el Juez Cuarto de Garantías Penales de Quinindé que se basó en declaraciones de dos empleados municipales de la localidad. Medida que fue levantada un mes después y sustituida por una medida cautelar de presentarse cada 15 días en el Juzgado mientras duró la instrucción fiscal.
Court ratifies the innocence of reporter accused of terrorism
On September 12th, 2014, the Esmeraldas court, confirmed the innocence of journalist Juan Alcívar communicator from La Hora in Concordia from Esmeraldas province, which is located 318 kilometers northwest from Quito, Alcívar was accused of «terrorist aggression against public officials» for supposedly throwing a tear gas grenade into a fairground where the President Rafael Correa was visiting at the time the last on July 19th, 2010.
The judges claimed, in their appeal sentence that «the prosecutor has failed on showing and proving conclusively the communicator participation in the hearing trial, because the police officers involved in the operation did not testify at all in the process. That is why the appeal filed by the Prosecution is denied”.
On August 27th, 2013, the First Criminal Court declared the innocence of the journalist from Emeraldas because the court haven’t found any evidence against him.
Previously, Alcívar had declared that the accusation against him, was responding to a political persecution made by the mayor of La Concordia; the journalist admitted to being very critical about the mayor´s work when he was working in the radio El Nuevo Sol.
Similarly, during the time that the process lasted, the journalist faced several verbal and physical attacks, threats and even had to stay hiding for a while since he did fear for his life. In August 2010, the reporter also faced a prison order issued by the Fourth Judge of Criminal Guarantees from Quinindé which was based on statements from two municipal employees of the locality. The order was annulled a month later and replaced by a precautionary measure of present himself every 15 days at the court for the time of the preliminary investigation last.
