Radio La Voz del Valle de Machachi, localidad ubicada a 35 Km. al sur de Quito, dejó de operar luego de 53 años de existencia tras la negativa, en marzo del 2008, de la renovación de la concesión de del uso de la frecuencia 1040 Khz, en amplitud modulada y su posterior clausura e incautación de equipos.
Su propietario, Aníbal Cueva informó que en 2007 inició los trámites para extender el uso de la frecuencia de su estación radial, que funcionó desde hace 53 años. Sin embargo, pasados los nueve meses de esa solicitud, su pedido fue negado por incurrir en una supuesta infracción técnica al operar con una línea física y no con enlace de microonda.
Cueva pagó una multa por esta infracción, pero, el 26 de marzo, el Consejo Nacional de Radiodifusión y Televisión (Conatel) negó la renovación de la concesión de la frecuencia, «por estar operando con características diferentes a las autorizadas en respectivo contrato que determina el artículo 20 del Reglamento General a la ley de Radiodifusión y Televisión».
Cueva impugnó la negativa y solicitó a la Superintendencia de Telecomunicaciones (Suptel) realizar una inspección técnica. Esta entidad realizó la gestión el 4 de julio de 2008 y emitió un informe técnico que indicó que «Al momento de la inspección se verificó que esta radiodifusora opera con los parámetros autorizados en el contrato de concesión».
Sin embargo, en noviembre del 2008, la Suptel, además de ratificar la negativa de la renovación por parte del Conatel, dispuso el retiro de los equipos a la Voz del Valle y su salida definitiva del aire.
El argumento, según consta en un oficio firmado por Oswaldo Ramón Moncayo, Procurador General y Judicial de la Suptel, fue que la estación de radio operaba en la misma frecuencia y sin autorización, en Santo Domingo de los Tsáchilas, lo cual viola el art. 88 de la Ley de Radiodifusión y TV vigente».
Así, en diciembre de 2008 y con una orden de la intendencia de policía, se clausura y requisan los equipos de la radio.
Cueva recurrió a un recurso de amparo solicitado ante el Juez XV del Cantón Mejía, quien falló a su favor y ordenó la reintegración de los equipos y el pago de daños y perjuicios, permitiendo la reintegración de sus operaciones el 19 de febrero de 2009.
Sin embargo, una nueva apelación realizada por la Suptel ante la Corte Provincial significó que La Voz del Valle vuelva callar y esta vez, de manera definitiva .
Actualmente, Aníbal Cueva continúa luchando para que le devuelvan la frecuencia y sus equipos, que según dijo, son su patrimonio personal, puesto que la consola fue fabricada por él de manera artesanal. Sin embargo, comentó que la negativa persiste y le han dicho que si quiere pedir una frecuencia, que presente la solicitud como si se tratara de un nuevo proyecto, a lo cual Cueva se niega pues sería borrar una historia de 53 años.
Radio station that operated during 53 years is arbitrarily closed down and its equipments are seized
Radio La Voz del Valle of Machachi, a town 35 km south of Quito, stopped operating after 53 years, after its request to renew its concession of the use of frequency 1040Khz AM was rejected in march 2008. It was later closed down and its equipments seized.
Its owner, Aníbal Cueva, reported that he began the procedures to extend the station’s use of the frequency, which had been operating for 53 years, in 2007. However, nine months later, his request was rejected because of an alleged technical violation incurred by operating with a physical line instead of with a microwave link.
Cueva paid a fine for this violation but then, on 26 March, the National Broadcasting and Television Council rejected the renewal of the frequency’s concession «because it operates under characteristics that are different than those authorized in the contract determined by article 20 of the General Regulations of the Broadcasting and Television Law».
Cueva contested the rejection and requested the Telecommunications Superintendency (Suptel) to perform a technical inspection. This entity carried out the inspection on 4 July 2008 and issued a technical report stating that «At the time of the inspection we verified that this radio station operates within the authorized parameters as stated in the concession contract».
However, in November 2008, Suptel, as well as ratifying Conatel’s rejection to renew the concession, ordered the seizure of La Voz del Valle’s equipments and ordered its definitive closing down. It argued, as is on record in a document signed by Oswaldo Ramón Moncayo, Suptel’s General and Legal Procurator, that the radio station operated in the same frequency and without authorization in Santo Domingo de los Tsáchilas, in violation of art. 88 of the current Broadcasting and Television Law.
Thus, in December 2008, with a warrant form the police intendancy, the station was closed down and its equipments seized.
Cueva filed a writ of amparo before the XV Judge of the Cantón Mejía. The judge ruled in his favor and ordered the devolution of the equipment and a payment for damages, allowing the station to begin operating again on 19 February 2009.
However, a new appeal filed by the Suptel before the Provincial Court, meant that La Voz del Valle was silenced again, this time for good.
Aníbal Cueva is currently still fighting to get the frequency and his equipments back, which, he has stated, are his own property. He made the console with his own hands. However, he commented that the rejection persists and that he has been told that if he wants a frequency he should request it as if it were a new project. He refuses to do this because it would mean erasing a 35 year old history.
