El 01 de marzo de 2011 diario El Universo hizo pública la posibilidad de que se inicie una acción legal contra el articulista Emilio Palacio, tras la solicitud del nombre del autor del artículo, «No a las mentiras», publicada el pasado 06 de febrero. El pedido lo hizo el Presidente Rafael Correa mediante un oficio remitido por El Departamento de Actuaciones Administrativas de la Fiscalía del Guayas.
De acuerdo con el rotativo, El Universo tiene un plazo de 48 horas para contestar el pedido que representa una fase anterior al probable inicio de una acción legal contra un periodista o un medio de comunicación social.
El artículo escrito por Palacio y titulado ‘No a las mentiras’ hace referencia a la intención del presidente Rafael Correa de indultar a los implicados en la sublevación del 30-S y critica, entre otras cosas, el actuar y la imprudencia del Primer Mandatario cuando acudió al Regimiento Quito el día de la sublevación policial .
Cabe recordar que Emilio Palacio fue demandado en octubre de 2009 por el presidente del Directorio de la Corporación Financiera Nacional, Camilo Samán por injurias en su nota de opinión titulada «Camilo el matón». El articulista fue condenado por un juez de primera instancia a tres años de prisión, sentencia que no se cumplió porque él retiró la acusación particular en julio del año pasado.
Feature writer could face legal actions
On 1 March 2011, the newspaper El Universo informed about the possibility that legal actions could be initiated against feature writer Emilio Palacio, after the name of the author of the article «No a las mentiras», published on 6 February, was requested.The request was made by President Rafael Correa through an official letter sent by the Guayas Prosecutor’s Office Administrative Records Department.
According to the newspaper, El Universo has a 48 hour deadline to respond to the request, which represents a previous stage before the probable start of legal actions against a journalist or media outlet.
The article written by Palacio under the title «No a las mentiras» refers to President Correa’s intention to pardon those involved in the S-30 Police uprising and criticizes, among other things, the chief of state’s behavior and his lack of prudence when he went to the Quito Regiment on that day.
It is worth remembering that Emilio Palacio was sued in October 2009 by the president of the board of the National Financial Corporation, CamiloSamán, who accused him of including offences against him in his opinion article «Camilo el matón». The feature writer was condemned by a first instance judge to three years in prison, a sentence he did not serve because the accusation was dropped in July 2010.
