Asamblea aprueba Ley que da control al ejecutivo sobre las Telecomunicaciones

El 17 de diciembre de 2014, la Asamblea Nacional aprobó con 93 votos a favor y 25 en contra, el proyecto de Ley Orgánica de las Telecomunicaciones  tras concluirse el segundo debate. Esta Ley crea una Agencia de Regulación y Control de las Telecomunicaciones con amplios poderes para regular el espectro radioeléctrico dependiente del Ejecutivo y que reemplazó a la Superintendencia de Telecomunicaciones cuyo titular era electo por la Asamblea, de una terna enviada por el Presidente de la República.

De loa 148 artículos y demás disposiciones de la Ley Orgánica de las Telecomunicaciones, diversas organizaciones han expresado preocupación por el Artículo 8 sobre Prestación de servicios en Estado de Excepción, que plantea lo siguiente: “En caso de agresión; conflicto armado internacional o interno; grave conmoción interna, calamidad pública; o desastre natural o emergencia nacional, regional o local, cuando el Decreto Ejecutivo de Estado de Excepción que emita el Presidente o Presidenta de la República, involucre la necesidad de utilización de los servicios de telecomunicaciones, los prestadores que operen redes públicas de telecomunicaciones tienen la obligación de permitir el control directo e inmediato por parte del ente rector de la defensa nacional, de los servicios de telecomunicaciones en el área afectada. Dicho control cesará cuando se levante la declaratoria de Estado de Excepción conforme lo previsto en el artículo 166 de la Constitución de la República del Ecuador y el Decreto de Estado de Excepción”.

En otro punto, en su Artículo 142, el cuerpo legal plantea la creación de la Agencia de Regulación y Control de las Telecomunicaciones (ARCOTEL) la cual será la encargada de la administración, regulación y control de las telecomunicaciones y del espectro radioeléctrico y su gestión, así como de los aspectos técnicos de la gestión de medios de comunicación .

El directorio de esta entidad, adscrita al Ministerio rector de las Telecomunicaciones y de la Sociedad de la Información,  estará conformado por el Ministro de Telecomunicaciones, el Secretario Nacional de Planificación y Desarrollo y un delegado del  Presidente de la República. Es decir, bajo control directo del Poder Ejecutivo.

Fundamedios hará un análisis más minucioso de este cuerpo legal que puede afectar gravemente el derecho a la libre expresión en el Ecuador.

Assembly passes law, giving the executive control on telecommunications

December 17th, 2014, the National Assembly passed with 93 votes in favor and 25 against, the Organic Law of Telecommunications’ draft after the second debate concludes. This Act establishes an Agency for the Regulation and Control of Telecommunications with wide powers to regulate the radio spectrum under the Executive instructions and which the principal of this entity used to be elected by the Assembly from a list submitted by the president.

Of the 148 articles and other provisions of the Organic Law of Telecommunications, various organizations have expressed concern about Article 8 that is about provision of public services in state of emergency, which states the following: «In the event of aggression; international or internal armed conflict; serious internal disturbances, public calamity; or natural disaster or national, regional or local emergency, when the State of Emergency Executive Decree will be issued by the President of the Republic, involving the need for use of telecommunication services providers operating public telecommunications networks have the obligation to allow direct and immediate control by the governing body of national defense, telecommunications services in the affected area. Such control will cease when the declaration of state of emergency under the provisions of Article 166 of the Constitution of the Republic of Ecuador and the state of emergency decree.

On another point, Article 142, the act proposes the creation of the Agency for the Regulation and Control of Telecommunications (ARCOTEL) which will be responsible for the administration, regulation and control of telecommunications and radio spectrum and its management as well as the technical aspects of managing the media.

The board of this entity attached to the rector of Telecommunication and Information Society Ministry, will consist of the Minister of Telecommunications, the National Secretary of Planning and Development and a delegate of the President. It means under the direct control of the executive power.

Fundamedios will make a closer examination of this legal body that can severely affect the right of freedom of expression in Ecuador.
