El 24 de enero de 2014, la Superintendencia de Información y Comunicación (SUPERCOM) sancionó a la estación televisiva RTS con una multa de más de 60 mil dólares, equivalente al 2% de su facturación promediada de los últimos tres meses, por difundir una noticia de un caso que se investiga en la Fiscalía, sobre un supuesto delito sexual en contra de un teniente de navío.
Según información proporcionada por la Supercom, la denuncia fue presentada por el afectado, el pasado 26 de diciembre de 2013, en contra de RTS y el periodista Hugo Gavilanez, alegando que el medio de comunicación tomó posición institucional dentro un caso que está en etapa de indagación previa, cuya sanción está contemplada en el artículo 25 de la Ley Orgánica de Comunicación. La multa ya fue pagada por el medio de comunicación.
En otro caso, el diario estatal El Telégrafo fue «amonestado» por escrito por la Supercom luego de recibir una denuncia del Banco Pichincha por la figura de “linchamiento mediático”. Según el medio, la entidad bancaria inició el trámite por tres notas periodísticas tituladas: “Granda insiste en que Fiscalía indague cómo perdió canal”, “Informe de SBS detectó anomalías” e “Icono porteño está deteriorado” publicadas en septiembre y octubre pasados, y por las que solicitó el respectivo derecho a la réplica.
La Supercom desechó la primera denuncia y consideró que el diario estatal acogió al derecho a la réplica del banco, pero no en las condiciones adecuadas . “Se evidencia que si bien el medio cumplió con la obligación de difundir la réplica, ésta no se realizó en el mismo espacio que ocupó la noticia cuya réplica se solicitó, por tanto no se dio cabal cumplimiento al artículo 24 de la Ley Orgánica de Comunicación”, señala la resolución publicada por el rotativo.
A este caso se suma otra denuncia presentada el pasado 7 de febrero de 2014 por Juan Francisco Torres, secretario de la organización Juventud Comunista del Ecuador, contra el segmento «El Nalgómetro» del programa “Soy el mejor” del medio confiscado por el gobierno, TC Televisión, por considerar que sus contenidos “discriminatorios a la mujer y denigrantes por sexo y género”. TV Channel is the second communication media punished economically
On January 24th, 2014, the Superintendency of Information and Communication (SUPERCOM) sanctioned the TV channel RTS, with a fine of more than $ 60,000, equivalent to the 2% of its last three months averaged billing, for publishing news about a case that is under investigation in the Prosecutors Office, of an alleged sexual offense against a navy lieutenant.
According to information provided by the Supercom, the complaint was sent by the affected person, on December 26th, 2013, against RTS and journalist Hugo Gavilanez, claiming that the media took institutional position in a case that is in previous inquiry, which is sanctioned by the penalty described in the Article 25th of the Communications Law. The fine has already been paid by the media.
In another case, the state newspaper El Telégrafo was «admonished» with a letter written by the Supercom after receiving a complaint from Pichincha Bank by the figure of «media lynching». According to the report, the bank initiated the process for three newspaper articles entitled: «Granda insists that Prosecutor investigates how lost the channel», «Report of SBS detected anomalies» and «Harbor Icon is deteriorated», published in September and October. For those articles, the bank asked their respective right to reply.
The Supercom dismissed the first complaint because it considered that the state newspaper welcomed the right to reply from the bank, but not in the right conditions. «It is evident that although the journal accomplished the obligation of publishing the reply, it was not performed in the same space occupied by the news which the reply is requested; therefore, the journal did not accomplish with the Article 24 of the Communications Law» states the resolution published by the newspaper.
In addition to this case, there is another complaint filed last February 7th, 2014 by Juan Francisco Torres, secretary of the Communist Youth organization of Ecuador, against «The Nalgómetro» segment of the program «Soy el mejor” (I’m the best) by the TV Channel TC, which is seized by the government. The affected denounced the segment because he considers that its content is «discriminatory and denigrates to women and the gender». At the time this case is in study by the Supercom, an entity that reported having attended 73 cases, of which 36% are still pending. However, it has not given details about them.
