El 11 de Noviembre de 2015, la Superintendencia de la Información y Comunicación (Supercom), sancionó a la estación televisiva Ecuavisa con la obligación de pedir disculpas públicas, por la difusión de contenidos discriminatorios en razón de edad y religión, en el programa “Ecuador Tiene Talento”, transmitido al aire el 20 de septiembre de 2015. En dicho programa de entretenimiento, el jurado cuestionó duramente a una participante de 16 años quien dijo abiertamente ser atea. Esta sanción se dio tras una denuncia presentada por la Asociación Ateísta del Ecuador.
Según la Supercom, el canal incumplió el artículo 62 de la Ley Orgánica de Comunicación (LOC) donde se indica que «está prohibida la difusión a través de todo medio de comunicación social de contenidos discriminatorios que tenga por objeto o resultado menoscabar o anular el reconocimiento, goce o ejercicio de los derechos humanos reconocidos en la Constitución y en los instrumentos internacionales”.
En ese sentido, determinó que los diversos mensajes realizados por los miembros del jurado en torno a la edad y creencia religiosa de la participante, “puso de manifiesto la intolerancia, en torno a la preferencia fundada en la religión o las convicciones, así como en la edad; lo que produjo el menoscabo de los derechos a la igualdad (…)”. Por lo que la Supercom resolvió que el programa “al ser difundido por el medio de comunicación social, se colocó en condición de desigualdad a una persona por no profesar una religión (creer en ‘Dios’) y al no contar con la edad suficiente, por ende, se quebrantó sus derechos, configurándose de esta forma, la infracción administrativa prevista en el artículo 62 de la Ley Orgánica de Comunicación”.El 29 de Octubre de 2015, Gustavo La Mota, representante de la Asociación Ateísta y su abogado, Tito Yépez Luit sostuvieron durante la audiencia de sustanciación, que “las expresiones que se emitieron en ese programa, respecto a la creencia de la participante menor de edad, profirieron un trato displicente de menosprecio por el simple hecho de haber manifestado públicamente su no creencia” . Para finalizar aseguró que existió una “afectación indirecta hacia el colectivo de personas no creyentes”, calificando de “vergonzosos los hechos registrados en torno al trato discriminatorio en contra de la concursante y la comunidad atea”. Por su parte, el medio de comunicación no se ha pronunciado al respecto y tampoco envió un representante para la audiencia.
Cabe anotar que tras la polémica generada por las críticas a la joven atea, Ecuavisa decidió separar del jurado a la actriz María Fernanda Ríos, quien se defendió de las críticas y comentarios de usuarios en Twitter, por haber cuestionado a la participante.
TV station sanctioned for making discriminatory comments during a reality show
On 11 November 2015, the Superintendency of Information and Communication (Supercom) sanctioned TV station Ecuavisa with the obligation to make a public apology for the dissemination of discriminatory content on the basis of age and religion during the program «Ecuador Tiene Talento», broadcasted on 20 September 2015. During the entertainment program the jury harshly questioned a 16-year old participant who openly said she was an atheist. The sanction was issued following a complaint filed by the Atheist Association of Ecuador.
According to Supercom, the TV station breached Article 62 of the Organic Communication Law (LOC), which states that «The dissemination through any social media of discriminatory content that has the purpose or effect of diminishing or nullifying the recognition, enjoyment or exercise of human rights recognized by the Constitution and international instruments is forbidden».
It ruled that the various messages issued by the jurors about the age and religious beliefs of the participant «showed intolerance of preferences based on religion or beliefs, as well as age; which led to the loss of the right to equality (…)». For all of this Supercom decided that the program «insofar as it was disseminated by a social media outlet, placed a person in a condition of inequality for not professing a religion (believing in «God») and for not being old enough. Her rights, therefore,were violated, leading to the administrative offense foreseen by Article 62 of the Communications Law».
On 29 October 2015, Gustavo La Mota, representative of the Atheist Association, and his lawyer, Tito Yépez Luit, maintained during the substantiation hearing that «the expressions issued in that program, regarding the beliefs of the minor participant, showed offhandedness and contempt for the simple fact of having publicly expressed her disbelief». He stated that «the collective of non-believers was indirectly affected» and classified «the events surrounding the discriminatory treatment of the contestant and the atheist community» as embarrassing. The media outlet has not commented the events. Neither did it send a representative to the hearing.
We should point out that after the controversy generated by the criticism of the young atheist, Ecuavisa decided to separate from the jury actress María Fernanda Ríos, who defended herself from the criticisms and comments of Twitter users for questioning the participant.
