El 23 de septiembre de 2015, la Superintendencia de la Información y Comunicación (Supercom), mediante un trámite iniciado de oficio, sancionó con una amonestación escrita al Canal incautado TC Televisión le previno “la obligación de corregir y mejorar las prácticas para el pleno y eficaz ejercicio de los derechos a la Comunicación” y le “conminó a abstenerse de reincidir” por inobservar la norma deontológica establecida en el artículo 10, numeral 3, literal d) de la la Ley Orgánica de Comunicación (LOC), en el programa “De Boca en Boca”, el cual se transmitió el 31 de julio de 2015, donde se difundieron imágenes sobre la agresión con ácido a una ciudadana.
La Institución reguladora determinó que el medio de comunicación presentó diálogos de los presentadores y fotografías de la señora afectada, las cuales la victimizaron; “en consecuencia, no se valoró ni se consideró la intimidad personal, afectando de esta forma a la dignidad del ser humano y enviando un mensaje de morbo a los televidentes”. Por lo que se “debió darle un tratamiento distinto a esa información para que al ser difundida a los televidentes no cause tales efectos”.
Durante la audiencia de sustanciación desarrollada el 9 de septiembre de 2015, José Morán representante del medio de comunicación argumentó que “no hubo ningún tono amarillista en la difusión de la noticia y aseguró que la afectada por una quemadura de ácido no se encontraba como protegida por los medios. Dijo también que “no existe un uso morboso de la noticia, sino que la noticia, por decirlo así, es morbosa en sí misma”. Añadió que las normas deontológicas “están encaminadas, sobre todo, al periodista” y que el canal es solamente responsable al tenor del artículo 21 en adelante de la Ley de Comunicación”. Para concluir dijo que “los reporteros no hicieron comentarios exagerados, no exacerbaron “más el morbo, se la planteó tal cual fue y la noticia es la noticia”.
Por otro lado, Alejandro Salguero representante de la Supercom ratificó el contenido del reporte interno, en el cual se especificó que “no se difuminó la imagen de la afectada y que se mostró su rostro en primer plano” , el abogado respaldó su argumento en el respeto a la dignidad humana, aseguró que “la exposición es el menoscabo a la dignidad de la persona como lo ha hecho el medio de comunicación”. Concluyó.
Confiscated channel is warned for broadcasting morbid content
September 23, 2015 the Superintendency of Information and Communication (Supercom), has sanctioned with a written warning, a government confiscated television channel called TC. During the hearing on September 9, 2015 media representative José Morán argued that “there had not been any sensationalist tone in the dissemination of the news” and that the woman affected by the acid burn was not protected by the media.” He also said that “there does not exist a morbid use of this news, but instead, the news is in its very nature is itself morbid.” He added that ethical standards are to be met by, above all, the journalist” and that the channel is only responsible for following article 21 of the Law of Communication.”
To conclude, he said that “the reporters did not make exaggerated comments, and did not exacerbate the morbidity of the news, it’s just that the story was morbid. On the other hand, Alejandro Salguero representing Supercom supported the contents of the interim report in which was specified that “the image of the affected victim was not blurred out, but completely showed her face on the screen”. The lawyer backed the argument concerning respect for human dignity, he said that “the media’s exposure has taken away from the dignity of the person.”
