El 21 de febrero de 2012, la Comisión Interamericana de Derechos Humanos (CIDH) solicitó al Estado ecuatoriano adoptar medidas cautelares a favor de los directivos de diario El Universo, Carlos, César y Nicolás Pérez y el exeditor de Opinión, Emilio Palacio, para que se suspendan los efectos de la sentencia que condenó a los acusados a tres años de prisión y al pago de $40 millones de dólares, por injurias contra el presidente Rafael Correa.
A través de una carta firmada por Santiago Cantón, Secretario Ejecutivo de la CIDH, se señala que»los hechos denunciados a la CIDH podrían constituir daños irreparables al derecho de libertad de expresión» de los demandados» y solicitó al gobierno del Ecuador que «suspenda de inmediato los efectos de la sentencia del 15 de febrero de 2012, a fin de garantizar el derecho a la libertad de expresión», reza la carta que fue difundida por El Universo.
Simultaneamente, la CIDH convocó a una audiencia para el próximo 28 de marzo en su sede en Washington, con el fin de «recibir información de las partes sobre la adopción y vigencia» de las medidas cautelares, que se mantendrán hasta la celebración de dicha diligencia. Posterior a esta audiencia, este organismo evaluará si continúa con ellas, las modifica o levanta, según se especifica en su carta.
Para Xavier Zavala Egas, abogado de la compañía que edita diario El Universo, la decisión de la CIDH «ha sido prudente y adecuada» y considera que el Estado ecuatoriano no tiene más alternativas que acatar estas medidas para evitar el reproche internacional .
De su parte, el canciller de Ecuador Ricadro Patiño aseguró que van a revisar cuál es el fundamento para las medidas cautelares que solicitan y en función de eso responderán, aclarando que es una solicitud y no una orden. «La capacidad que tienen algunos empresarios periodísticos del país es muy grande, lograron mover a la CIDH.
Ahora tenemos a la CIDH todos los días atrás de nosotros interfiriendo en el sistema judicial ecuatoriano (…) ya vamos a ver la respuesta que los señores de la CIDH se merecen». En cuanto a la audiencia prevista para marzo, en Washington añadió «le diremos a la CIDH lo que se merece recibir», apuntó Patiño en el boletín de prensa No 165 emitido por la Cancillería ecuatoriana.
Iachr grants precautionary measures in El Universo case
On 22 February 2012, the Inter American Commission on Human Rights (IACHR), requested the Ecuadorian State to adopt precautionary measures in favor of the newspaper El Universo’s directors, Carlos, César and Nicolas Pérez, and its former Opinion editor, Emilio Palacio. The measures would mean the suspension of the effects of the sentence that convicted the accused to three years in prison and the payment of $40 million for the crime of offences against President Rafael Correa.
The IACHR pointed out in a letter signed by Santiago Canton, its executive director, that “the events denounced to the IACHR could constitute irreparable damage to the defendants’ freedom of expression” and requested the Ecuadorian government to “suspend immediately the effects of the sentence issued on 15 February 2012, in order to guarantee the freedom of expression”. The letter was published by El Universo.
The IACHR simultaneously called for a hearing on 28 March 2012 in its Washington headquarters, in order to “receive information from the parties involved about the adoption and enforcement” of the precautionary measures, which should be maintained until that date.The letter also specified that the organization would evaluate if the measures should continue to be applied, be modified or lifted after the hearing.
For Xavier Zavala Egas, attorney of the company that edits the newspaper, the IACHR’s decision “has been prudent and adequate”. He believes that the Ecuadorian State has no alternative but to comply with these measures if it is to avoid international reproach.
Meanwhile, the Ecuadorian minister of foreign affairs, Ricardo Patiño, stated that the government will review the foundation for the precautionary measures requested and will respond accordingly, making it clear that they are dealing with a request, not an order.“The capacity of some of the country’s journalistic entrepreneurs is very large, they managed to move the IACHR.Now we have the IACHR behind us every day, interfering with the Ecuadorian legal system (…)we will see what reply is deserved by the members of the IACHR».Regarding the hearing called for in Washington in March, “we will give the IACHR what it deserves to receive”, he pointed out in press release No 165 issued by the Ecuadorian Ministry of Foreign Affairs.
