El 30 de noviembre de 2011, el Juzgado Vigésimo Cuarto de Garantías Penales del Guayas dictó el auto de llamamiento a juicio y la orden de captura contra el ciudadano Víctor Vizcaíno Luzuriaga, acusado de ofender al ex Fiscal General de la Nación, Washington Pesántez, a través de un blog.
De acuerdo con el oficio No. 1064-2011, dirigido al jefe provincial de la policía judicial del Guayas, Vizcaíno no cumplió con las medidas cautelares ordenadas por la Fiscalía, por lo cual ordena que: «Dentro de la Instrucción Fiscal No.1064-2011, seguida contra VICTOR ANTONIO VIZCAINO LUZURIAGA, por el Delito de CONTRA LA ADMINISTRACION PUBLICA. Se ha dispuesto oficiar a Ud., a fin de hacerle conocer que se ha dictado AUTO de PRISION PREVENTIVA en contra del referido procesado, como el mismo no se encuentra detenido, se dispone que personal bajo su mando procedan a su localización y captura, aprehendido que fuere sea trasladado hasta el Centro de Rehabilitación Social de Varones de Guayaquil, donde permanecerá a ordenes de esta Judicatura», reza el escrito.
El pasado 03 de mayo, Vizcaíno fue detenido durante 24 horas con fines investigativos por agentes policiales, quienes le indicaron que sobre él caía una orden de detención emitida el pasado 19 de abril, por el Juzgado Vigésimo Cuarto de Garantías Penales de Pichincha, a pedido del Fiscal de la Unidad Especializada de la Administración Pública de Pichincha, Miguel Jurado Fabara, por presuntas ofensas a Washington Pesántez, en ese entonces, Fiscal General del Estado, escritas a través del blog www.laplegariadeunpagano.com, de su presunta autoría.
Para ese entonces, el ciudadano fue liberado al día siguiente, después que el juez Vigésimo de Garantías Penales de Pichincha, Juan Pablo Hernández, reemplazó la orden de prisión que pesaba en su contra, por otras medidas cautelares que contemplaban el impedimento de acercarse a Pesántez y su familia; el no iniciar actos de intimidación y el presentarse cada 10 días ante el Fiscal del Guayas .
Según una fuente cercana al bloguero y que pidió la reserva de su nombre aseguró que hace apenas dos días, Vizcaíno se enteró, por medio de sus vecinos, que estaba siendo requerido por la policía y que desconocía de esta orden de captura porque la abogada que el Estado le asignó para su defensa, no le notificó.
En declaraciones anteriores a FUNDAMEDIOS el, en ese entonces, abogado de Vizcaíno en Quito, Carlos Moya Rueda, aseguró que su cliente no era el autor de estas ofensas escritas en el blog y que eso lo demostrarán técnica y jurídicamente ya que se trataba de una suplantación de identidad.
Citizen accused of offending former prosecutor through a blog is sentenced to prison again
On 30 November 2011, the 24th Criminal Guarantees Court of Guayas issued a summons to trial and order for the arrest of citizenVíctorVizcaínoLuzuriaga, accused of offending the former Prosecutor General, Washington Pesántez, through a blog.
According to official document No.1064-2011, addressed to the provincial chief of Guayas’ judicial police, Vizcaíno did not comply with the precautionary measures ordered by the Prosecutor’s Office. Therefore:“As part of the Prosecution Hearing No. 1064-2011, against VICTOR ANTONIO VIZCAINO LUZURIAGA, for a Crime AGAINST THE PUBLIC ADMINISTRATION.We inform you that a PREVENTIVE CUSTODY ORDER has been issued against the person in question. Because he is currently not detained, personnel under your command should proceed to find and arrest him. Once detained he should be taken to the Men’s Social Rehabilitation Center of Guayaquil, where he shall remain under the orders of this Judicature”.
On 3 May 2011, Vizcaíno was detained for 24 hours in order to be investigated by police agents who told him that the 24th Criminal Guarantees Court of Pichincha had issued a warrant for his arrest on 19 April. The warrant was issued by request of Pichincha’s Public Administration Specialized Unit’s Prosecutor, Miguel JuradoFabara, for alleged offences against Washington Pesántez, who was at the time the State’s Prosecutor General. The offences had been allegedly published in the blog www.laplegariadeunpagano.compresumed to have been written by Vizcaíno.
Vizcaínowas released the following day, after the 20th Judge of Criminal Guarantees of Pichincha, Juan Pablo Hernández, replaced the prison sentence by other precautionary measures that included the prohibition to approach Pesántez and his family; not initiating intimidating acts; and appearing before the Guayas Prosecutor every 10 days.
According to a source close to the blogger, who requested that his name not be revealed, Vizcaíno was told two days before by his neighbors that the Police were looking him for. He had not found out about the warrant for his arrest because the lawyer assigned to him by the State, had not notified him.
Vizcaíno’s attorney in Quito at the time, Carlos Moya Rueda, had stated to FUNDAMEDIOS in previous declarations that his client was not the author of the offences written in the blog and that he would prove that technically and from a legal standpoint. He said it was a case of stolen identity.
