Defensa de diario El Universo denuncia irregularidades en juicio por $80 millones que les sigue el Presidente de la República

El 01 de junio de 2011, la jueza temporal Mónica Encalada, recientemente designada para conocer la querella interpuesta por el presidente Rafael Correa en contra de diario El Universo, sus Directivos; Carlos, César y Nicolás Pérez y el Editor de Opinión Emilio Palacio, por supuesta injuria calumniosa, dictó una providencia donde fijó la fecha para la audiencia final. Sin embargo, la defensa del diario y de Palacio anunció que impugnará esta decisión por irregularidades en el proceso.

A través de una nota publicada por El Universo el 04 de junio, se denunció que la jueza temporal, quien es la cuarta magistrada a la que se designa el caso, dictó una providencia en menos de tres horas de haber asumido el cargo y negó casi todas las pruebas procesales que han solicitado los querellados, entre las que se incluyen: grabaciones de las cadenas sabatinas, donde el Presidente ataca al diario; exhortos a la prensa internacional y pericias lingüísticas solicitadas por el articulista Emilio Palacio.

Xavier Zavala, abogado de la Compañía Anónima El Universo aseguró que, tras negarse el 95% de las pruebas solicitadas por los querellados, «es evidente la indefensión y que van hacia una sentencia condenatoria que seguramente ya está redactada».

De acuerdo con una publicación de diario El Comercio, la única prueba que aceptó la jueza por parte de los demandados fue la presencia de 12 testigos. Sin embargo, ese medio aseguró que los abogados del presidente Correa, Alembert y Gutemberg Vera, pidieron que se reduzca ese número a la mitad y advirtieron a los testigos que el Código de Procedimiento Penal faculta disponer la detención del testigo «sospechoso de faltar a la verdad».

En entrevista para el programa La Mañana 24 Horas, de Teleamazonas, Zavala dijo que el proceso se ha enrarecido y no entiende cómo pueden calificar la pertinencia o no de una prueba si no se lee la acusación ni las contestaciones. «Estamos por el cuarto juez, es que hasta ahora no tenemos a uno que con dignidad y sapiencia escape del poder político».

Por su parte, Emilio Palacio anunció que, tras fijarse la audiencia para el 19 de julio se ha quedado en «completa indefensión jurídica» puesto que no se le permite presentar pruebas.

En tanto, el abogado del Presidentes, Alembert Vera dijo a Fundamedios estar seguro que van a ganar el juicio: «hemos demostrado la verdad procesal y por eso debemos ganar; más que nada, porque ellos han aceptado tácitamente que son culpables del delito porque en ningún momento han dicho que no lo son».

Cabe recordar que, el medio, sus directivos y Emilio Palacio fueron demandados por el presidente Rafael Correa por un artículo de Palacio publicado el pasado 6 de febrero. En la querella, el Jefe de Estado pide tres años de prisión para cada uno de los demandados y una indemnización de $80 millones.

El Universo’s counsel denounces irregularities in lawsuit for $80 million filed by the president of the republic

On 1 july 2011, temporary judge MónicaEncalada, recently designated to try the case filed by President Rafael Correa against the newspaper El Universo, its directors Carlos, César and Nicolás Pérez, and editorialist Emilio Palacio for alleged aggravated slander, issued an order setting the date for the final hearing. The paper and Palacio’s counsel, however, has announced that he will challenge this decision on the basis of irregularities during the process.

Through a press release published by El Universo on 4 july, the attorney denounced that the temporary judge, who is the fourth magistrate to have been assigned the case, issued an order less than three hours after having taken her post and rejected nearly all the evidence requested by the defendants, among them:recordings of the president’s Saturday radio and TV programs in which he attacks the newspaper; formal requests to the international press and linguistic experts’ opinions requested by editorialist Emilio Palacio.

Xavier Zavala, lawyer of CompañíaAnónima El Universo, stated that the rejection of 95% of the defendants’ requested evidence «manifests their defenselessness and the fact that they head towards a convicting sentence that has surely already been written».

According to an article published by the newspaper El Comercio, the only evidence in favor of the defendants accepted by the judge was the presence of 12 witnesses.The paper also stated, however, that President Correa’s lawyers, Alembert and Gutemberg Vera, requested that that number should be reduced to half and warned the witnesses that the Code of Criminal Procedure allows witnesses who are «suspected of not telling the truth» to be detained.

In an interview for Teleamazonas program La Mañana 24 Horas, Zavala said that the process has deteriorated and that he cannot understand how evidence can be deemed to be pertinent or not if neither the accusation nor the defendants’ pleas are read. «This is our fourth judge, because one that escapes the political power with dignity and sapience hasn’t been found yet».

On the other hand, Emilio Palacio announced that now the hearing has been set for 19 July, he has been left «completely legally defenseless» because he is not allowed to present evidence. «I have no weapons and my hands are tied behind my back, but I don’t believe they can keep me quiet forever», declared Palacio during a press conference.

Meanwhile the president’s lawyer, Alembert Vera, declared to Fundamedios that he is certain they will win the case:»we have proven procedural truth so we must win; mainly because they have tacitly accepted they are guilty of the crime because they have never said they are not».

It is worth remembering that the newspaper, its directors and Emilio Palacio were sued by President Rafael Correa because of an article written by Palacio and published on 6 February.The Chief of State is requesting a three year prison sentence for each of the accused and $80 million in reparations.
