El 24 de abril de 2012, el diario del Estado El Telégrafo, descalificó a FUNDAMEDIOS a través de una nota que fue difundida en su edición impresa bajo el título Fundamedios llama a preguntar por un editorial no publicado.
Esta publicación se dio después de que la organización se comunicó con Orlando Pérez, director de ese medio, como parte de un proceso normal de verificación de datos ante una denuncia de censura.
Parte de la nota dice que “de manera pública le decimos a Fundamedios que no se preocupe por nuestra tarea editorial, no está en sus potestades pedir explicaciones a la dirección editorial sobre lo que se publica o no en nuestras páginas.»
La nota continúa con los descalificativos en contra de la Organización con la siguiente frase: “no está por demás subrayar que esa entidad no gubernamental, que no tiene reconocimiento ni autoridad sobre los medios no dependientes de empresas de comunicación, la misma que ha enunciado criterios y postulados no sustentados en la realidad sino en prejuicios y principios ajenos a nuestra realidad, sometidos particularmente a intereses de empresas periodísticas antes que de los periodistas y reporteros, tendría que preguntar primero por nuestras políticas editoriales, si fuese del caso”.
FUNDAMEDIOS ha estado investigando dos casos en los que se denuncia censura. Uno de ellos es el caso del articulista Juan Cárdenas Espinoza, quien había sido columnista de diario El Mercurio de Cuenca durante 13 años.
Cárdenas denunció haber sido censurado por ese medio el 18 de abril, a través de una columna de opinión, en calidad de invitado, que se publicó en diario El Telégrafo bajo el título ¡Censura! En ella, el articulista aseguró que el rotativo dejó de publicar sus notas de opinión sin recibir explicación, coincidiendo con las marchas de oposición al régimen que ocurrieron a finales de marzo.
En diálogo con FUNDAMEDIOS, Cárdenas, quien se desempeña como funcionario del Servicio de Rentas Internas en Cañar, comentó que el último artículo que publicaron de su autoría fue uno que se titulaba Vamos a las marcha, del 02 de marzo.
A partir de allí, desapareció su columna. Situación que llamó su atención puesto que no fue notificado de que prescindirían de ella y tampoco recibió una respuesta del Director. Sin embargo aclaró que no fue censurado por un artículo específico.
El segundo caso que se ha estado investigando y que motivó la publicación de la advertencia por parte del diario del Estado fue la denuncia de censura que hizo el articulista William Sánchez el pasado 22 de abril, quien afirmó que El Telégrafo dejó de publicar sus artículos dominicales, desde el 15 de abril.
Sánchez, quien ha colaborado en ese medio, desde mayo de 2010, dijo a FUNDAMEDIOS que al parecer, el artículo que tenía que publicarse el 15 de abril bajo el título Todos Somos Como La Hierba, “los ha molestado debido a que se hace una alusión a que no hay que endiosarse por el poder”.Según Sánchez, al percatarse de que su artículo no fue publicado, envió tres mensajes de correo electrónico al director del medio, Orlando Pérez, sin recibir una respuesta, hasta que el 19 de abril contactó a Pérez por la red social Facebook y su respuesta fue la siguiente:“Como usted sabe, el diario tiene la potestad de publicar o no. No tenemos un registro de un compromiso de publicarlo siempre que nos lo manda, ¿verdad? O si usted tiene firmado un convenio con el diario, le ruego hacérmelo llegar”.
Pese a esta respuesta, El director de El Telégrafo afirmó en su nota que es sorpresivo “que la queja la haya hecho uno de nuestros editorialistas, sin antes dialogar con las autoridades de esta institución.
El articulista aseguró que, si bien no tiene un contrato firmado con el medio, sí percibía una remuneración por artículo enviado. Sin embargo ya han pasado dos domingos que dejaron de publicar sus notas de opinión.
Cuando FUNDAMEDIOS intentó conocer la opinión de Pérez, este prefirió no pronunciarse al respecto y simplemente dijo: “El sabe cuál es mi respuesta”.Celebramos que una simple llamada telefónica de nuestra parte, haya motivado la reacción de los directivos El Telégrafo y su cambio de actitud para disponerse a dialogar con un articulista que denunció un acto de censura en un medio que se financia con dineros públicos .
Al mismo tiempo, fieles a nuestra misión institucional, sin caer en provocaciones, pero de manera firme, FUNDAMEDIOS reitera que seguirá vigilante de posibles violaciones al derecho fundamental a la libre expresión, lo cual incluye la vigilancia sobre los medios estatales.
Quienes han sido nombrados directivos de estos medios deben entender que, por su misma naturaleza, están obligados a rendir cuentas a todos los ciudadanos y a las organizaciones que representamos formas legítimas y legales de participación en una sociedad democrática.
State newspaper issues warning to fundamedios after it investigated reports about censorship
On 24 April 2012, the State newspaper El Telégrafo discredited FUNDAMEDIOS through an article that was published in its printed edition with the title Fundamedios calls to ask about an unpublished editorial.
This took place after the organization got in touch with Orlando Pérez, the newspaper’s editor, as part of a normal process to verify information after receiving a report about censorship.
Part of the article says “we publicly tell Fundamedios not to concern itself with our editorial work, it is not in its power to ask the editorial management for explanations about what is published or not in our pages”.
The piece continued discrediting the Organization stating that:“it is worth highlighting that this non-governmental entity, which has not been recognized and has no authority over media that do not depend on communication companies, which has enunciated criteria and premises that are irrelevant to our reality, subject particularly to the interests of journalistic businesses before those of journalists and reporters, should ask first about our editorial policies, if it were pertinent».
FUNDAMEDIOS has been investigating two cases of reported censorship.One of them is the case of feature writer Juan Cárdenas Espinoza, who had been a columnist for the newspaper El Mercurio of Cuenca for 13 years.
Cárdenas denounced he was censored by El Mercurio on 18 April through an opinion column, published by him as a guest in the newspaper El Telégrafo, with the titleCensorship!In it the feature writer stated that the newspaper stopped publishing his opinion pieces without providing an explanation, coinciding with the marches against the government which took place in March.
In a conversation with FUNDAMEDIOS, Cárdenas, who works as an official at the Internal Revenue Service in Cañar, commented that his last published article was titled Let’s join the march, on 2 March.His column has disappeared since then.This caught his attention because he had not been notified they would do without it and he did not receive a reply from the editor.He stated, however, that he was not censored because of one article in particular.
The second case that is being investigated, which triggered the warning published by the State newspaper, was the report issued by feature writer William Sánchez on 22 April, who stated that El Telégrafo stopped publishing his Sunday articles on 15 April.
Sánchez, who has collaborated with that newspaper since May 2010, told FUNDAMEDIOSthat apparently the article that was to be published on 15 April with the title We Are All Like Grass, “has annoyed them because there is an allusion to the fact that power should not lead one to believe one is god».
According to Sánchez, when he noticed his article had not been published he sent three emails to the newspaper’s editor, Orlando Pérez, but did not receive a reply. On 19 April he contacted Pérez through Facebook and the editor’s reply was:
“As you know, the newspaper has the faculty to publish or not.We have not signed an agreement stating we will publish an article every time you send one, have we?If you have signed an agreement with the newspaper, please pass it on”.
Despite this reply, El Telégrafo’s editor stated in his piece that it was surprising “that the complaint was made by one of our editorial writers, without having talked to the institution’s authorities beforehand».
The feature writer stated that although he has not signed a contract with the newspaper, he did receive payment for each article he sent.His opinion articles, however, were not published the last two Sundays.
When FUNDAMEDIOS asked to know Pérez’s opinion, he preferred not to speak out and simply said:“He knows my answer”.
We celebrate that one simple phone call made by us caused a reaction among El Telégrafo’s executives and a change of attitude in their willingness to dialogue with a feature writer who denounced an act of censorship in a media outlet that is financed with public resources.At the same time, in keeping with our institutional mission, without falling prey to provocations, but firmly, FUNDAMEDIOS reiterates that it will remain alert to possible violations of the fundamental right to the freedom of expression, which includes monitoring State media.
Those who have been named to executive positions in those media outlets must understand that, because of their own nature, they are accountable to every citizen and the organizations that represent legitimate and legal ways to participate in a democratic society.
