El sábado 13 de noviembre de 2010, diario El Comercio publicó un comunicado en el que denunció que: «A través de algunos medios de comunicación de propiedad del Estado, se ha emprendido una campaña de desprestigio contra Grupo El Comercio…»
Este pronunciamiento se dio luego de que a partir del 8 de noviembre, Gama TV (canal incautado de propiedad del Estado) comenzó a emitir una serie de notas que denunciaban una presunta evasión de impuestos por parte del rotativo en la importación de unos libros infantiles para colorear que se declararon como enciclopedias exentas de impuestos y la autoridad aduanera afirma que son cuadernillos que deben pagar el 30% de impuestos, es decir $60.000 dólares para el Fisco.
En el comunicado emitido por diario El Comercio se manifiesta que «jamás existió el ánimo deliberado de evadir impuestos… (y) que tampoco existe un delito aduanero» y que lo ocurrido fue producto de una discrepancia respecto de la utilización de la partida arancelaria.
A partir del 9 de noviembre, los demás canales en manos del Estado (Ecuador TV, TC Televisión) comenzaron a emitir notas al respecto. El 8 de noviembre en la mañana, el entrevistador de Gama TV Carlos Ochoa comentó sobre la noticia de una posible evasión de impuestos por parte del rotativo capitalino y criticó, en tono sarcástico, a los medios «independientes por dar clases de moral, cuando son los que comenten este tipo de ilícitos.»
El 11 de noviembre diario El Telégrafo, de propiedad del Estado publicó una investigación en la que detalla lo denunciado por Gama TV. Finalmente, la también estatal Agencia ANDES y el periódico virtual Ecuadorinmediato.com también han publicado por Internet notas al respecto.
Esta serie de emisiones fueron rechazadas por El Comercio y señaló que existe una campaña por desprestigiar al diario -uno de los más antiguos y de mayor circulación-, e hizo notar que el caso aún se encuentra en una fase de indagación previa por parte de la Fiscalía .
Cabe destacar que según el último inciso del artículo 215 del Código de Procedimiento Penal que literalmente consagra: «Sin perjuicio de las garantías del debido proceso y del derecho a la defensa; las actuaciones del Ministerio Público y de la Policía Judicial para el esclarecimiento del delito durante la indagación previa, se mantendrán en reserva del público en general, sin perjuicio del derecho del ofendido y de las personas a las cuales se investiga de tener acceso inmediato, efectivo y suficiente de las investigaciones. Los fiscales, los investigadores, los jueces, el personal policial y los demás funcionarios que habiendo intervenido en estas actuaciones, las divulguen o pongan de cualquier modo en peligro el éxito de la investigación, serán sancionados conforme a lo previsto en el Código Penal.»
Newspaper denounces discrediting campaign by government controlled media
On Saturday 13 November 2010, the newspaper El Comercio published a press release denouncing that: «A campaign to discredit the newspaper El Comercio has been undertaken by some State owned media…»
This was published after Gama TV (a seized TV station, now property of the State) started to broadcast on 8 November a series of reports accusing the station of tax evasion after it imported children’s coloring books declaring they were tax free encyclopedias. The customs authorities have stated that they are workbooks for which a 30% tax should be paid, amounting to US$60,000 to be received by the IRS.
The newspaper has declared that «a deliberate plan to evade taxes never existed… (and) no crime against the customs department has been committed». What happened was the product of a discrepancy regarding the tariff code.
The remaining State controlled TV stations (Ecuador TV, TC Televisión) started to broadcast information about the same case on 9 November. During the morning of 8 November, Gama TV interviewer Carlos Ochoa commented on the alleged tax evasion by the Quito newspaper and was sarcastic in his criticism of «independent media that teach about morals when they are the ones who commit this kind of crime».
On 11 November the newspaper El Telégrafo, also property of the State, published a detailed investigation of Gama TV’s accusation. The State’s news agency ANDES and the virtual newspaper Ecuadorinmediato.com have also voiced their opinions through the internet.
All these accusations have been rejected by El Comercio. The newspaper’s spokespersons pointed out a campaign has been organized to discredit the paper – one of the oldest and with the highest circulation – and pointed out that the case is still in a stage when preliminary enquiries are being made by the Prosecutor’s Office.
It is worth highlighting that the last subsection of article 215 of the Penal Procedure Code states literally that: «Without detriment to the guarantees of due process and the right to defense; the Public Prosecutors Office and the Judicial Police’s actions for the elucidation of the crime during the preliminary investigations will remain undisclosed to the general public, without prejudice to the right of the injured party and the persons being investigated to have immediate, effective and sufficient access to the investigations. If any of the prosecutors, investigators, judges, police staff and other officials who have participated in these activities should make them public or in any way endanger the investigation’s success, they will be sanctioned in accordance to the Criminal Code».
