El 12 de junio de 2015, la Superintendencia de la Información y Comunicación (Supercom) sancionó a diario Expreso con la obligación de presentar disculpas públicas y difundir nuevamente una rectificación a pedido Richard Espinosa, presidente del Consejo Directivo del Instituto Ecuatoriano de Seguridad social IESS, por la nota titulada: “IESS: ni créditos ni salud para los nuevos afiliados”, publicada el 5 de mayo de 2015.
Espinosa denunció al medio de comunicación tras sentirse inconforme con la rectificación publicada el pasado 12 de mayo, porque supuestamente no fue presentada en los términos que establece la ley, ni divulgada con la diagramación y los títulos remitidos por el Funcionario. La Supercom concluyó que la nota periodística referida “no cumplió con los principios de verificación, contrastación y precisión, puesto que no constató si los hechos narrados efectivamente sucedieron, tampoco se recogió, ni publicó las versiones de las personas involucradas en dichos hechos. Además, no viabilizó adecuadamente lo que indica el artículo 23 de la LOC, debido a que al publicar la rectificación lo hizo con el título ‘pedido de réplica’ y lo que corresponde es ‘rectificación’ o ‘aclaración’ ”.
Durante la audiencia de sustanciación el pasado 5 de junio, la defensa del medio sostuvo que la noticia que publicó tuvo como finalidad informar respecto a la afiliación al IESS de tres grupos especiales de trabajadores sin relación de dependencia y señaló que la rectificación realizada “fue una aclaración respecto al artículo referido por el señor Espinoza, en el cual no se trataba sobre la afiliación de las amas de casa, sino acerca de los nuevos grupos que se estudia incorporar el IESS; la nota lo que quería decir y quería informar es que, en estos nuevos tres segmentos o nuevas modalidades que se están estudiando, no hay efectivamente la posibilidad, hasta el momento, ni de créditos, ni de salud otorgados por el IESS”.
Por su parte, Espinosa, agregó que “es evidente que por la falta de pruebas el medio de comunicación trate de menoscabar la información que se dio a conocer, y que, la rectificación solicitada no fue presentada en los términos que establece la ley” . En ese sentido, el Funcionario añadió: “No nos vamos a doblegar ante los medios de comunicación, si es que los medios de comunicación tienen que llenar sus periódicos de rectificación, y si es que las rectificaciones superan a las noticias, pues bienvenida la Ley Orgánica de Comunicación, al fin los ciudadanos, estoy hablando de los ciudadanos y también como autoridad, tenemos derecho a la réplica, tenemos el derecho a informar adecuadamente a la ciudadanía”.
Tras la sanción, diario Expreso Diario acogió la sanción de la entidad de control y pidió disculpas a Espinosa y afirmaron tener “convencimiento de que obramos cumpliendo con todos los requisitos exigidos con la citada información”.
Newspaper is forced to publish rectification and to apologize to official
On 12 June 2015, the Superintendency of Information and Communication (Supercom) sanctioned the newspaper Expreso with the obligation to publicly apologize and once again publish a rectification requested by Richard Espinosa, president of the Board of Directors of the Ecuadorian Social Security Institute IESS, because of an article titled: «IESS neither credits nor health for new affiliates», published on 5 May 2015.
Espinosa filed a complaint against the newspaper because he felt dissatisfied with the rectification published on 12 May. He stated the paper had failed to comply with the terms established by law and had not included the layout and headlines submitted by the Official. Supercom concluded that the newspaper article in question «did not comply with the principles of verification, corroboration and accuracy, since it had not verified if the events described had actually happened, and neither had it collected nor published the versions of those people who were involved in the events. It added, moreover, that the newspaper had not adequately observed Article 23 of LOC, because it had published the rectification under the title ‘reply request’ when it should have said ‘rectification’ or ‘clarification'».
During the substantiation hearing on 5 June, the newspaper’s defense stated that the article published aimed to inform about the affiliation to the IESS of three special groups of workers who do not have a full time agreement with their employers and pointed out that the rectification published «was a clarification of the article referred to by Mr. Espinoza, in which there was no mention of the affiliation of housewives, but about the new groups that are being considered for affiliation to the IESS; what the article meant and wanted to report is that these three new segments or new modalities being considered would not, so far, enjoy the possibility of receiving credits or health benefits form the IESS».
Espinosa, meanwhile, added that «it is clear that the lack of evidence has led the media outlet to undermine the information disclosed, and that the rectification requested was not published under the terms established by law». The official said: «We will not bow to the media, if the media have to fill their pages with rectifications and if these rectifications outweigh the news, then I welcome the Organic Communications Law. The citizens after all, I’m talking about citizens and also as an authority, enjoy the right of reply, we have the right to properly inform the public».
Expreso accepted the control entity’s sanction and apologized to Espinosa, claiming to be «convinced that, when it comes to this information, we complied with every requirement».
