El 4 de septiembre de 2015 Radio Impacto de Sucúa –ubicada en la región amazónica de Morona Santiago- dejó de transmitir su señal tras 17 años al aire, por una decisión de la Agencia de Regulación y Control de las Telecomunicaciones (Arcotel). María Luisa Delgado, directora de la radio denunció que existieron presiones políticas para el cierre del medio por pugnas con autoridades locales.
La emisora apagó sus equipos y salió del aire después de recibir una notificación de la agencia gubernamental Arcotel mediante la cual se decidió “dar por terminado unilateralmente y anticipadamente el contrato de concesión suscrito el 17 de noviembre de 1997, con el señor Alfredo Gilberto Vizuete Villagomez, de la frecuencia 106.1 MHz.” Según el oficio Nro. ARCOTEL-DGDA-2015-0373-OF, el concesionario incumplió con la disposición que prohíbe el arrendamiento y transferibilidad de la concesión, contemplado en los artículos 112, numeral 7; y 117 de la Ley Orgánica de Comunicación (LOC).
Sin embargo, Delgado cuestionó esta decisión y aclaró que no existió mala fe ni incumplimiento. En ese sentido explicó que su esposo, Alfredo Vizuete ganó el pasado 10 de diciembre de 2013 un concurso para ser notario de ese cantón, por lo que, como una decisión ética y para deslindarse de las actividades de la radio, nombró a su hijo administrador. Al notar que la capacidad de maniobra comercial de este era limitada y en un intento por permitir que esa administración tenga la mayor autonomía posible, otorgó ese contrato de arrendamiento, el cual posteriormente intentó ser revocado sin éxito, pues la Arcotel ya había iniciado el proceso para retirar la frecuencia .
En los documentos a los que tuvo acceso Fundamedios la defensa del medio de comunicación aclaró que “no se trataba de un contrato de arrendamiento per se, sino de un acuerdo de administración de la radio, tendiente a permitir que mi hijo ejerza los actos comerciales de sostenimiento de la operación -como por ejemplo, firmar contratos de pautaje-, sin que ello signifique que yo pierda el control efectivo de la estación”. Pero, más allá de los argumentos jurídicos, Delgado aseguró que esta decisión podría responder a presiones políticas por la línea editorial crítica de la radio. “Hemos sacado a relucir muchas situaciones negativas en la administración municipal”, comentó. En ese sentido subrayó que han cumplido la ley y que nunca han tenido un llamado de atención, por lo que le da la impresión que esto es netamente político, pues incluso ese mismo día, el Alcalde de la localidad, quien es del partido de gobierno Alianza PAÍS se había pronunciado públicamente advirtiendo a los medios radiales que podrían perder su frecuencia si incumplen con la Ley.
Radio station stops broadcasting and denounces political pressure
On 4 September 2015, Radio Impacto of Sucúa – located in the Amazon region of Morona Santiago – stopped broadcasting its signal after 17 years on the air as a result of a decision made by the Agency for the Regulation and Control of Telecommunications (Arcotel). María Luisa Delgado, director of the radio, denounced the existence of political pressure for the closure of the media outlet due to conflicts with local authorities.
The station switched off its equipment and went off the air after receiving a notification from the government agency Arcotel stating it had been decided to «terminate unilaterally and in advance the concession contract signed on 17 November 1997, with Mr. Alfredo Gilberto Vizuete Villagomez, regarding frequency 106.1 MHz». According to official communication No. ARCOTEL-DGDA-2015-0373-OF, the licensee breached the provision that banned the lease and transfer of the concession, referred to in Article 112, paragraph 7; and 117 of the Organic Communication Law (LOC).
However, Delgado challenged this decision and made clear that there was no bad faith or non-compliance. In this regard, she explained that her husband, Alfredo Vizuete, won on 10 December 2013 a public tender to become a notary of the district. For this reason, making an ethical decision to distance himself from the activities of the radio, he appointed his son as manager. Realizing that his capacity for commercial maneuvering was limited and in an attempt to allow the administration to have the greatest possible autonomy, he leased the concession, and then unsuccessfully tried to revoke the contract, because Arcotel had already started the process to withdraw the frequency.
In documents to which Fundamedios had access, the media outlet’s defense made it clear that «this was not the case of a lease contract per se, but an agreement to manage the radio station, aimed at allowing my son to exercise the commercial actions needed for sustaining its operations – for example, signing advertisement contracts -, without this meaning that I lost the effective control of the station.” However, beyond any legal arguments, Delgado asserted that the decision might respond to political pressure due to the radio’s critical editorial line. «We have brought to light many negative situations in the municipal administration,» she said. She also stressed that they have complied with the law and that they have never received a call to attention, reason why she has the impression that this case is purely political, because on that same day, the town mayor, who is a member of the ruling party Alianza PAÍS, spoke publicly warning radio stations that they could lose their frequencies if they broke the Law.
