El miércoles 29 de septiembre de 2010, María De Los Ángeles Duarte, Ministra de Transporte y Obras Públicas, envió una carta a los periodistas Juan Carlos Calderón y Cristian Zurita autores del libro «El Gran Hermano», para que «comparezcan» a la primera Sala del Tribunal Distrital de lo Contencioso Administrativo No. 1 y rindan declaraciones sobre las investigaciones que recoge el libro antes mencionado.
En la carta se menciona que los autores de la obra deberán presentarse a partir del jueves 30 de septiembre hasta que finalice el término de prueba para rendir «su testimonio al tenor del pliego de preguntas formuladas por esta Cartera de Estado». La misiva contiene los logotipos oficiales y la leyenda «Despacho Ministerial».
Juristas consultados por Fundamedios, coinciden en señalar que al realizar la citación de manera directa, la funcionaria se atribuye funciones que corresponden a una autoridad judicial, lo que viola garantías constitucionales al debido proceso.
Los periodistas no se presentaron a la citación y señalaron que no rendirán declaración alguna si es que no reciben notificación de autoridad judicial competente.
Esta es la tercera carta que Duarte envía a los autores del libro. La primera fue remitida el pasado 01 de septiembre, en la cual la funcionaria cuestionaba el pie de una foto incluida en el libro donde se menciona que la concesión de un contrato al hermano del Presidente fue realizada durante su gestión, afirmación que a juicio de Duarte es «erróneo» y «carece de sustento y veracidad».
La segunda carta fue enviada el 17 de septiembre. En ésta, Duarte amenazó a Calderón, uno de los autores de la obra, con tomar acciones legales si no recupera los libros vendidos y evita «la circulación de los mismos por contener afirmaciones que no corresponden a la realidad» . Las dos cartas antes mencionadas contienen logotipos oficiales y tienen el sello de «Despacho Ministerial».
El Secretario Jurídico de la Presidencia, Alexis Mera, solicitó a los periodistas declarar respecto al hermano del Presidente, Fabricio Correa, y los contratos con el Estado, según se recogió en una nota periodística de diario El Universo.
Por su parte los autores de la obra argumentaron que la investigación que recopila el libro, es verdad y está debidamente sustentada.
Minister «summons» journalists to make statements in a new letter
On Wednesday 29 September 2010, María De Los Ángeles Duarte, Minister of Transport and Public Works, sent a letter to journalists Juan Carlos Calderón and Cristian Zurita, authors of the book «El Gran Hermano», summoning them to «appear» before the 1st District Court for Contentious Administrative Proceedings and make statements about the investigations recorded in the aforementioned book.
The letter states that the book’s authors will have to appear from Thursday 30 September until the trial term ends to present «their testimony regarding the contents of the list of questions formulated by this State Portfolio». The letter has official logos and the inscription «Ministerial Office».
Lawyers consulted by Fundamedios agree that by summoning the men directly, the minister is assuming functions that correspond to a judicial authority, infringing the Constitution’s guarantee of due process.
The journalists did not comply with the summons and declared that they will not make any statements unless they are called to do so by a relevant judicial authority.
This is the third letter sent by Duarte to the book’s authors. In the first one, sent on 1 September, the high ranking official questioned the caption of a photograph included in the book that mentions the part she played in the concession of a contract to the President’s brother, something she stated was «erroneous» and «lacking evidence and veracity».
The second letter was sent on 17 September. In this one Duarte threatened Calderón, one of the book’s authors, with taking legal action if sold copies of the book were not retrieved and the «circulation of them» not avoided, seeing that they «contain allegations that do not match reality». The two aforementioned letters included official logos and a seal that reads «Ministerial Office».
According to a news item published in the newspaper El Universo, the Presidency’s Legal Secretary, Alexis Mera, requested that the journalists should make statements about the President’s brother, Fabricio Correa, and the contracts with the State.
The book’s authors have argued that their investigation has uncovered a truth that is duly supported by evidence.
