El 11 de marzo de 2015, la Intendencia Zonal 6 de la Información y Comunicación, mediante un proceso iniciado de oficio sancionó, con una amonestación escrita a la estación radial Ondas Azuayas, de la ciudad de Cuenca, por infringir el artículo 10, numeral 4, literal f, de la Ley Orgánica de Comunicación (LOC), que se refiere a la obligación de distinguir de «forma inequívoca» entre noticias y opiniones; en este caso, del programa “El noticiero”, transmitido el 2 de febrero de 2015. La entidad de control también previno al medio de comunicación a mejorar las prácticas internas.
Durante la audiencia de sustanciación desarrollada el 26 de febrero de 2015, Diego Delgado Jara, como representante del medio de comunicación afirmó que en el programa ´El noticiero’, “se hizo un comentario que no tiene nada subjetivo o juicios de valor sobre el tema del “Super Bowl”. Afirmó también “que el comentario se hizo con objetividad para sustentar lo que se dice en la noticia” y aseguró que “no es la falta de distinción entre noticia y opinión, sino el contenido de lo que se dijo en la noticia, que no debió gustarle a alguien”.
Por otro lado intervino en la audiencia Oswaldo Coraisaca, Director de Prevención Jurídica de la Intendencia Zonal 6 de la Información y Comunicación, quien ratificó el contenido del reporte interno, que establece que todo medio de comunicación está obligado al cumplimiento de la Ley Orgánica de Comunicación. Coraisaca afirmó “que la ley tiene como fin el precautelar a que la audiencia ejerza su derecho a recibir información de contenidos noticiosos que se alejen de una apreciación personal valorativa y se enmarque dentro de un contexto de objetividad y de imparcialidad sobre los hechos que se transmitan y con ello puede el ciudadano diferenciar de manera inequívoca que refiere a información y el que se aleja del mismo”. Concluyó el representante de la institución reguladora .
En diálogo con Fundamedios, Gustavo Cordero representante legal del medio y conductor del programa sancionado ¨El noticiero¨, asegura que el proceso se inició por que supuestamente se había transmitido información sin citar la fuente. Sin embargo, Cordero afirmó que la información que salió al aire fue producto de una investigación propia de la estación radial, lo que se logró probar y demostrar en la audiencia de sustanciación. Cabe recalcar que esta es la segunda amonestación escrita que recibe la estación radial por el supuesto incumplimiento del artículo 10, numeral 4, literal f.
Radio station is cautioned for failing to distinguish between news and opinion
On 11 March 2015, the 6th Zonal Administration for Information and Communication sent a written caution to radio station Ondas Azuayas, in the city of Cuenca, as part of proceedings initiated ex officio, for infringing Article 10, paragraph 4, letter f, of the Organic Communication Law (LOC), concerning the obligation to distinguish «unequivocally» between news and opinion; in this case, in the program «El Noticiero», broadcasted on 2 February 2015. The control entity also warned the media outlet of the need to improve its internal practices.
During the substantiation hearing held on 26 February 2015, Diego Delgado Jara, representing the media outlet, stated that during the program ‘El Noticiero’ a comment was made about the «Super Bowl» that was not in the least subjective or a value judgment. He also stated «that the comment was made objectively to support what was said in the news» and asserted that «it was not the failure to distinguish between news and opinion that was not to somebody’s liking, but the content of what was said in the news».
Oswaldo Coraisaca, Director of Legal Prevention of the 6th Zonal Administration for Information and Communication, also participated in the hearing and he ratified the content of the internal report, which states that every media outlet is obliged to comply with the Organic Communications Law. Coraisaca stated «that the law is aimed at ensuring that the audience can exercise its right to receive information from news content that does not include personal assessments and is framed within a context of objectivity and impartiality about the facts being transmitted, so that citizens can differentiate unequivocally between information and that which distances itself from it».
Speaking to Fundamedios, Gustavo Cordero, legal representative of the media outlet and host of the sanctioned news program, stated that the proceedings had been initiated because they had allegedly broadcasted information without citing the source. Cordero expressed, however, that the information was the result of an investigation carried out by the radio station itself, which was proved and demonstrated at the substantiation. This is the second written caution received by the radio station for an alleged breach of Article 10, paragraph 4, letter f.
