El 28 de agosto de 2011, Emilio Palacio, ex editorialista de diario El Universo anunció, mediante un correo electrónico, que «se vio obligado» a salir del país por la persecución política de la que afirma ser objeto.
En la misiva, el ex articulista afirmó que decidió viajar a Estados Unidos porque su seguridad corría peligro debido a los «descarados abusos» que denuncia se están ejecutando en su contra: «Me quisieron imponer como juez al amigo más íntimo del abogado del dictador. Me iniciaron un nuevo juicio penal por calificar de fascistas a los insultadores a sueldo de Rafael Correa. Un ministro cuyo nombre no recuerdo, amenazó con demandarme por «perjurio». La prensa gobiernista de derecha e izquierda redobló sus insultos», reza parte de la carta.
De acuerdo a la carta de Palacio, este se encuentra en Estados Unidos desde el miércoles 24 de agosto. Sin embargo, Fundamedios no pudo corroborar el estatus migratorio del articulista.
Jorge Alvear, abogado de Palacio dijo a Fundamedios que presume que Palacio viajó con su visa de turista a la ciudad de Miami y desde la Embajada de Estados Unidos en Quito, no pudieron confirmar si existe o no un pedido de exilio de parte de Palacio .
Alvear cuestionó la forma como se ha llevado el proceso y citó como ejemplo la veloz sentencia dictada por un juez temporal y el intento de poner a un con juez con presuntos vínculos de amistad con la defensa del Presidente. Con ello, el abogado justificó la decisión de su defendido por cuanto cree que «no es heroico mantenerse en el país» ya que se expone a que sus derechos sean vejados.
Emilio Palacio es el principal acusado por injurias, en el juicio que el Presidente Rafael Correa ha entablado y que incluye a Diario El Universo y sus tres principales accionistas, por el cual se sentenció en primera instancia a tres años de prisión para los acusados, así como el pago indemnizatorio de $40 millones. La causa está en segunda instancia.
Former feature writer taken to trial by the president leaves the country believing himself to be a target of political persecution
On 28 August 2011, Emilio Palacio, former editorial writer of the newspaper El Universo, announced through an e-mail that he «was forced» to leave the country due to the political persecution he claims to be the victim of.
In the letter, the former feature writer asserts that he decided to leave for the United States because his safety was in danger due to the «shameless abuse» he has denounced being the target of.»They want to impose as a judge the dictator’s lawyer’s closest friend.They have initiated a new criminal trial because I called Rafael Correa’s paid offenders fascists. A minister whose name I don’t remember threatened to sue me for «perjury».The right and left wing pro-government press hasintensified its insults», says part of the letter.
According to Palacio’s e-mail, he arrived in the United States on Wednesday, 24 August. Fundamedios, however, was unable to corroborate the writer’s migratory status.
Jorge Alvear, Palacio’s attorney, told Fundamedios that he supposes the journalist flew to Miami with his tourist’s visa. The Embassy of the United States in Quito was unable to confirm if Palacio has made a request for exile.
Alvear questioned the way in which the process has taken place and quoted as an example the quick sentence issued by a temporary judge and the attempt to name another judge who is allegedly linked by friendship to the president’s lawyer. The attorney justified his client’s decision stating he believes «it’s not heroic to stay in the country» because his rights may be trampled on.
Emilio Palacio is the main accused for slander in a suit filed by President Rafael Correa, which includes the newspaper El Universo and its three main shareholders, in which they were all sentenced in the first instance to three years in prison and the payment of $40 million in damages. The case is now being seen in second instance court.
