El 20 de septiembre de 2013, el Juzgado Segundo de Garantías Penales de Esmeraldas aceptó a trámite la demanda por injurias calumniosas que interpuso la abogada y exjueza Ivonne Boada Ortiz, en contra del diario La Verdad y cuatro de sus directivos, en Esmeraldas, ciudad ubicada en la frontera norte del Ecuador. En la demanda, la exjueza exige una indemnización por daños y perjuicios de $30 millones.
La demanda fue planteada en contra de Editorial Alternativa y Comunitaria Diario La Verdad, así como en contra de Mario Gutiérrez, presidente y representante legal del medio; Nathaly Ibarra, gerente; Saúl Ibarra, editor y Rodrigo Jácome, director.
De acuerdo con el escrito presentado por Boada, la demanda inició a raíz de la publicación de una nota titulada “Prófugos de La Roca se escondían en Colombia”, del 20 de abril de 2013, referente a la recaptura en Colombia de César Vernaza Quiñónez ‘El Empresario’, uno de los más buscados que se habría fugado de la cárcel de máxima seguridad La Roca y en cuyo caso Boada, a inicios de este año, ejerció como jueza temporal de la Corte Provincial de Justicia de Esmeraldas y formó parte del Tribunal encargado de revisar la sentencia de Vernaza.
En la demanda, Boada asegura que: “…de manera dolosa, temeraria, maliciosa en el Diario la Verdad (…) el señor Saulo Ibarra Leones el día sábado 20 de abril de 2013 y con la coadyuva del Dr. Mario Gutiérrez Moya, Nathaly Ibarra Bustos y Saúl Ibarra Leones y Lcdo. Rodrigo Jácome, instrumentalizando a la Asociación de Comunicadores Asociados de Editorial Alternativa y Comunitaria Diario La Verdad, publicaron un artículo (…) En el que otras cosas se dice “Serrano también denunció a la Jueza Ivonne Boada, miembro de esta sala penal y quien tuvo el papel de intermediaria entre Vernaza y Valdez para intentar sobornar al Juez. Explicó a la prensa que se mantienen contactos con el Consejo de la Judicatura para que se suspenda a esta presunta jueza corrupta y solicitó que también se la destituya” .
La demanda se refiere a unas presuntas declaraciones que el ministro del Interior, José Serrano, habría dado a la prensa sobre la detención del prófugo y otras anomalías.
La exjueza también alega que la publicación “vulnera sus derechos y garantías, haciendo imputaciones falsas de delitos, que lesionan el buen nombre, dignidad, honra, decoro e imagen, no solo de persona sino pública”, por lo que acusa como autores del delito de injuria calumniosa a los cuatro directivos del medio y exige una indemnización de $20 millones y $10 millones al rotativo.
Former judge sues newspaper and directors of newspaper. Demands us$30 million as reparation
On September 20, 2013,the Second Court of Criminal Guarantees of Esmeraldas accepted the action for slander that the former judge IvonneBoada Ortiz presented againstDiario la Verdad and its four members of its board of directors. Boada also requested an economic reparation of US $ 30 millions.
The criminal action was presented against Editorial Alternativa y ComunitariaDiario La Verdad, and against Mario Gutiérrez, president and legal representative of the newspaper; Nathaly Ibarra, manager; Saúl Ibarra, editor and Rodrigo Jácome, director.
The action is based of the publication of the article “Interns that escaped from La Roca were hidden in Colombia”, published on April 20, 2013. The note narrated the capture of one of the most wanted men that escaped from “La Roca”. His case was decided by Judge Boada which was part of the tribunal.
Boada claims, in the action that “ in a slanderous fashion, in Diario La Verdad (…) Mr. Saulo Ibarra Leones, alongside with Dr. Mario Gutiérrez Moya, Nathaly Ibarra Bustos, Saúl Ibarra Leones and Rodrigo Jácome, and the Association of Communicators of the Alternative and Comunitarian Editorial Diario La Verdad, published an article (…) in which, among other things, the journalist affirms that “Serrano presented a claim against Judge IvonneBoada, who acted as a connection between Vernaza and Valdez in their attempt to bribe the judge. He explained that he currently presented a claim to the Council of the Judiciary to sanction and dismiss Judge Boada”.
Boada refers to some alleged declarations of the Ministry of the Interior, José Serrano on the escaped intern and other issues.
Boada alleged that the publication affects her rights due to the false accusations that she committed a crime, which affects also her rights to honor and dignity, and demands an economic reparation of US $20 millions and US$10 millions that the paper must pay.
