El 08 de junio de 2011, el ex diputado y ex director de los noticieros de la estación televisiva TC Televisión (ahora incautada por el Gobierno) Rafael Cuesta Caputi pidió a la Fiscalía Provincial del Guayas que inicie una investigación a diario El Universo por «injuria calumniosa» al sentirse aludido en el editorial «¡No callaremos señor presidente!», publicado en respuesta a una noticia difundida por el medio estatal El Telégrafo en la que se vinculó al fundador y a los propietarios de El Universo con un negocio que supuestamente habría perjudicado al Estado en $100 millones de dólares.
En entrevista dada a TC Televisión, Cuesta mostró la providencia dictada por la Fiscalía, en donde se pide al director de El Universo que, en el término de 72 horas, remita a la fiscalía los nombres y apellidos de los autores del artículo mencionado. Cuesta afirmó que, a pesar de que en el artículo no se lo nombra directamente, lo aluden. «El hecho de que no me nombren no quiere decir que no se refieren a mí y que no me hayan causado daño», dijo Cuesta.
El artículo al que se refiere Cuesta fue publicado por El Universo el pasado 02 de junio bajo la firma de sus directivos Carlos, César y Nicolás Pérez, y en él dice lo siguiente: «El enorme pulpo de medios de comunicación del Gobierno, diarios, canales de televisión y radios, se ha empeñado en estos días en difundir un pasquín que se publicó hace veinte años, sin firma de responsabilidad, y que luego sirvió para apoyar las falsedades de un diputado socialcristiano que también buscaba difamar. Nuestro padre contestó en aquella ocasión todas las mentiras.», reza el escrito.
Para Cuesta, el «diputado socialcristiano» al cual se refieren es él y por eso inició acciones legales.
El Universo afronta diversos juicios y acusaciones por parte de funcionarios públicos . La más reciente fue una demanda interpuesta el pasado 22 de marzo de 2011 por el presidente Rafael Correa, quien pidió una indemnización de $80 millones y prisión de tres años para los directivos de ese medio y el articulista Emilio Palacio por injurias calumniosas. Palacio además, fue acusado por Camilo Samán, presidente del directorio de la Corporación Financiera Nacional, quien finalmente decidió retirar la demanda.
Diario El Universo constantemente es foco de descalificaciones por parte del Primer Mandatario, quien en los enlaces sabatinos ha afirmado que el rotativo es parte de la «prensa corrupta», «amarillista e irresponsable que manipula y conspira».
Prosecutor investigates newspaper for alleged malicious slander
On 8 June 2011, former representative and former director of TV station TC Televisión’s news programs (now seized by the government), Rafael Cuesta Caputi, requested the Provincial Prosecutor’s Office of Guayas to initiate an investigation against the newspaper El Universo for «malicious slander» because he felt he was being referred to in the editorial «¡We will not stay silent, Mr President!», published in response to a news piece circulated by the state owned media outlet El Telégrafo in which El Universo’s founder and owners were linked to a business that was allegedly detrimental to the State in the amount of $100 million dollars.
In an interview with TC Televisión, Cuesta showed the ruling issued by the Prosecutor’s Office in which El Universo’s director is requested to, within72 hours, deliver to this office the names and surnames of the authors of the article in question. Cuesta stated that, despite he is not mentioned directly in the article, they refer to him. «The fact that they don’t name me doesn’t mean that they don’t refer to me and that they haven’t caused me harm», said Cuesta.
The article in question was published by El Universo on 2 June, signed by its directors Carlos, César and Nicolás Pérez, and states the following: «The government’s huge media conglomerate, newspapers, and TV and radio stations, is bent these days on disseminating a rag published twenty years ago, without a signature, which was then used to support the falsehoods of a Social-Christian representative who was also aiming to defame (us). Our father replied on that occasion to all the lies», states the piece.
According to Cuesta, the «Social-Christian representative» referred to in the article is him and that is why he has initiated legal actions.
El Universo is facing several lawsuits and accusations by public officials. The most recent one was a demand filed on 22 March 2011 By President Rafael Correa, who requested damages for $80 million and a three year prison sentence for the newspaper’s directors and editorialist Emilio Palaciofor malicious slander. Palacio was also accused by Camilo Samán, chairman of the board of the National Financial Corporation, who finally decided to withdraw the charges.
The newspaper El Universo is constantly the focus of discredit by the Chief of State, who in his Saturday programs has stated that the paper is part of a «corrupt press», «sensationalist and irresponsible that manipulates and conspires».
