El 19 de octubre de 2015, el tuitero y subdirector nacional del movimiento Unidad Popular, Sebastián Cevallos fue llamado a juicio penal después de que denunciara a través de la red social de presunto caso de nepotismo de familiares del ministro de Trabajo, Carlos Marx Carrasco.
En la cuenta de Twitter de Cevallos quien se autodefine como «un militante de la izquierda revolucionaria», denunció que “Pretende @CarlosMarxC atemorizar, amordazar, callar, a quienes decimos la verdad. No nos amedrentan. Seguiremos.!!”, en alusión al Ministro. Sin embargo, la demanda, por presunta contravención de cuarta clase tipificada en el artículo 396 del Código Orgánico Integral Penal, fue impuesta por su sobrina, Paula Francisca Rodas Espinoza, quien ha admitido ser funcionaria del Instituto Nacional de Patrimonio Cultural desde julio de 2008.
En el escrito, Rodas Espinosa aseguró que los días 21, 22 y 23 de julio de este año, Cevallos, identificado en la red social como @sebastcevallos, “ha proferido expresiones en franco descrédito y deshonra” en su contra, por tres mensajes de Twiiter que según la funcionaria se han manifestado “de forma absolutamente falaz, dolosa y con el profundo ánimo de irrogar daño”.
Los ‘tuits’ que se refiere la funcionaria son tres; en el primero, Cevallos convoca a una rueda de prensa para denunciar, según él, “actos de corrupción de un alto funcionario de Alianza País”; en el segundo, Cevallos pregunta a sus seguidores si saben quién es el presidente de la comisión de ética del partido de gobierno, con mención al Ministro y en el tercero, alude directamente a la demandante con el siguiente mensaje: “Paula Rodas sobrina @CarlosMarxC está en INPC- regional6 Efectivamente es el Ministro de Trabajo de su familia”.
Para Cevallos, este proceso legal no tiene asidero ya que dice contar con todas las pruebas de sus denuncias, por lo que cree, que pretenden llevarlo a la cárcel por tener una opinión política, por hacer uso del derecho a la libertad de expresión y por combatir lo que él llamó la nueva casta política que está en el poder. Sin embargo, para la funcionaria, el cargo que ocupa lo ha obtenido gracias a sus méritos y de su arduo esfuerzo, como consta en el escrito de la demanda .
En julio de este año, el ministro Carrasco se pronunció en Twitter respecto a las denuncias de Cevallos y en uno de ellos del 26 de ese mes, aseguró lo siguiente: “Conozco que varias de las personas señaladas, injuriadas por el sujeto del extinto MPD, seguirán acciones legales, porque…se sienten indignadas por estos atropellos contra su dignidad. Quieren dejar precedentes de justicia y respeto.Que Dios y la justicia obren!”. En otro mensaje escribió: “Algunos parece, les duele ver como mi conciencia está tranquila, mis bolsillos limpios, con honestidad mostrada y que PUEDO DORMIR EN PAZ!”.
La primera audiencia de este juicio ha sido convocada para este 11 de noviembre.
Official files criminal lawsuit against twitter user because of accusations of nepotism
On 19 October 2015, Twitter user and national deputy director of the movement Unidad Popular, Sebastián Cevallos, was called to a criminal trial after he used the social network to denounce an alleged case of nepotism involving relatives of Labor Minister Carlos Marx Carrasco.
Cevallos, who calls himself «a militant of the revolutionary left», stated through his Twitter account that «@CarlosMarxC aims to intimidate, muzzle, silence, those of us who tell the truth. We are not intimidated. We shall continue!!»
However, the lawsuit for an alleged fourth-class violation typified in Article 396 of the Criminal Code, was filed by Carrasco’s niece, Paula Francisca Rodas Espinoza, who has admitted to being an official of the National Institute of Cultural Heritage since July 2008.
In the writ, Rodas Espinosa claimed that on 21, 22 and 23 July this year, Cevallos, identified in the social network as @sebastcevallos, «uttered expressions that discredit and dishonor» her. She referred to three Twitter messages that, according to the official, are «absolutely false, malicious and have the deep aim of causing harm».
The ‘tweets’ in question are three: in the first, Cevallos calls a press conference to denounce, according to him «acts of corruption by a high ranking official of Alianza País»; in the second, Cevallos asks his followers if they know who is the chairman of the ethics committee of the ruling party, with reference to the minister; and in the third, he refers directly to the plaintiff with the following message: «Paula Rodas niece @CarlosMarxC is in the INPC- regional6 Is in fact a relative of the Labor Minister».
To Cevallos, the legal process is baseless because he has evidence of his claims. He believes they want to see him in prison because he has a political opinion, because he makes use of the right to freedom of expression and fights against what he calls the new political caste that is in power.
The official, however, claims she has obtained her position due to her own merits and her effort, as stated in the lawsuit.
In July this year, Minister Carrasco issued statements through Twitter regarding Cevallos’ allegations and in one of them, written on 26 July, said the following: «I know that several of the persons mentioned, reviled by the subject of the late MPD will file legal actions, because … they feel indignant at these outrages against their dignity. They want to set precedents of justice and respect. May God and justice prevail!» In another message he wrote: «It seems that some are annoyed because my conscience is clear, my pockets are clean, I have proved my honesty and I CAN SLEEP PEACEFULLY!»
The first hearing of this trial has been called for 11 November.
