El 06 de noviembre de 2012, el Juzgado Vigésimo Primero de lo Civil de Pichincha admitió a trámite la Acción de Protección planteada por el subsecretario nacional de la Administración Pública, Óscar Pico Solórzano, en contra de diario La Hora de Quito, por supuesta violación a sus derechos constitucionales, al sentirse inconforme con una rectificación que solicitó al medio sobre una noticia referente al gasto oficial en publicidad.
Mediante oficio Nº 457-2012-JVPCP-GE dirigido al presidente ejecutivo de diario La Hora, Francisco Vivanco, el juez Marco Albán Núñez notifica que la demanda presentada por la Secretaría Nacional de la Administración reúne los requisitos por ley para admitir el trámite y fija audiencia pública para el 8 de noviembre.
El escrito presentado por Pico, en calidad de Subsecretario Nacional de la Administración Pública, afirma que el medio publicó «datos periodísticos inexactos», que «faltan a la verdad o provienen de fuentes cuya inexactitud ha sido públicamente demostrada». Referentes a la nota publicada el pasado 10 de octubre de 2012 por diario La Hora, bajo el título «71 millones en propaganda».
Según este funcionario, la rectificación que solicitó al medio, el pasado 11 de octubre, se difundió «sin ocupar el mismo espacio» que la información original, lo que, a criterio de Pico, «se denota que de manera por demás displicente, se hace referencia tan solo una cifra de la totalidad de la información».
«Dicha forma de actuar de diario La Hora ha causado un grave perjuicio a la Administración Pública, a la Función Ejecutiva y al Gobierno Nacional, colocando en estado de indefensión a los mismos frente al poder de ese medio de comunicación, violentando gravemente nuestro derecho constitucional establecido en el numeral 7 del artículo 66 de la Constitución de la República» .
En el escrito, el funcionario pide al juez que se prohíba al medio pronunciarse en sus páginas sobre el proceso, ya que es parte interesada en él, por lo que no podría producir y difundir información contextualizada y plural, según el artículo 18, numeral 1, de la Constitución. Así mismo, la acción de protección solicitada por la Secretaría de la Administración pide que se ordene a la editorial Minotauro S.A. que edita el diario, a proceder a la rectificación de la información en espacios similares y que se pida disculpas públicas al Gobierno Nacional y a la ciudadanía por violar «preceptos constitucionales, disculpas públicas que deberán publicarse en la primera página del diario La Hora».
Official requests rectification from media outlet through injunction and forbids it from publishing information about the process
On 6 November 2012, the Twenty-first Civil Court of Pichincha admitted the injunction presented by the national sub-secretary of Public Administration, Óscar Pico Solórzano, against the Quito newspaper La Hora, because of an alleged violation of its constitutional rights after feeling that the rectification it requested from the outlet about an article concerning official advertising expenses was not of its liking.
Through document No 457-2012-VPCP-GE addressed to the newspaper’s executive president, Francisco Vivanco, Judge Marco AlbánNúñez notified that the injunction presented by the National Secretariat of Administration meets the conditions established by law to be admitted and set a public hearing for 8 November.
The document presented by Pico, acting as National Sub-secretary of Public Administration, states that the paper published “inexact journalistic information” that “did not correspond to the truth or originated from sources whose inexactitude has been publicly proven”,in regard to the piece published on 10 October 2012 by La Hora titled “71 million in propaganda”.
According to this official, the rectification it requested from the newspaper on 11 October was published “without occupying the same space” as the original information, which from Pico’s point of view “denotes disdain in the way it mentions only one figure of the total information».
“The manner in which the paper has proceeded has caused serious damage to the Public Administration, the Executive and the National Government, rendering them helpless before the power of this media outlet, infringing our constitutional right as established in item 7 of article 66 of the Constitution of the Republic».
The official also requested the judge to forbid the newspaper from reporting about the process in its pages, insofar as it is one of the interested parties, and therefore would not be able to produce and disseminate contextualized and plural information, as established by article 18, item 1 of the Constitution. The injunction presented by the Secretariat of the Administration also requests that the newspapers’ editing house, Minotauro S.A., should proceed to rectify the information in similar spaces and present public apologies to the National Government and the public for violating “constitutional prescripts, public apologies that should be published in the front page of the newspaper La Hora”.
