El 25 de enero de 2015, horas después de que el Presidente Rafael Correa declarara que “oficialmente el día de hoy queda organizada la batalla por la dignidad y por la verdad en las redes sociales”, a través de la plataforma online somosmas.ec, los tuiteros y críticos con el Gobierno en redes sociales identificados con nombres, apellidos y fotografías, recibieron múltiples insultos y amenazas.
El administrador de la página de Facebook Crudo Ecuador recibió amenazas que atentan a su integridad física. A través de la red social Twitter, simpatizantes del gobierno le advirtieron que “le darán su merecido” horas después de que el presidente Correa amenazara con revelar la identidad del administrador de dicha página y declarara la batalla en contra de sus críticos en las redes sociales, en su Enlace Ciudadano No 408.
El usuario identificado como @Fidelernesto24, en cuyo perfil exhibe una foto de Fidel Castro y de Ernesto “Che” Guevara escribió: “Se que pronto te vamos a encontrar y te daremos tu merecido, empezaremos por tu familia para que palpes el sufrimiento”, mientras que el usuario @pedropablozmbr escribió: “Todo cobarde muere como sapo… te tenemos un espacio listo para que lo ocupes en Eplicachima C-E”.
Tras esto, el Ministro del Interior José Serrano aseguró en un mensaje en Twitter que pondrá la denuncia para que se investigue esa amenaza y agregó: “qué importante sería que ningún canalla se esconda detrás de troll”.
El Presidente Correa prometió revelar la identidad e imagen de Crudo Ecuador y advirtió: «Vamos a encontrar a esta persona para ver si es tan jocoso cuando todo el mundo sepa quien es (…) para ver si sigue siendo tan valiente este tipo (…) es un simple cobarde que se esconde en el anonimato para insultar y desfogar sus odios» (…) «es un cobarde y pronto sabremos quien es y lo conocerá el país» sentenció.
Para el Presidente lo que hace Crudo Ecuador “tal vez no rompe la Ley, pero «somos 10 000, así que le vamos a responder» (…) por cada tuiter que mandé mandaremos 10 000, diciéndole eres un cobarde».
Otras amenazas e insultos varios se pudieron leer en contra de tuiteros señalados por el Presidente: Johan Caicedo, Shamira Santamaría recibieron mensajes como: “Antes de demostrar tu idiotez, piénsatelo aunque te cueste”; “Tienes en la cabeza lo que el WC en este momento, solo mierda”; “Sigue insultando pero desde la penitenciaría y hazle un puesto a Crudo Ecuador que es el próximo”; “Vos con esa cara, ojalá te la arreglaran de un tiro. Burra estúpida!!!!!!!!!!”; “Estás CRUDO papagayo para insultar a CORREA, pronto te veremos en la ROCA”; “Basura”; “Tarada”; “Canalla”; “Drogadicta”…
Otro tuitero, Danny Villacrez, quien aparece en una fotografía con un niño de no más de 5 años, fue insultado de esta forma: “Hasta la máscara de lacra asquerosa tienes”; “Ya deja de rebuznar contra nuestro Presidente y mejor pide disculpas y retírate, pobre tipejo”; “Y vos, junto con tu hijo, ¿eres capaz de ese nivel de estupidez?
Estas amenazas son expuestas a través del portal www.somosmas.ec, presentado por el Presidente durante su enlace N.408 ( que se retransmite por más de 300 emisoras de radio y canales de TV) para “contrarrestar” los mensajes críticos a su gestión. En este portal, los simpatizantes del Gobierno se registran para denunciar y revelar la identidad de los tuiteros con el fin de «ganar la batalla en las redes sociales». El Jefe de Estado llegó al extremo de comparar la situación con la masacre a los dibujantes, periodistas y editores de la revista humorística francesa Charlie Hebdo: “Esto no es libertad de expresión. Esto es insulto, agresión, cobardía (…) Si en Francia hubieran tenido las leyes que nosotros tenemos tal vez no se daban esas explosiones de violencia sino que se recurría a la justicia”.
En ese contexto, el Presidente volvió a descalificar al caricaturista Xavier Bonilla “Bonil”, quien debe enfrentar una nueva audiencia de juzgamiento bajo la Ley de Comunicación, el próximo 09 de febrero. El Presidente lo descalificó asegurando que “recoge cualquier basura” y que ha perdido toda ética y afirmó que también se miente con “dibujitos” y que eso es una calumnia que tampoco va a permitir en su gobierno” .
Fundamedios condena que se haya instaurado una política de Gobierno enfocado en la persecución a los usuarios de redes sociales críticos al Gobierno por el solo hecho de expresar su opinión, de forma humorística o chocante. Recordamos que las autoridades de Gobierno, encabezadas por el Presidente de la República, tienen la obligación de garantizar derechos y libertades constitucionales como el de la protección de datos personales. Al respecto, la delación propiciada por autoridades del Estado bien puede configurar una grave violación legal.
Finalmente, señalamos que en el desarrollo de los Derechos Humanos en el Internet (Derechos Digitales), uno de los principios esenciales para ejercer plenamente la libertad de expresión es la protección del Derecho al anonimato.
Fundamedios condemns persecution to social network users who are critic towards the president and the Ecuadorian government
On January 25th 2015, hours after President Correa’s statement “officially declaring that today the battle for dignity and truth in social networks is settled”, through the online platform somosmas.ec, Twitter users and government critics were identified with names, last names and photographs, receiving multiple insults and threats.
The administrator of Facebook page, Crudo Ecuador, received threats to his physical integrity. Through Twitter, government supporters warned that “they will give him what he deserves”, few hours after President Correa threatened with revealing his identity and declared the battle against his critics in social networks, during his weekly broadcast No. 408.
Twitter user identified as @Fidelernesto24, who exhibits in his profile a picture of Fidel Castro and Ernesto “Che” Guevara wrote: “I know that son we will find you and we will give you what you deserve, we will begin with your family so you can suffer”, while user @pedropablozmbr wrote: “Every coward dies as a frog… we have a spot ready for you in Eplicachima C-E (referring to a Police complex)”.
After these events, Interior Minister, José Serrano, assured through a Twitter message that he will file an investigation request for these threats, and added: “how important it will be if no villain hid behind a troll”.
President Correa promised to reveal Crudo Ecuador’s image and identity, and warned: «We will find this person to see if he is still so funny when everybody knows who he is (…) we will see if this guy still is so brave (…) he is a sole coward who hides in anonymity to insult and unleash his hatred » (…) «he is a coward and soon we will know who he is and the country will know this as well, he concluded.
For the President, what Crudo Ecuador does “might not break the Law, but we are 10.000, so we will respond» (…) for each twit he sends, we will send 10.000, saying you are a coward».
Other threats and various insults could be read against Twitter users pointed out by the President: Johan Caicedo, Shamira Santamaría they both received messages such as: “Before showing your stupidity, think even if it costs you”; “You have in your head what there is in the WC in this moment, only shit”; “Keep insulting but from the penitentiary and make some room for Crudo Ecuador that he is next”; “You with that face, I hope they could fix it with a bullet. Stupid donkey!!!!!!!!!!”; “You are a RAW (CRUDO in Spanish) parrot to insult CORREA, son we will see you in the ROCA (referring to a prison in Guayaquil)”; “Trash”; “Ass”; “Villain”; “Drug addict”…
Another Twitter user, Danny Villacrez, who appears in a picture with a child no older than 5 years old, was insulted: “Even the mask of a disgusting scourge you have”; “Stop braying as a donkey against our President, it will be best if you apologized and left, poor guy”; “And you, with your son, are you capable of this stupidity level?”.
These threats are presented in the web page www.somosmas.ec, presented by the President in his weekly broadcast No.408 (which broadcasts to more than 300 radio and TV stations) to “counterbalance” critical messages against his government. In this web page, government’s followers register themselves in order to file claims and reveal Twitter users identities for “winning the social networks battle”. The Chief of State even compared the situation with the massacre of cartoonists from the French magazine Charlie Hebdo: “This is not freedom of speech. This is insult, aggression, cowardice (…) If in France they had the laws we have, maybe those violence rants wouldn’t happened, probably they would have gone to justice”.
With this in mind, the President once again diminished cartoonist Xavier Bonilla “Bonil”, who has to face a new hearing under the Communication Law, on February 9th. The President diminished him assuring that he “picks up any trash” and that he has lost all ethics and asserted that he also lies through “little drawings” and he commits slander which his government will not allow.
Fundamedios condemns that there is a governmental policy focused in persecution towards social networks users who are against the government only by expressing their opinion, in a satirical or humorous manner. We remind that government officials, leaded by the President, are obliged to guarantee constitutional rights and freedoms as the protection of personal data. Regarding this, the government officials’ attitude might be considered a serious legal violation.
At last we point out that throughout the Human Rights in the Internet (Digital Rights), one of the main principles to exercise freedom of expression is the protection of anonymity right.
