El martes 14 de febrero de 2012, la jueza Mónica Encalada y quien llevó el caso de diario El Universo, antes de que este medio, sus directivos y su ex articulista sean sentenciados en primera instancia por el delito de injurias contra el presidente Rafael Correa, dejó una declaración por escrito drigida a la Fiscalía del Guayas, en la cual testimonia que fue uno de los abogados del Primer Mandatario quien redactó la sentencia.
Estas declaraciones las hizo dentro del proceso de indagación previa que se sigue en contra del juez Juan Paredes por prevaricato y falsedad ideológica.
La defensa de diario El Universo denunció a Paredes tras presentar pruebas de que este no habría sido el autor de la sentencia que condenó, en primera instancia al ex articulista y los tres directivos de diario a tres años de prisión y al pago de $40 millones.
Encalada narró ante la Fiscalía del Guayas lo siguiente: «Recibí una llamada a mi teléfono reconociendo que se trataba de uno de los abogados del acusador, quien me manifestó que históricamente a usted le va a corresponder hacer la audiencia el día de mañana… el ‘número uno’ está contento pues él dice que se lleva bien con las damas que tienen más pantalones que los hombres, entonces le corresponde a usted hacer la sentencia, haga nomás la audiencia, nuestro respaldo y el respaldo del «número uno», lo que yo dije eso sería irregular pues ya hay una resolución del juez de la recusación y que iba a esperar a que me notifique el juez séptimo y que se siente la razón.
Encalada también aseguró que el juez Paredes había hablado con ella para darle el mensaje de que Gutemberg Vera «no cobrará nada por este juicio (caso Universo), a él le van a dar el cobro de las deudas de los bancos cerrados y que eso era una millonada…a quien haga la sentencia, lo hará participar en ese negocio; también se mandan a pagar en sentencia tres millones de dólares por honorarios profesionales para los abogados y él está dispuesto a entregar un 25% en esta instancia a quien haga la audiencia y la sentencia del caso, y solo tiene que hacer la audiencia y notificar la sentencia que será histórica, la sentencia está bien trabajada y fundamentada pues Gutemberg, no duerme haciéndola, lleva dos semanas trabajando», reza parte del escrito que fue divulgado porel Abogado Joffre Campaña, procurador judicial de diario El Universo, durante una rueda de prensa .
Campaña afirmó ante la prensa que, con estas declaraciones, se ratifica la denuncia de que el juez Paredes no redactó la sentencia y que se confirma que fue el mismo abogado Vera quien lo hizo, a partir de un usuario pirata de Windows, denominado «Chucky Seven».
Según informaron diversos medios de comunicación, después de esta declaración la Jueza Encalada abandonó el país, pues temía por su seguridad.
Judge denounced that president’s attorney wrote the sentence against El Universo and left the country in fear for her safety
On Tuesday 14 February 2012, Judge MónicaEncalada, who saw the case against El Universo before the newspaper, its directors and a former feature writer were convicted by a first instance court for the crimes of offences against President Rafael Correa, left a written statement addressed to the Guayas District Attorney’s Office, declaring that the sentence was written by one of the Chief of State’s attorneys.
Her declarations were made as part of the preliminary investigation process followed against Judge Juan Paredes for the crimes of prevarication and inserting false statements in a document.El Universo’s defense attorneys denounced Paredes after presenting evidence that he was not the author of the first instance sentence that convicted the paper’s three directors and a former feature writer to three years in prison and the payment of $40 million.
Encalada declared the following before the Guayas District Attorney’s Office:“I received a call to my phone and was able to recognize it was one of the accuser’s attorneys who told me I would be in charge the hearing the following day… ‘number one’ is happy, because he says he gets on well with women who can wear trousers better than men. Therefore, you will be in charge of writing the sentence. Just go on with the hearing, you have our backing and ‘number one’s backing. I said that would be irregular, because a resolution by the judge in charge of the indictment already existed, and I would wait to be notified by the seventh judge and for hings to proceed as established by law.
Encalada also assured that Judge Paredes spoke with her to let her know that Gutemberg Vera «will not charge anything for this trial (El Universo case), he will get the money charged for the debts held by the closed banks and that also amounts to millions…. Whoever writes the sentence will participate in this business. The sentence will also order that three million dollars must be paid in lawyers’ fees and he is willing to give 25% of this to whoever holds the hearing and issues the sentence, and this person only has to hold the hearing and notify the sentence, which will be historical. The sentence is well prepared and founded because Gutemberg is not sleeping in order to write it, he has been working for two weeks». This is part of the statement disclosed by attorney Joffre Campaña, El Universo’s legal procurator, during a press conference.
Campaña stated before the press that these declarations ratify the accusation that Judge Paredes did not write the sentence and confirm that attorney Vera did, using the pirate Windows username «Chucky Seven».
According to different media, after making this statement Judge Encalada left the country fearing for her safety.
