El 17 de junio de 2013, la jueza Verónica Medina aceptó la acción de protección que interpuso el defensor del Pueblo, Ramiro Rivadeneira, contra diario Hoy de Quito, por un titular que publicó el medio el pasado 31 de mayo de una nota de la agencia AFP que decía: «Correa califica de novelería al matrimonio homosexual». Dicho titular, a criterio de la Defensoría del Pueblo, “no fue previamente verificado” y “contiene una tergiversación” que afecta los derechos de la comunidad GLBTI.
Tras la audiencia, la Jueza estableció que se vulneró el derecho a recibir información veraz y verificada y ordenó al medio de comunicación pedir disculpas a los afectados, en especial, al colectivo GLBTI, así como rectificar en los términos que indique la Defensoría del Pueblo. Antes de esto, la defensa del medio se allanó a la acción de protección presentada por la Defensoría del Pueblo.
El 13 de junio de 2013, el Juzgado Vigésimo de Garantías Penales de Pichincha había admitido a trámite la acción de protección interpuesta por Rivadeneira. En dicha la acción se solicitó que “mediante sentencia debidamente motivada, declare la vulneración del derecho a recibir información veraz y verificada y el derecha rectificación y disponga que Diario HOY proceda a rectificar la información que fue publicada el 31 de mayo (…) en los términos que establece el artículo 66, número 7, de la Constitución de la República».
Anterior a esta acción, Rivadeneira envió una carta al medio en la cual se señaló que “estos hechos resultan preocupantes para la Defensoría del Pueblo por cuanto afectan a los derechos de la ciudadanía GLBTI, por la información inexacta del titular de la noticia, siendo responsabilidad del medio la inmediata, obligatoria y gratuita rectificación”.
Además, desde el 31 de mayo y durante casi dos semanas, la Secretaría de Comunicación de la Presidencia de Ecuador emprendió una intensa campaña en contra de ese diario a través de notas descalificadoras publicadas en los medios de gobierno, así como en cadenas nacionales de radio y TV, acusando al rotativo de que “tergiversó gravemente” el titular de una nota de la agencia AFP . Un oficio enviado el 31 de mayo por Fernando Alvarado, secretario nacional de comunicación, también afirmó que el titular referido “no corresponde a la verdad (…) y que no solo orienta equivocadamente a sus lectores, sino también modifica, sin observancia alguna de ética periodística, la nota original de la agencia AFP”.
Al respecto, el medio rechazó públicamente que se haya tergiversado el titular y manifestó que “Esa secretaría endosa a este diario una fuente que nunca se usó”, pues, según explicó diario Hoy, tanto en la carta de Alvarado, como en las cadenas de radio y TV ordenadas desde el 3 de junio, hasta tres días después, “se reproducen declaraciones dadas por el Primer Mandatario en una entrevista radial que no consta en el despacho original de la agencia AFP”
Judged orders that newspaper corrects a headline and forces it to offer public apologies.
On June 17, 2013, Judge Verónica Medina admitted the protection action (amparo) that National Ombidsman Ramiro Rivadeneira presented against Diario Hoy (from Quito). The action was based on an article´s headline that read “Correa says that gay marriage is just a fad”, which was taken from a note published by AFP news agency. According to the National Ombdusman, the headline “was not duly verified” and “twists the truth”, while “affecting the rights of the GLBTI community”.
The Judge determined that the right to receive verified and true information had been violated, and ordered the newspaper to apologize, in particular to the GLBTI community. Also, it ordered that Diario Hoy rectifies the information in the terms set by the National Ombudsman. The attorneys of Diario Hoy accepted the action presented by the Ombudsman.
On June 13, 2013, the 20th Criminal Court of Pichincha admitted the action, which requested, inter alia: “a motivated decision must declare that the right to receive true and verified information has been violated, as well as the right to rectification. Diario Hoy must rectify the information published on May 31, 2013, as article 66(7) of the Constitution mandates.
Prior to the presentation of the action, Rivadeneria sent a letter to Diario Hoy, indicating that “the situation worries us, since it violates the rights of the GLBTI community due to the imprecise nature of the information published. Therefore, Diario Hoy must rectify it immediately, and free of any cost.
From May 31 2013, the National Secretariat for Communication SECOM, started a mediatic campaign against Diario Hoy, from Quito. Though national broadcasts in radio and TV the government accused Diario Hoy that it had “twisted” a headline published by news agency AFP that on May 31 published: “Correa says that gay marriage is just a fad”. The National Secretary of Communication, Fernando Alvarado, addressed a note on May 31 indicating that the headline is not coherent with the truth, (…) and that it misleads readers while modifying the note by AFP in an unethical fashion”. The National Ombudsman joined SECOM´s request for rectification.
Diario Hoy, on its part, publicly rejected the idea that the headline was misleading and indicated that “SECOM indicates that we based our information on a source we actually never used”.In all national broadcasts and articles published in State-controlled newspapers, an radio interview that Correa gave is presented, while this was note even mentioned in the note by AFP agency.
