La madrugada del 29 de mayo de 2014 el medio digital LaRepública.ec salió del aire durante casi cuatro horas, tras haber sido dado de baja por el servidor que aloja el portal digital en Estados Unidos. El hecho responde a una denuncia de violación de los derechos de propiedad intelectual, presentada por la compañía Ares Rights, en representación del señor Santiago Mena Vallejo.
El portal digital informó que ese día permaneció fuera del aire entre las 04h00 y las 07h30. Asimismo, sobre el material denunciado, se aseguró que se trata de la fotografía de un cheque que fue exhibido en la Sala de Prensa de la Asamblea Nacional por el entonces asambleísta Galo Lara, quien hace dos años denunció ante los medios una supuesta transferencia indebida de fondos de la Secretaría Nacional de Inteligencia a cuentas particulares.
El medio digital había publicado el pasado 10 de mayo de 2012 una nota titulada “Lara denuncia desvío de fondos de la Secretaría de Inteligencia” con la fotografía del mencionado cheque, cuya propiedad intelectual según Ares Rights corresponde al oficial de la Policía Santiago Mena Vallejo. Sin embargo, Carlos Jijón, director del portal digital aseguró no entender en base a qué Ares Rights alega la propiedad intelectual de dicha fotografía, pues aclaró que esta fue tomada originalmente por diario El Universo en una rueda de prensa y posteriormente reproducida por LaRepública.ec. “Me parece un abuso de las normas de propiedad intelectual, pues la fotografía no viola los derechos de propiedad de nadie porque no fue tomada por este señor”, apuntó Jijón. El sitio fue restablecido después que el medio de comunicación accediera a censurar la fotografía impidiendo que pueda verse la firma que consta en el cheque objeto de la denuncia .
Esta no es la primera vez que la empresa española Ares Rights actúa en perjuicio de este portal, el pasado 13 de enero de 2014, el medio denunció el cierre de uno de sus dos canales de Youtube, tras una notificación de infracción de derechos de copyright planteada por esta empresa, en representación de la estación televisiva del Estado, Ecuador TV.
Cabe recordar que Ares Rights es la misma empresa que impulsó el retiro de Internet del documental “Rafael Correa: Retrato de un padre de la Patria”, dirigido por el periodista colombo-americano Santiago Villa, en diciembre del año pasado, así como material audiovisual del portal EcuadorLibreRed, el documental de Pocho Álvarez sobre la explotación minera denominado “Acoso a Íntag” y otros videos relacionados con el gobierno ecuatoriano.
Digital media stopped broadcasting after Ares Rights presented a complaint
The early morning of May 29, 2014 the digital media LaRepública.ec went off the air for nearly four hours after being disconnected by the main server that hosts the digital web sites in the United States. The fact responds a claim of violation of rights to intellectual property, presented by the company Ares Rights on behalf of Mr. Santiago Mena Vallejo.
The digital media reported that day were off the air between 04h00 and 07h30. Also on the reported news, they made sure that is about a photograph of a check that was exhibited at the National Assembly press room by the formerly Assemblyman Galo Lara, who two years ago complained publicly in front of the media for an apparent misappropriation of funds made by the National Intelligence Secretariat harming private accounts.
Digital media published an article on May 10, 2012 titled «Mr. Lara denounce the misappropriation of funds made by Intelligence Secretary» with the picture of the check previous mentioned, whose intellectual property corresponds to Police Officer Mr. Santiago Mena Vallejo as Ares Right alleged. However, Mr. Carlos Jijón web site’s Executive Director assured to don’t understand on what basis Ares Rights claims intellectual property of photography, is necessary to clarified that the picture was originally taken by the newspaper El Universo in a press conference and later published and reproduced by LaRepública.ec. «It seems to me is an abuse of intellectual property regulations, because the picture does not violate the rights of anyone’s property, because the picture was not taken by this gentleman,» Mr. Jijón said. The site was reestablished after the media agreed to censor the picture, preventing from seeing the signature on the check, subject of the complaint.
This is not the first time that the Spanish company Ares Rights works against this web site, on January 13, 2014, the digital media reported the closure of one of its two Youtube channels, after a complaint about copyright infringement raised by the Spanish company on behalf of the State television station, Ecuador TV.
It is important to recall that Ares Rights is the same company that sponsored the internet censorship of the documentary «Rafael Correa: Portrait of a father of the Nation» (“Rafael Correa: Retrato de un padre de la Patria”), directed by Colombian-American journalist Santiago Villa, in December last year; Also was removed an audiovisual material from EcuadorLibreRed web site, as well as a documentary from Pocho Alvarez called » harassment in Íntag» (Acoso a Íntag) and other videos related with the Ecuadorian government.
