A 10 millones de dólares de indemnización por daño moral asciende el monto que el presidente de la República Rafael Correa pretende cobrar a los periodistas de investigación y autores del libro «El Gran Hermano», Juan Carlos Calderón y Christian Zurita, tras una demanda interpuesta por el Primer Mandatario, por considerar que la publicación contiene «imágenes suyas y de su hermano sin autorización»; además, de «textos no autorizados que violentan el derecho de propiedad intelectual porque se refiere a otras personas, resulta ofensivo, denigrante y humillante…».
Parte del texto de la demanda sostiene que «el libro, además de contener hechos falsos, menoscaba, hiere, mancilla mi dignidad y mi buen nombre… pretendiendo hacerme ver como una persona corrupta y deshonesta, poniendo en duda hasta mi integridad profesional al insinuar y vincularme con situaciones irreales, inexistentes y falsas, de falsedad absoluta», reza el texto.
Durante una entrevista concedida al portal de noticias Ecuadorinmediato.com, el Presidente calificó a los periodistas de «malintencionados, seudoescritores» y aseguró que el libro es «falso e injurioso desde su portada hasta la página 460 y el índice» y que fue hecho de manera dolosa para exponer hechos falsos e irreales que evidencian «la existencia del ‘animus injurandi’ en toda la mencionada obra».
Según el Jefe de Estado, el libro relata «de forma maliciosa, delincuencial y temeraria», la supuesta pasión de la familia Correa Delgado por el poder, buscando especialmente desprestigiar su buen nombre y reputación.
El 21 de marzo, el Primer Mandatario aseveró, durante una entrevista radial, que sus autores deberán demostrar ante la justicia lo cierto de sus aseveraciones y ratificó, además, que enjuiciará a un articulista de diario El Universo (Emilio Palacio) y a los directivos de ese medio, del cual dijo son también responsables de lo que publica .
Fundamedios expresa su solidaridad y respaldo a Juan Carlos Calderón y Christian Zurita y rechaza la pretensión de demandar por 10 millones de dólares a dos periodistas de investigación, sin otros ingresos que sus salarios, Tal acción tiene un indudable efecto intimidatorio y funciona como una advertencia a cualquier periodista que pretenda investigar al poder; por lo cual consideranmos pone en serio riesgo los derechos y libertades de expresión y prensa.
Investigative journalists sued by the president of the republic for $10 million
The amount requested as reparations for moral damage by President Rafael Correa in his lawsuit against investigative journalists and authors of the book «el Gran Hermano», Juan Carlos Calderón and Christian Zurita, amounts to 10 million American dollars. The President has sued the journalists because he believes the book contains «unauthorized images of himself and his brother», as well as «unauthorized texts that infringe the right to intellectual property, because it makes reference to other persons and is offensive, degrading and demeaning…».
Part of the lawsuit’s text maintains that «the book, as well as containing false information, damages, wounds, sullies my dignity and my good name… attempting to make me appear as a corrupt and dishonest person, doubting even of my professional integrity by insinuating and linking me to unreal, nonexistent and false, absolutely false, situations».
During an interview granted to the news portal Ecuadorinmediato.com, the president called the journalists «malicious, pseudo writers» and asserted that the book is «false and libelous, from its front page to page 460, including the index» and that it was written in a fraudulent manner to reveal false and unreal events that show «the existence of ‘animus injuriandi’ (a desire to offend) in the whole book».
According to the chief of state, the book tells «in a malicious, criminal and reckless way», of the alleged passion of the Correa Delgado family for power, aiming especially to discredit his good name and reputation.
On 21 March, the president asserted during a radio interview that the book’s authors would have to present evidence of their assertions before the law. He also ratified that he will file a lawsuit against a newspaper El Universo feature writer (Emilio Palacio) and the paper’s editors, who are also responsible for what is published.
Fundamedios expresses its solidarity and support for Juan Carlos Calderón and Christian Zurita and rejects the president’s plan to sue for 10 million dollars two investigative journalists whose only income is their salaries. Such an action has an intimidating effect and works as a warning to any journalist who wants to investigate those in power. We consider, therefore, that it places the rights and freedoms of expression and the press at serious risk.
