La madrugada del 16 de diciembre de 2015 el canal Ecotel TV de Loja -ciudad ubicada en la frontera sur del país- denunció a través de un comunicado público que un grupo de elementos de la Policía Nacional y funcionarios del organismo regulador de telecomunicaciones ingresaron violentamente a las instalaciones del canal con la orden de incautar sus equipos y dejarlos fuera del aire. El medio explicó que se llevaron los equipos de transmisión y una serie de enseres vitales para mantenerse al aire y publicó fotografías de lo ocurrido.
El hecho se produce tres días después de que el presidente Rafael Correa durante su Enlace Ciudadano N° 454 tildara de “politiquero, disfrazado de periodista, envenenado y mentiroso” a Ramiro Cueva, propietario de dicho canal, tras haber denunciado en una nota periodística que para la inauguración de la Unidad del Milenio Bernardo Valdivieso, se llevaron escritorios y mobiliario de la Unidad Educativa San Juan Bosco en Gualaquiza. Cueva defendió esa información por considerar que si fue debidamente verificada y contrastada y atribuyó el allanamiento e incautación de la estación televisiva a dicha nota periodística. Sin embargo, reconoció que el pretexto legal para realizar esta acción es un proceso que enfrenta el medio de comunicación desde el 12 de septiembre de 2014.
En esa fecha, el entonces Consejo Nacional de telecomunicaciones (CONATEL), mediante resolución RTV-653-23-CONTAEL-2014 dispuso “iniciar el proceso de terminación anticipada y unilateral del contrato de concesión del canal 22 UHF” de Ecotel TV, celebrado en agosto de 1996 y renovado en julio de 2008, por una supuesta mora en el pago de las tarifas de uso de concesión ocurrida en el año 2002 y por un valor de USD 151,20 dólares.
Esa entidad se basó en la Disposición Transitoria Décima y en el artículo 112, numeral 10 de la Ley Orgánica de Comunicación (LOC) para retirar la frecuencia al medio televisivo. Dicha Disposición se refiere a la potestad legal para revertir la frecuencia de los medios de comunicación que no hayan iniciado sus operaciones en el plazo señalado; los que no hayan pagado las tarifas de uso de concesión; los que hayan arrendado por más de dos años su frecuencia, entre otras, para lo cual tomará en cuenta un informe presentado por la Comisión para la Auditoría de las Concesiones de las Frecuencias de Radio y Televisión de mayo de 2009.
Para ese entonces, las razones dadas por el CONATEL fueron rechazadas por la defensa de la estación televisiva, la cual argumentó que no es posible ser juzgados de acuerdo a una ley inexistente al momento de cometer la supuesta infracción, puesto que la LOC está vigente desde el 25 de junio de 2013, mientras que la supuesta infracción se habría cometido en el año 2002. “No existe retroactividad de la ley” y “no cabe acción regresiva que menoscabe o anule injustificadamente el ejercicio de los derechos”, consta en los escritos presentados. Por ello, el medio de comunicación había interpuesto una acción de protección, la cual fue negada el pasado 7 de enero de 2015 por un Juez de la Corte Provincial de Justicia de Loja.
Ramiro Cueva anunció en un video que fue difundido por Internet y redes sociales que se acogerán al derecho constitucional a la resistencia y que volverán al aire “pronto”. También aseguró que permanecerán en los estudios del canal y que pernoctarán allí si es necesario .
Esta no es la primera vez que se dan operativos en contra de este canal. El pasado 5 de diciembre de 2013, un operativo policial allanó las instalaciones de EcotelTv, en horas de la madrugada, para incautar algunos equipos de la extinta emisora EcotelRadio que ya había dejado de funcionar en agosto de ese año, cuando un operativo similar retiró los equipos transmisores de las repetidoras.
Police seize TV station equipment leaving it off the air
In the early morning of December 16 2015, Ecotel TV Station of the city of Loja – located on the southern border of the country – denounced through a public statement that a group of members of the National Police and officials of the telecommunications regulatory body violently entered the TV station’s facilities with orders to seize the equipment and leave the station off the air. The media outlet said they took the transmission equipment and a number of tools that are essential to stay on the air and published pictures of what happened.
This occurred three days after President Rafael Correa, during his No. 454 weekly broadcast, called the owner of the station, Ramiro Cueva, a «political intriguer disguised as a journalist, poisoned and a liar», after he denounced in a news item that for the opening of Millennium Unit Bernardo Valdivieso, desks and furniture were taken from Education Unit San Juan Bosco in Gualaquiza. Cueva defended this information on the grounds that it was duly verified and corroborated and attributed the raid and seizure of the TV station to that news story. He acknowledged, however, that the legal pretext for this action is a process the media outlet has been involved in since September 12, 2014.
On that date, the then National Council of Telecommunications (CONATEL), through resolution RTV-653-23-CONTAEL-2014 decided to «initiate the process of early and unilateral termination of the concession contract of channel 22 UHF» of Ecotel TV, entered into in August 1996 and renewed in July 2008, for alleged arrears of the fees for the use of the concession occurred in 2002 for USD 151.20.
That entity used the Tenth Transitional Provision and Article 112, paragraph 10 of the Organic Communication Law (LOC) to take away the TV station’s frequency. This Provision refers to the legal authority to revert the frequencies of media outlets that have not started operating within the prescribed period; those that have not paid the fees for use of concession; those who have leased their frequencies for longer than two years, among others, for which it will take into account a report presented by the Commission for the Audit of Television and Radio Frequency Concessions of May 2009.
At the time, the reasons given by the CONATEL were rejected by the TV station’s defense, who argued that it is not possible to be judged based on a law that was nonexistent at the time when the infringement was allegedly committed, considering that LOC has been in force since June 25, 2013, while the infringement was allegedly committed in 2002. «There is no retroactivity of the law» and «there can be no regressive action that unjustifiably impairs or annuls the exercise of rights», say their written submissions. For this motive, the media outlet had filed a request for a protective action, which was rejected on January 7, 2015 by a judge of the Provincial Court of Loja.
Ramiro Cueva announced in a video that was broadcasted on the Internet and social networks that they will exercise the constitutional right to resistance and return to the air «soon». He also stated that they will stay in the TV station’s premises and will spend the night there if necessary.
This is not the first time that operations have been mounted against this station. On December 5 2013, a police operation raided EcotelTV’s facilities in the early morning hours, to seize some equipment from the former EcotelRadio station, which had stopped operating in August of that year, when a similar operation took away its relay stations’ transmitting equipment.
