El 21 de noviembre de 2012, diario El Telégrafo hizo pública la demanda interpuesta por Salvador Quishpe, prefecto de Zamora Chinchipe -localidad ubicada a 698 km de Quito, en el sureste del Ecuador- en contra de Orlando Pérez, director de ese medio, por haberle causado «daño espiritual» supuestamente causado a raíz de una nota difundida por este medio bajo el título «Dirigente apoya la minería». El funcionario pide una indemnización de 5 millones de dólares.
De acuerdo con este medio de propiedad del Estado, Quishpe entabló la demanda el pasado 3 de septiembre, convirtiéndose en el segundo juicio interpuesto por este funcionario en contra del director del rotativo.
Al igual que en la anterior demanda – archivada el pasado 16 agosto por el Juzgado Tercero de lo Civil de Pichincha- Quishpe, pidió que se repare el daño «espiritual» y a su honra, y pide 5 millones de dólares como indemnización alegando que «se le quitó la ‘tranquilidad de espíritu’ (…) se me ha estigmatizado como corrupto y de doble moral, un sinvergüenza, todo lo cual cambió mi proyecto de vida», reza el escrito difundido por el periódico.
La demanda se basó en la publicación de una nota publicada por diario El Telégrafo el pasado 21 de marzo de 2012 bajo el título: «Dirigente apoya la minería».
En esta nota se afirmó, entre otras cosas que «Salvador Quishpe, actual prefecto de Zamora, creó el Proyecto Diálogo Intercultural Minero, en 2011, junto con una empresa holandesa, auspiciada por la Embajada de ese país. El 22 de febrero de 2011, formó la compañía civil Kenkuim-Kurinunka, para explotar en la zona de Conguime, sin descartar al Pangui, en donde ahora está el Proyecto Mirador».
El prefecto afirmó en la demanda, que el director de El Telégrafo «jamás dispuso que se rectifique la información» y que en «la publicación se denota que jamás contrastaron la información con la fuente, ni realizaron ninguna investigación».
Dicha demanda ya fue admitida a trámite y recayó en el Juzgado Décimo de lo Civil de Pichincha.
Fundamedios recuerda que la información relativa a la gestión de los funcionarios públicos está especialmente protegida por el derecho a la libertad de expresión, y no puede ser objeto de responsabilidades ulteriores salvo casos excepcionales . En este aspecto, los funcionarios públicos están expuestos a un nivel mayor de escrutinio público, y deben ser más tolerantes a la crítica y a la fiscalización de la prensa y la ciudadanía. No obstante, este principio ha sido constantemente cuestionado por los funcionarios del Gobierno central, quienes han sido los primeros en utilizar figuras penales inexistentes, como el del «daño espiritual».
Fundamedios hace un llamado a todos los sectores para que se deje de judicializar el trabajo periodístico y se respeten los estándares internacionales que protegen la libre expresión.
Prefect sues state newspaper director and requests $5 million in damages for “spiritual damage”
On 21 November 2012, the newspaper El Telégrafo disclosed the lawsuit filed by Salvador Quishpe, prefect of Zamora Chinchipe – an area located 698 km from Quito, in southeast Ecuador – against Orlando Pérez, director of that paper, for having allegedly caused him «spiritual damage» through an article published under the title «Leader Supports Mining.»He is requesting a compensation of 5 million dollars.
According to this media outlet, which is owned by the State, Quishpe filed the lawsuit on 3 September. This is the second trial initiated by this official against the newspaper’s director. As in the previous lawsuit – filed on 16 August by the Third Civil Court of Pichincha – Quishpe requested that the spiritual “damage” against him and his honor should be repaired and asked for $ 5 million in compensation arguing that «his ‘peace of mind’ was taken from him (…)I have been stigmatized as corrupt and as having double standards, a scoundrel, all of which changed my life plan”, reads the statement released by the newspaper. The lawsuit was based on the publication of an article by the newspaper El Telégrafo on 21 March under the title:»Leader supports mining.»
The article stated, among other things, that «Salvador Quishpe, current prefect of Zamora, created the project Intercultural Mining Dialogue in 2011, along with a Dutch company, sponsored by that country’s Embassy.On 22 February 2011, he created the civil company Kenkuim-Kurinunka to explore for minerals in the area of Conguime, without discarding the Pangui, where the Mirador Project is currently being developed”.
The prefect stated in the lawsuit that the El Telégrafo’s director «never ordered the rectification of the information» and that «the article makes it clear that they never checked the information with the source, or carried out an investigation.» The lawsuit has already been admitted and sent to the Tenth Civil Court of Pichincha.
Fundamedios recalls that information concerning the management of public officials is specially protected by the right to freedom of expression, and cannot be subject to the subsequent imposition of liability except in exceptional cases.In this respect, public officials are exposed to a higher level of public scrutiny, and should be more tolerant of criticism and control by the press and the public.However, this principle has been constantly questioned by central government officials, who have been the first to use non-existent criminal offenses such as «spiritual damage».
Fundamedios appeals to all sectors to stop prosecuting journalists’ work and respect international standards that protect free speech.
