El 15 de junio de 2013, el presidente Rafael Correa anunció, durante el Enlace Ciudadano N 326 que iniciará una acción judicial en contra de diario Hoy por un titular publicado el pasado 31 de mayo al que calificó de «mentira grosera» y, tras citar uno de los artículos de la recientemente aprobada Ley de comunicación, que aún no entra en vigencia, aseguró que con esta nueva normativa «se les acabó la fiesta».
«¿Y ustedes creen que quieren rectificar? Ya pusimos, pues, la correspondiente acción judicial y les vamos a ganar en la justicia (…) Van a decir ‘Correa domina la justicia’. No, Correa tiene la verdad, tenemos la razón y van a tener que rectificar y verán todas las barbaridades que van a decir, pero es pura y simple prepotencia. Es evidente que mintieron, pusieron un titular engañoso, pero como se han creído los reyes del mambo no les da la gana de rectificar, cumpliendo la Constitución, la ley, la ética elemental profesional. No entienden que se les acabó la fiesta, que aquí manda el pueblo ecuatoriano, no mandan unas cuantas familias que tuvieron dinero para comprarse una imprenta», enfatizó el Presidente.
El titular al que se refiere Correa se publicó en diario Hoy el pasado 31 de mayo, de una nota de la agencia AFP que decía: «Correa califica de novelería al matrimonio homosexual». Tras la difusión del mismo, y durante casi dos semanas, la Secretaría de Comunicación, SECOM, de la Presidencia de Ecuador emprendió una intensa campaña en contra de ese diario a través de notas descalificadoras publicadas en los medios de gobierno, así como en cadenas nacionales de radio y TV, acusando al rotativo de que «tergiversó gravemente» el titular de una nota de la agencia AFP.
Un oficio enviado el 31 de mayo por Fernando Alvarado, secretario nacional de comunicación, también afirmó que el titular referido «no corresponde a la verdad (…) y que no solo orienta equivocadamente a sus lectores, sino también modifica, sin observancia alguna de ética periodística, la nota original de la agencia AFP». A esto le siguió una demanda de acción de protección interpuesta por la Defensoría del Pueblo .
En cuanto a la nueva Ley de Comunicación, el jefe de Estado resaltó los puntos que él considera positivos de esta normativa, como la obligatoriedad de que las personas que manejan información tengan título profesional de periodistas; que por medio del estado de emergencia se pueda poner censura previa e imponer cadena nacional «para que no haya periodistas que inciten a la violencia»; así como la existencia de la figura de «linchamiento mediático» para prohibir la difusión de información, que de manera directa o a través de terceros, sea producida de forma concertada y publicada reiterativamente a través de uno o más medios de comunicación.

On June 15, 2013, during its weekly National Broadcast N° 326, President Correa announced that the Government will start a legal process against Diario Hoy, for the publication of an article on May 31 past. Correa indicated that the article was a “gross lie”, and indicated that the norms in the new Communications Law will not allow these things to happen again, even though such law is not in force yet. Correa indicated that “the party is over” for the media.

They will surely say ‘Correa controls the Judiciary’, but no, Correa is right and speaks the truth, and they will have to rectify. You will see all the terrible things they will say, but it´s only arrogance. It’s evident that they lied, they published a misleading headline, but since they think they are the kings of the world, they just won´t correct it. They violate the Constitution, the Law, the most basic work ethics. They don’t understand that the party is over, that the people of Ecuador now rule this place, and not a few families that could afford a printer”, the President said.
Correa refers to a headline published by Diario Hoy on may 31, quoting an article by AFP news agency that said. “Correa saysthat gay marriageisjust a fad”. From the publication of the article on, the National Secretariat of Communication SECOM, the Executive´s media coordinator, launched an intense campaign against this newspaper. The Government has disparaged Diario Hoy through press notes and national radio and TV broadcasts, accusing the newspaper of gravely twisting the meaning of an article published by AFP news agency.
The National Secretary of Communication, Fernando Alvarado, addressed a note on May 31 indicating that the aforementioned headline is not coherent with the truth, (…) and that it misleads readers while modifying the note by AFP in an unethical fashion”. The National Ombudsman joined SECOM´s request for rectification.
As for the recently aproved Communications Law, the President highlighted some of the norms that he believes are the most important, such as the requirement that journalists must hold a degree on that field, that during states of emergency prior censorship may be imposed while national broadcasts are made mandatory. «So thatjournalistswon’t incite violence”.
The creation of the mediatic lynchingfigure, actually creates prior censorship to information of public interest. In practice, it forbids that media publish or reproduce information about people repeatedly, which is a broad prohibition that may inhibit debate on issues related to the public administration.
