El 22 de marzo de 2011, el presidente Rafael Correa presentó una demanda penal en contra de la compañía anónima diario El Universo, el director Carlos Pérez Barriga y el editor de Opinión, Emilio Palacio, «por injurias calumniosas y exige, en calidad de ciudadano, una indemnización de un total de $80 millones y tres años de prisión para Carlos, César y Nicolás Pérez, directivos del periódico; y para el articulista Emilio Palacio», según reza una publicación del mismo diario El Universo, del 30 de marzo.
De acuerdo con este rotativo, el proceso, del cual aún no han sido notificados, ya se encuentra en el Juzgado 15º de Garantías Penales del Guayas, a cargo del juez Oswaldo Sierra y está a la espera de que el Primer Mandatario realice un reconocimiento de firma con la cual el juez podrá decidir si acepta o no la querella.
En un inicio, el reconocimiento de firma por parte del Presidente Correa fue programado para el 29 de marzo, pero, como esta diligencia no se llevó a cabo por otras ocupaciones del Primer Mandatario, se ha fijado para una fecha posterior, aún por definir.
La querella del Presidente se dio por el artículo «No a las mentiras» firmado por Palacio, el pasado 6 de febrero, en relación al papel del Jefe de Estado el 30-S, fecha de la revuelta policial.
El 21 de marzo, el presidente Correa señaló, durante una entrevista radial para el portal de noticias Ecuadorinmediato.com, que «será un hito en la historia ecuatoriana» enjuiciar a los directivos de Diario El Universo y a Emilio Palacio .
En ese espacio, el Presidente insistió que «hace poco un periodista dijo que yo debía disparar a discreción a un hospital lleno de civiles sin previo aviso. ¿Qué es lo que van a decir los directivos de ese diario? Bueno, esa fue la opinión de ese editorialista. ¡Mentiras! Eso no es responsable, eso no es opinión. Esa es una acusación gravísima porque el directorio es responsable de la política editorial del diario… nosotros estamos presentando una demanda no solo en contra del editorialista, sino contra los directivos de Diario El Universo», aseveró el Mandatario.
President of the Republic sues newspaper, editors and feature writer for $80 million
On 22 March 2011, President Rafael Correa filed a criminal lawsuit against the corporation Newspaper El Universo, its editor in chief Carlos Pérez Barriga and its opinion editor Emilio Palacio, accusing them of «malicious slander, and demanding, in his capacity as a citizen, damages for a total of $80 million and a three year prison sentence for Carlos, César and Nicolás Pérez, the newspaper’s main editors; and for editorial writer Emilio Palacio», according to an article printed by the same paper on 29 March.
According to El Universo, the suit, which they have not been notified about yet, has already been filed at the Guayas 15th Criminal Investigations Court, in charge of Judge Oswaldo Sierra. The judge is waiting for a signature authentication by the president before deciding if he will accept or not the complaint.
President Correa’s signature authentication was initially programmed for March 29, but a later date will be set because he was not able to attend.
The president lodged the complaint because of the article «No a lasmentiras» signed by Palacio on 6 February, which dealt with Correa’s role on the 30- S, the date of the police uprising.
On 21 March, President Correa pointed out during a radio interview for news portal Ecuadorinmediato.com, that bringing newspaper El Universo’s editors and Emilio Palacio to trial «will mark a milestone in Ecuadorian history».
During the interview the president insisted that «not long ago a journalist said I should fire indiscriminately against a hospital full of civilians without previous warning.What are this newspaper’s editors going to say?Well, that was the editorial writer’s opinion. Lies!That’s not responsible, that’s not an opinion.That is an extremely serious accusation because the editors are responsible for the newspaper’s editorial line… we are filing a lawsuit against El Universo’s editors, not just its editorial writer», he asserted.
