Presidente de la República pide se sancione a revista por supuestamente violar el silencio electoral

El 04 de junio de 2011, el presidente Rafael Correa, durante su Enlace Ciudadano No 223, desde Puerto Ayora, en las Islas Galápagos afirmó que la revista Vistazo cometió una infracción electoral al publicar un editorial que se refiere a las preguntas planteadas en la consulta popular y referendo que, a criterio del Primer Mandatario, representan una «descarada infracción» que debe ser sancionada.

Durante el enlace sabatino, Rafael Correa aseguró que los medios de comunicación fueron sus grandes adversarios en la consulta del pasado 07 de mayo y que, pese a ello, ha vencido y aseguró que la revista Vistazo cometió una infracción electoral que debe ser sancionada, al supuestamente violar el silencio electoral de 48 horas establecido por ley antes de elecciones.

El día 06 de mayo hizo infracción electoral, Vistazo saca toda una publicación: ‘Votar No’, señalando las preguntas que hay que votar No; descarada infracción electoral. Vamos a ver si alguien se atreve a ponerle el cascabel al gato, porque esa es una infracción y debe ser multada», aseveró el Mandatario.

La acusación que hace el presidente Correa se basa en el hecho de que la revista Vistazo en su edición No 1049 el pasado 04 de mayo, publicó un editorial bajo el título de «Un no rotundo».

En el editorial, la revista dio a conocer su posición y analizó los motivos para votar No en las preguntas 3, 4, 5 y 9 de la consulta, relacionadas con los cambios en el sistema judicial,  las limitaciones en la propiedad y en la difusión de contenidos en los medios .

Patricia Estupiñán, editora general de la revista Vistazo aseguró a Fundamedios que lo publicado fue un editorial y que, por lo tanto, no han violado la ley electoral. «No hicimos ninguna propaganda ni promocionamos el No, lo que hicimos fue dar nuestra posición editorial… pero ya se está sancionando la opinión como medio», dijo Estupiñán.

Por su parte, en el Tribunal Contencioso Electoral el caso aún no ha llegado a esta dependencia, según confirmaron fuentes de este organismo.

On 4 June 2011, during the 223rd edition of his program Enlace Ciudadano, broadcasted from Puerto Ayora in the Galápagos Islands, President Rafael Correa stated that the magazine Vistazo committed an electoral offense by publishing a leading article about the questions presented in the popular consultation and referendum which, according to the Chief of State, was a «shameless infraction» that must be sanctioned.

During the Saturday program, Rafael Correa declared that the media were his great adversaries during the May 7th referendum and that, even so, he won. He also stated that the magazine Vistazo committed an electoral infraction that must be sanctioned, by allegedly violating the electoral 48 hour silence established by the law before the elections.

«On May 6thVistazo committed an electoral infraction, it published an article stating:‘Vote No’, pointing out which questions people should vote No for; a shameless electoral infraction. Let’s see if anyone dares to stick their necks out, because that is an infraction and it should be sanctioned», asserted the Chief of State.

The accusation made by President Correa is based on the fact that in its 1049 edition of May 4 Vistazo published an editorial with the title «An emphatic no».

In this article the magazine stated its position regarding the referendum and analyzed the motives for voting No for questions 3, 4, 5 and 9,which were related to changes in the judicial system, limits on property and the diffusion of contents by the media.

Patricia Estupiñán, Vistazo’s general editor, affirmed to Fundamedios that the article was an editorial and that, therefore, they did not infringe the electoral law. «We did not make propaganda or promote the No vote, what we did was express our editorial position…but opinion is now already being sanctioned».

On the other hand, the case has not yet reached the Contentious Electoral Tribunal, as confirmed by sources in that entity.
