El 28 de mayo de 2013, el tuitero Danny Ayala, conocido en la red social como @DayalaEc, fue notificado de un acto urgente que solicitó el presidente de la república Rafael Correa a la Fiscalía por, presuntamente, “instigar a atentar en contra de su vida”. Esto por un ‘tuit’ publicado por Ayala el pasado 5 de marzo en el que decía: “RT si ahora quieres que se muera Correa”.
En el documento, en el cual el Jefe de Estado pide que se realice un peritaje, también se asegura que “el mensaje transcrito bien podría ser considerado por algún usuario de dicha red socialcomo una instigación para atentar en contra de mi vida, hecho que en vista de mis actuales funciones, evidentemente constituiría un magnicidio”.
Asimismo, en dicho escrito se afirma que la conducta del ‘tuitero’ se ajustaría a la conducta penal tipificada en el artículo 386 del Código Penal ecuatoriano que dice lo siguiente: “El que públicamente instigare a cometer un delito determinado contra una persona o institución, cuando el instigador no puede ser considerado legalmente como correo, será reprimido, por la instigación y aunque el delito no se hubiere perpetrado, con prisión de quince días a dos años, según la gravedad del delito instigado” .
Al respecto Ayala, un ciudadano ecuatoriano que trabaja en tecnología y cuenta con 934 seguidores en la red social Twitter, aseguró a Fundamedios que el mensaje publicado de ninguna manera tuvo el ánimo ni la voluntad de cometer, o instigar a cometer algún delito y afirmó que el Jefe de Estado tampoco debió sentirse aludido con el ‘tuit’, pues tampoco lo mencionó de manera directa.
Ayala también rechazó la manera en cómo fue notificado, pues aseguró que a su domicilio llegaron 10 personas, cuatro de la policía judicial y seis de la fiscalía para notificarle del acto urgente. Un número de funcionarios que considera innecesario para la diligencia.
President accuses tweeter of instigationes
On 28 May 2013 tweeter Danny Ayala, known in the social network as @DayalaEc, was notified of an urgent action requested by President Rafael Correa to the Prosecutor’s Office because Ayala had allegedly «instigated an attack against his life”.This was prompted by a ‘tweet’ posted by Ayala on 5 March which said:»RT if you now want Correa to die».
The document sent by the president, in which he calls for an expert opinion, also says that «the transcribed message could well be considered by some user of this social network as instigation to attempt against my life, a fact that in view of my current position would obviously be an assassination”.
The document also states that the tweeter’s behavior is consistent with the criminal conduct categorized by Article 386 of the Ecuadorian Criminal Code, which states: «Whoever publicly instigates to commit a specific crime against a person or institution, when the instigator cannot be considered legally as a messenger, shall be held, for the instigation and even if the offense was not committed, in prison for fifteen days to two years depending on the severity of the crime instigated».
Ayala, an Ecuadorian citizen who works in technology and has 934 followers on the social network Twitter, asserted to Fundamedios that the published message in no way intended or wanted to instigate anyone to commit a crime and said that the Head of State should not have felt alluded to by the ‘tweet’, as he had not even been directly mentioned.
Ayala also rejected the way in which he was notified. He declared that 10 people arrived at his home, four members of the judicial police and six from the prosecutor’s office, to notify the urgent action.A number of officials he believes unnecessary to relay a message.
