Presidente «perdona» a directivos y exarticulista de El Universo y desiste de la demanda contra autores de libro «El Gran Hermano»

El 27 de febrero de 2012, el presidente Rafael Correa anunció «el perdón a los acusados», en el caso El Universo e informó que «concederá la remisión de las condenas que merecidamente recibieron», refiriéndose a la sentencia por delito de injurias dictada en contra de Carlos, César y Nicolás Pérez, directivos del rotativo y su exeditor de opinión, Emilio Palacio. También informó que desistirá de la demanda, por daño moral, que interpuso en contra de los periodistas y autores del libro «El Gran Hermano», Juan Carlos Calderón y Christian Zurita, porque «no vale la pena perder el tiempo en personas que ni aquello merecen».

El Presidente hizo el anunció en un acto solemne que se realizó en el Salón Amarillo de Palacio de Gobierno, acompañado de su gabinete. Además, el acto fue transmitido por cadena nacional de radio y TV y se hizo traducción simultánea al inglés y al francés. Al mismo tiempo, en un sector popular de la ciudad de Guayaquil, La Trinitaria, se colocaron pantallas gigantes y fueron convocados partidarios del Gobierno para escuchar el mensaje presidencial.

En su mensaje, el Presidente también anunció que desistirá de la demanda que propuso en contra de los autores del libro ‘El Gran Hermano’, pues según su criterio: «no vale la pena perder el tiempo en personas que ni aquello merecen».

En ese contexto, y con el perdón, pero no el olvido, Rafael Correa aseguró que, pese a su decisión, se cumplieron los tres objetivos que buscaba con el juicio. Primero, demostrar que El Universo mintió y no corrigió su mentira; segundo,» evidenciar que los responsables no son solamente los malquerientes que no tienen nada más que perder (…), sino también los directivos del medio y el propio diario por el cual se instrumentan las infamias» y tercero, «lograr que los ciudadanos del Ecuador y toda nuestra América superen el miedo a esa prensa que actúa de manera corrupta y abusiva y que, con la ley en la mano, los ciudadanos defiendan sus derechos».

Asimismo, el presidente Rafael Correa descalificó la labor que realiza la Comisión Interamericana de Derechos Humanos (CIDH) y la Relatoría Especial para la Libertad de Expresión a la que cuestionó por tener presupuesto propio que, según el Jefe de Estado, «refleja la hegemonía del capital que está detrás de los negocios de los medios de comunicación».

El Primer Mandatario también enfatizó en que, con el juicio «se evidenciaron los grandes sesgos de la CIDH, comisión que tiene más bien la característica de una ONG y no de una institución jurídica, en donde la legalidad es secundaria. Así asumen cruzadas reales o imaginarias», aseguró el Presidente .

Cabe recordar que el pasado 16 de febrero de este año, la Sala de lo Penal de la recientemente reformada Corte Nacional de Justicia ratificó, en casación, la condena de tres años de prisión y el pago de $40 millones de dólares, por injuriar al Presidente, en contra de los directivos y exeditorialista de El Universo; mientras que el 7 de febrero pasado, los periodistas Juan Carlos Calderón y Christian Zurita fueron sentenciados, en primera instancia, al pago de $2 millones de dólares por el supuesto daño espiritual causado al Primer Mandatario.

Sin embargo, estos últimos aún afrontan el juicio interpuesto por la ministra María de los Ángeles Duarte, quien exige el pago de $500 mil dólares, por cada uno, como indemnización por supuesto daño moral, tras la publicación del mencionado libro de investigación.

President pardons «El Universo» executives and writers; drops lawsuit against «El Gran Hermano» authors

On 27 February 2012, President Rafael Correa announced his “forgiveness of the accused” in El Universo case and informed that he will “concede the remission of the convictions that were deservedly received”, referring to the sentence for the crime of offences issued against Carlos, César and Nicolás Pérez, directors of the newspaper, and its former opinion editor, Emilio Palacio.He also informed that he will withdraw the lawsuit for moral damage filed by him against journalists and authors of the book “El Gran Hermano”, Juan Carlos Calderón and Christian Zurita, because «it is not worth wasting time on people who do not deserve even that».

The president made these announcements during a solemn act that took place in the Yellow Room of the Government Palace, in the company of his ministers.The act was broadcasted by a national radio and TV chain and was simultaneously translated to English and French.In a popular sector of the city of Guayaquil, La Trinitaria, giant TV screens were set up and government supporters were invited to listen to the presidential message.

In his message, the president also announced that he willwithdraw the lawsuit filed against the authors of the book “El Gran Hermano” because, he believes:“it is not worth wasting time on people who do not deserve even that”.

In this context, after granting his pardon but stating he will not forget, Rafael Correa stated that despite his decision, he succeeded in the three objectives he wanted to achieve with the trial.First, to show that El Universo lied and did not correct its lie; second, “to make it evident that the responsible parties are not just spiteful people who have nothing more to lose (…), but also the directors of the media and the newspaper itself through which infamy is orchestrated”; and third, “to make the citizens of Ecuador and all of our America overcome their fear of this press that acts in a corrupt and abusive way, so that with the law in their hands, they can defend their rights”.

The president also discredited the work of the Inter American Commission of Human Rights (IACHR) and the Special Rapporteurs Office for the Freedom of Expression, which he questioned for having its own budget, and that according to the Chief of State, “reflects the hegemony of the capital that is behind the negotiations of the media”.

Correa also emphasized that the trial “made evident the great biases of the IACHR, a commission that has the characteristics of an NGO rather than a legal institution, in which legitimacy is secondary.Thus they take on real or imaginary crusades”.

It is worth remembering that on 16 February 2012, the Criminal Division of the recently reformed National Court of Justice ratified, during a hearing for the review of facts, the conviction to three years in prison and the payment of $40 million for offending the president against the directors and former editorialist of El Universo. Meanwhile, on 7 February, journalists Juan Carlos Calderón and Christian Zurita were sentenced in the first instance to pay $2 million for the alleged spiritual damaged they caused the chief of state. The two journalists, however, are still facing the lawsuit filed against them by Minister María de los Ángeles Duarte, who is demanding $500 thousand dollars from each of them as compensation for the alleged moral damage caused to her by the publication of the investigative journalism book.
