El 8 de diciembre de 2015, la Agencia de Regulación y Control de las Telecomunicaciones (ARCOTEL) notificó a la estación radial Democracia 920 AM con el inicio del proceso de reversión de su frecuencia. Este caso forma parte de un proceso de reversión de más de 300 frecuencias iniciado por dicha Agencia a nivel nacional bajo el argumento de que se ha obtenido la renovación de su frecuencia por una “autoridad no competente” según consta en la disposición transitoria décima de la Ley Orgánica de Comunicación (LOC).
Álvaro Rosero, director de Exa-Democracia hizo pública la notificación a través de su cuenta de Twitter y calificó de “absurdo” dicho proceso. La notificación llegó a nombre de su padre, Gonzalo Rosero, periodista y conductor del espacio de opinión y entrevistas Revista Informativa Democracia. En dicho escrito, la ARCOTEL “dispone el inicio del proceso de terminación anticipada y unilateral del contrato de concesión celebrado entre el ex Instituto Ecuatoriano de Telecomunicaciones (IETEL) y el señor Luis Gonzalo Rosero Chávez el 21 de diciembre de 1988 y renovado mediante escritura pública, el 01 de octubre de 2004, ante el notario Sexto del Cantón Quito, entre la ex Superintendencia de Telecomunicaciones (…) por haber obtenido la renovación automática de la frecuencia por parte de autoridad no competente.”
Rosero cuestionó en la red social que la autoridad competente de hoy desconoce lo actuado por la autoridad competente de 2004, pero confía en que si “efectivamente @Arcotel_ec actúa en derecho, como anuncia en sus redes sociales, el proceso debería archivarse”. El 14 de diciembre el director, junto a Gonzalo Rosero, presentó las pruebas de descargo ante la Agencia, acompañado de un grupo de ciudadanos, exfuncionarios y asambleístas simpatizantes con la radio .
Entre las estaciones que perderían la frecuencia están: Radio Sucesos; JC Radio en Quito; HCJB en sus distintas frecuencias en Quito, Machala y Ambato; Tropicana; Stereo Zaracay de Santo Domingo de los Tsáchilas. También se encuentran estaciones de televisión como Asomavision y Televisora del sur. Estas frecuencias se renovaron de oficio, o de manera automática por los funcionarios de Superintendencia de Telecomunicaciones (exSupertel) entre el 9 de mayo de 1995 y el 30 de abril de 1997. Sin embargo, según el Informe de la Comisión para la Auditoría de Frecuencias de Radio y Televisión, dichas renovaciones “no son válidas” por la ilegalidad de arrogación de funciones, que denota un abuso del poder por parte de funcionarios del exSupertel”, cuando le habría correspondido la aprobación de las renovaciones al Consejo Nacional de Radiodifusión y Televisión (exConartel).
Radio Democracia is notified that the process of reverting its AM frequency is due to begin
On 8 December 2015, the Agency for the Regulation and Control of Telecommunications (ARCOTEL), notified Radio Democracia 920 AM of its decision to initiate the reversion process of its frequency. This case is part of a process that involves more than 300 frequencies, initiated by this Agency nationwide claiming they obtained the renewal of their frequencies through a «non-competent authority» as stipulated in the tenth transitional provision of the Organic Communication Law (LOC).
Álvaro Rosero, director of Exa-Democracia, made the notice public through his Twitter account and called the process «absurd». The notice arrived bearing the name of his father, Gonzalo Rosero, journalist and host of the opinion and interview program Revista Informativa Democracia. In it ARCOTEL «orders the beginning of the process of early and unilateral termination of the concession agreement entered between the former Ecuadorian Institute of Telecommunications (IETEL) and Mr. Luis Gonzalo Rosero Chávez on December 21, 1988 and renewed by deed on October 1, 2004 , before the Sixth Notary of the Canton of Quito, by the former Superintendency of Telecommunications (…) after obtaining the automatic renewal of the frequency from a non-competent authority».
Rosero questioned in the social network the fact that the competent authority today would disown the actions taken by the competent authority in 2004, but is confident that if «@Arcotel_ec effectively acts according to the law, as it announces in social networks, the process should be closed». On December 14, the director, along with Gonzalo Rosero, presented exculpatory evidence before the Agency, accompanied by a group of citizens, former officials and Assembly members who support the radio station.
Other stations that will lose their frequencies are: Radio Sucesos; JC Radio in Quito; HCJB in its different frequencies in Quito, Machala and Ambato; Tropicana; Stereo Zaracay de Santo Domingo de los Tsáchilas. Television stations such as Asomavision and Televisora del Sur, are also included. However, according to the report of the Commission for the Audit of Radio and Television Frequencies, these renewals «are not valid» because of the illegality of the arrogation of functions, which denotes an abuse of power by officials of exSupertel», when the approval of renewals should have corresponded to the National Broadcasting and Television Council (exConartel).
