Se archiva causa contra periodista tras confesión judicial pedida por Secretario de Comunicación

El 17 de noviembre de 2015, periodista Roberto Aguilar, autor del blog Estadodepropaganda.com rindió una confesión judicial a pedido de Fernando Alvarado, secretario de Comunicación. Alvarado acusa al periodista de “calumnias y desprestigio” por sus opiniones emitidas desde dicho espacio. La diligencia, que tuvo lugar en la Unidad Judicial en Quito, se dio después una convocatoria anterior que había sido suspendida por haber sido convocada “por error”, en día de descanso, el pasado sábado 7 de noviembre. Tras este acto, el periodista fue notificado con el archivo del proceso.

Daniela Salazar, una de las abogadas del periodista comento, en entrevista para Rayuelaradio.com que  la jueza Gabriela Lemos, descalificó 7 de las 10 preguntas planteadas por el Secretario de Comunicación, las cuales tenían, a su criterio, el objetivo de que su defendido llegue a auto incriminarse. Sin embargo, al no ser de carácter personal, estas no fueron admitidas. Finalmente Aguilar admitió ser el autor y responsable de dicho blog.

Salazar también denunció que antes y durante esta diligencia se dieron varias irregularidades como la presencia del abogado de la Secretaría de Comunicación, sin explicar su calidad oficial, puesto que tampoco estuvo presente la Procuraduría, así como la carencia de la matrícula del abogado del funcionario, sin la cual no habría podido comparecer .

El pasado 25 de junio de este año, el autor del blog fue notificado para  rendir una confesión judicial. En el escrito presentado por Alvarado, a título personal y como representante legal de la SECOM, aseguró que “En los últimos días hemos venido siendo víctimas de calumnias y desprestigio de manera continua y sistemática en redes sociales, por parte.  del señor Roberto Aguilar Andrade quien funge ser el director y propietario de un blog en el cual consta como autor de un sinnúmero de ataques y mentiras en mi contra y en contra de mi representada”. En ese sentido, el funcionario pidió que se llame a confesión judicial al periodista, con base en el artículo 64 del Código de Procedimiento Civil, que establece que, entre los actos preparatorio para un juicio, la confesión judicial. La petición de Alvarado recayó en la Unidad Judicial Civil de Quito, misma que fue admitida a trámite el pasado 27 de mayo.

Process against journalist is closed after judicial confession requested by Communications Secretary

On 17 november 2015, journalist Roberto Aguilar, author of the blog Estadodepropaganda.com, made a judicial confession at the request of Fernando Alvarado, communications secretary. Alvarado accused the journalist of «libel and defamation» because of the opinions disseminated through his blog. The procedure, which took place in Quito’s Judicial Unit, took place after a previous session had been suspended because it had been organized «by mistake» on a non-working day, Saturday 7 November. Daniela Salazar, one of the journalist’s attorneys, commented in an interview with Rayuelaradio.com that Judge Gabriela Lemos, dismissed 7 of the 10 questions asked by the Communications Secretary, which had, she believed, the objective of making her client incriminate himself. However, because they were not personal, they were not admitted. Aguilar admitted to being the author and responsible for the blog.

Salazar also reported that there were several irregularities before and during the procedure, such as the presence of the Communications Secretary’s lawyer, without explaining his official capacity, considering that the Prosecutor was not present, as well as this lawyer’s lack of registration, without which he should not be able to appear in court.

On 25 June this year, the author of the blog was notified that he would have to make a judicial confession. The notice sent by Alvarado, in his personal capacity and also as legal representative of SECOM, states that «over the last few days we have been the victims of libel and defamation, issued continuously and systematically through the social networks by Roberto Aguilar Andrade, director and owner of a blog in which he appears as the author of countless attacks and lies against me and the institution I represent». The official requested that the journalist should be called to make a judicial confession, based on Article 64 of the Code of Civil Procedure, which establishes the judicial confession among the preparatory proceedings for a trial. Alvarado’s request went to Quito’s Civil Judicial Unit, and declared admissible on 27 May.
