El 06 de septiembre de 2011, la Superintendencia de Telecomunicaciones SUPERTEL notificó a siete estaciones de radio de las ciudades de Quito, Guayaquil y Cuenca, del inicio de un proceso de juzgamiento, tras haberse enlazado para emitir programas de iniciativa en defensa a la libertad de expresión.
Mediante boleta única, la SUPERTEL informó a las emisoras: Quito, Centro, Genial Exa, Visión, Platinum, de la ciudad de Quito; Radio City, de Guayaquil y Ondas Azuayas, de Cuenca, que podrían haber incurrido en una infracción administrativa Clase II. Esto, por no haber notificado previamente al organismo de control para realizar dicho enlace.
De acuerdo con la ley, la sanción en estos casos podría ser del 50% de 10 salarios mínimos vitales para cada radio y deberán contestar los cargos que se les imputan en el término de ocho días.
El proceso de juzgamiento tiene como antecedente un programa radial que se llevó a cabo el pasado 10 de agosto de 2011, por motivo del Primer Grito de Independencia en Ecuador. En él, participaron personalidades del periodismo para tratar el tema de la libertad de expresión. Dicho programa fue transmitido por las emisoras mencionadas, teniendo como señal matriz la de Ecuadoradio (Radio Quito y Platinum) .
La SUPERTEL se basó en un documento emitido por esa misma entidad, en el que certifican que las emisoras mencionadas «no ingresaron comunicación alguna a este organismo Técnico de Control, referente a una asociación para transmitir la misma programación el 10 de agosto de 2011». También, en la información de una nota periodística publicada por diario El Comercio el 11 de agosto, que detalla el encuentro transmitido por las emisoras.
FUNDAMEDIOS llama la atención sobre el hecho de que la iniciativa de un grupo de estaciones que han decidido unirse para la defensa de la libertad de expresión, a través de programas puntuales, sean indiciados en una posible infracción que acarrearía una sanción y que tiene el efecto de desalentar este tipo de iniciativas.
Judgment process begins against seven radio stations that jointly broadcasted program about freedom of expression
On 6 September 2011, the Telecommunications Superintendence, SUPERTEL, notified seven Quito, Guayaquil and Cuenca radio stations of the beginning of a trial against them after they linked together to broadcast programs on initiatives for the defense of the freedom of expression.
Through a standard form, SUPERTEL informed the radio stationsQuito, Centro, Genial Exa, Visión and Platinum, of the city of Quito; Radio City, of Guayaquil andOndasAzuayas, of Cuenca, that they could have incurred in a Class II administrative infraction.The reason for this was that they had not previously notified the control body about the link.
According to the law, the sanction in a case like this one could amount to 50% of 10 minimum living wages for each station. They have 8 days in which to respond to the charges presented against them.
The trial has a precedent in a radio program broadcasted on 10 August 2011 celebrating Ecuador’s First Cry of Independence.Renowned personalities of the world of journalism participated in it to deal with the issue of the freedom of expression.The program was broadcasted by the same stations, using Ecuadoradio’s (Radio Quito and Platinum) as their main signal.
SUPERTEL based its judgment on a document emitted by that same entity certifying that the radio stations «had not communicated this Technical Control body their intention to associate to broadcast the same programming on 10 August 2011». It also used an article published by El Comercio on 11 August giving details of the meeting broadcasted by the radio stations.
FUNDAMEDIOS draws attention to the fact that the initiative of a group of stations that decide to join together for the defense of the freedom of expression, through specific programs, may be indicted with a possible infraction that may result in a sanction, with the possible effect of discouraging this kind of initiatives.
