El 24 de enero de 2012, el juez Luis Quiroz, presidente de la Sala de lo Penal de la Corte Nacional de Justicia (CNJ) y encargado de resolver, en casación, la sentencia que condenó, por injurias, al ex articulista y los directivos de diario El Universo a tres años de prisión y al pago indemnizatorio de $40 millones, resolvió suspender la audiencia convocada para las 09:00, debido a la ausencia física del juez Enrique Pacheco, quien se excusó por enfermedad.
El juez Quiroz dijo que, con la ausencia del juez Pacheco, no existía tribunal completo para la realización de la audiencia, a la que acudieron dos jueces, el secretario y el oficial mayor.
Xavier Zabala Egas, abogado de la compañía El Universo dijo a FUNDAMEDIOS que tras esta suspensión y, tomando en cuenta que los actuales jueces terminarán sus funciones el miércoles 25 de enero, el siguiente paso será esperar a que se conforme la Nueva Corte Nacional de Justicia y la nueva Sala de lo Penal, que se encargaría de resolver el caso. Esto debido a un proceso de reestructuración de esta función del Estado.
Tras la decisión del Juez, el presidente Rafael Correa ofreció una rueda de prensa en donde cuestionó que El Universo siga dilatando el proceso. «Ellos saben que tenemos la razón, por eso quieren retrasar todo; quieren hacer daño y deslegitimar a la nueva corte», dijo el Primer Mandatario.
Mientras esto ocurría, en los exteriores de la CNJ se congregaron cerca de un centenar de simpatizantes del Presidente, quienes gritaban consignas como: «abajo la prensa corrupta; abajo los sicarios de tinta» .
El pasado 22 de marzo de 2011, el presidente Rafael Correa demandó penalmente al ex articulista de diario El Universo, Emilio Palacio; a sus tres directivos; Carlos, César y Nicolás Pérez y a la compañía anónima El Universo por $80 millones, tras la publicación del artículo de opinión «No a las mentiras» de autoría de Palacio, en relación al papel del Jefe de Estado en los hechos ocurridos el pasado 30 de septiembre.
Este caso recibió su primera sentencia en primera instancia el pasado 20 de julio de 2010. Ese día, un juez temporal declaró culpable de injurias a Palacio y a los directivos del periódico por autoría coadyuvante y ordenó tres años de prisión para cada uno y al pago de $40 millones. Esta condena que fue ratificada en segunda instancia.
Appeal for the review of facts in president’s trial against newspaper el universo is suspended indefinitely
On 24 January 2012, Judge Luis Quiroz, president of the Criminal Division of the National Court of Justice (CNJ) in charge of reviewing an appeal for the review of facts concerning the sentence that convicted a former feature writer and the directors of the newspaper ElUniverso to three years in prison and the payment of $40 million in damages, decided to suspend the hearing called for 9:00 am because of the absence of Judge Enrique Pacheco, who excused himself claiming to be ill.
Judge Quiroz stated that Judge Pacheco’s absence meant the tribunal was not complete and the hearing could not take place. Two judges, the secretary and the senior officer had attended.
XabierZabalaEgas, El Universo’s attorney, told FUNDAMEDIOS that if the fact that the judges will cease in their functions on Wednesday 25 January is taken into account, the suspension means that it will now be necessary to wait for the new National Court of Justice and Criminal Division to be established. They would be in charge of the case.This will occur because of a restructuring process in this branch of the State.
After the judge’s decision was announced, President Rafael Correa offered a press conference during which he blamed El Universo for delaying the process.“They know we are right, so they want to delay everything; they want to harm and undermine the authority of the new court”, said the Chief of State.
While this took place, around a hundred of the president’s sympathizers congregated outside the CNJ headquarters shouting slogans such as“down with the corrupt press; down with the ink hit men”.
On 22 March 2011, President Rafael Correa sued former El Universo feature writer Emilio Palacio; its three directors, Carlos, César and Nicolás Pérez; and the company El Universofor $80 million after the opinion article “No a lasmentiras” was published. The article, which was written by Palacio, referred to the president’s actions during the events of 30 September 2010.
On 20 July 2011, in a first instance ruling, a temporary judge declared Palacio guilty of offences against the president and the newspaper’s directors as contributing authors of the crime. He sentenced them to three years in prison and to pay $40 million in damages. This sentence was ratified in a second instance.
