El 20 de octubre de 2015, la Secretaría de Comunicación (SECOM) negó a Fundamedios el derecho constitucional de asociarse para defender la libertad de expresión al no dar paso al registro de una reforma de estatuto, cuyo objetivo central es la defensa de este derecho humano fundamental.
El argumento dado por la Secom, ente que regula a Fundamedios desde inicios del 2014, es que “no es procedente que una organización sin fines de lucro pretenda atribuirse facultades jurídicamente atribuidas a la administración pública”.
El oficio de la Secom dice lo siguiente: “Conforme el artículo 11 número 9 de la Carta Fundamental, el más alto poder del Estado consiste en respetar y hacer respetar los derechos garantizados en la Constitución, en consecuencia, resulta inadecuado e incongruente que una persona jurídica de derecho privado pretenda a través de reformas estatutarias internas atribuirse la calidad de defensora o protectora de los derechos fundamentales cuando la norma suprema claramente establece que tal obligación le corresponde al Estado ecuatoriano. Asimismo, la Constitución de la República, en el artículo 99, determina categóricamente que la acción ciudadana será presentada ante autoridad competente de acuerdo con la ley y se ejercerá en forma individual o en representación de la colectividad, cuando se produzca la violación de un derecho o la amenaza de su afectación . Es decir, existen mecanismos establecidos constitucionalmente para la defensa de derechos fundamentales como la libertad de expresión y asociación. Por tanto, no es procedente que una organización sin fines de lucro pretenda atribuirse facultades jurídicamente atribuidas a la administración pública”.
El oficio, firmado por el director de asesoría legal, Christian Hernández, culmina con el pedido a Fundamedios de que adecúe su objetivo general a las normas señaladas y da 20 días para responder.
Esta acción ocurre después de que la Secom resolviera el 25 de septiembre de este año archivar el proceso de disolución de Fundamedios por supuestamente incumplir con sus propios estatutos.
Secom claims that organizations cannot defend freedom of expression
On 20 October 2015, the Communication Secretariat (SECOM) refused Fundamedios the constitutional right to associate to defend freedom of expression by not allowing the registration of a statute amendment whose main objective is the defense of this fundamental human right.
The argument presented by Secom, the entity that regulates Fundamedios since the beginning of 2014, is that «it is not appropriate that a non-profit organization should assume powers legally conferred to the public administration».
The document issued by Secom states: «In accordance with Article 11 item 9 of the Constitution, the highest power of the State consists in respecting and enforcing the rights guaranteed by the Constitution, as a result, it is inappropriate and incongruous that a private legal entity should, through internal statutory amendments, assume the quality of advocate or protector of fundamental rights when the supreme law clearly establishes that such obligation is the responsibility of the Ecuadorian State. Also, the Constitution, in Article 99, categorically determines that citizen action should be presented to the relevant authority in accordance with the law and should be exercised individually or on behalf of the community, when the violation of a right occurs or there is a threat that it may be affected. In other words, constitutionally established mechanisms exist for the defense of fundamental rights such as freedom of expression and association. It is not appropriate, therefore, that a non-profit organization should assume powers legally conferred to the public administration».
The document, signed by the director of legal advice, Christian Hernández, ends by requesting Fundamedios to adjust its general aim to the specified regulations and gives it 20 days to respond.
This action occurs after Secom resolved on 25 September of this year to terminate the process of dissolving Fundamedios for allegedly breaching its own statute.
