El 18 de Enero de 2016, la Delegación Provincial de Imbabura de la Contraloría General del Estado ejecutó el cobro de USD 3.849,47, incluidos intereses y costas, a “Radio la Premier 91.9FM” de Ibarra -ciudad ubicada a 115 Km al noreste de Quito- tras una sanción administrativa impuesta por la Superintendencia de la información y Comunicación (Supercom), por incumplir el artículo 103 de la Ley Orgánica de Comunicación (LOC), el cual se refiere a la difusión de contenidos musicales.
El 21 de abril de 2015, la Supercom, mediante resolución Nro. 017-2015-DPS, determinó la responsabilidad de radio “La Premier de Ibarra” por lo que le impuso una multa de 10 salarios básicos unificados.
La Supercom al no contar con capacidad coactiva remite a la Contraloría General del Estado las resoluciones sancionatorias para que se proceda con el cobro de multas, en los casos en los que los medios de comunicación sancionados no han cancelado el monto impuesto por este organismo de control. Este es el noveno caso que la Supercom actúa a través de la Contraloría para cobrar multas por sanciones.
Supercom collects the ninth fine through coercive action
On January 18th 2016, the Provincial Delegation of Imbabura of the Comptroller General of The State executed the collection of USD 3.849,47, included interests, from “Radio la Premier 91.9FM” from Ibarra -city that is about 115 Km northeast of Quito- after the administrative sanction imposed by the Superintendency of Information and Communication (Supercom), because of breaching article 103 from the Organic Communication Law (LOC), which refers to the broadcasting of musical contents.
On April 21st 2015, Supercom, through resolution N° 017-2015-DPS, mandated legal liability to the radio “La Premier de Ibarra”, that is why it charged a fine of 10 unified basic salaries.
As Supercom does not have the legal capacity to collect fines, it referred to the Comptroller General of The State the punitive decision in order to carry out the collection of fines in the case that sanctioned media do not pay the imposed amount of money by this control body. This is the ninth case in which Supercom takes action through the Comptroller to collect fines that are result of sanctions.
