El 23 de Diciembre de 2015, la Contraloría General del Estado ejecutó el cobro de USD 3540 dólares a Radio Fútbol FM, por una multa impuesta por la Superintendencia de la Información y Comunicación (Supercom), con base en la resolución Nro. 033-2015-DNGJPO-INPS, emitida el 4 de septiembre de 2015.
La resolución indica que el medio no acató lo dispuesto en el artículo 65 de la Ley Orgánica de Comunicación y artículo 7 del Reglamento a la Ley, al transmitir el programa ‘Hablando Jugadas’, en decir que se difundió contenido comunicacional que no correspondía a la franja horaria.
En otro caso, el 17 de Diciembre de 2015, la Delegación Provincial de Manabí de la Contraloría General del Estado ejecutó el cobro de una multa de USD 5.450,12 dólares, incluidos intereses y costas, a Diario “El Mercurio” de Manabí, provincia de la Costa ecuatoriana, por una multa impuesta por la Superintendencia de la información y Comunicación (Supercom), tras incumplir el artículo 23 de la Ley Orgánica de Comunicación, el cuál se refiere al derecho a la rectificación . El proceso se inició con una denuncia planteada por el ciudadano José Macías en contra del medio impreso y la sanción se dio el pasado 24 de diciembre de 2014, mediante resolución Nro. D-008-2014-DPS-IICZ4P, emitida por la Supercom, que impuso una multa del 10% de la facturación promedio de tres meses, no solo por la denuncia presentada por el señor Macías, sino también por haber reincidido en dos ocasiones durante un año el incumplimiento del mencionado artículo.
Con estos suman ocho los casos en los cuales la Superintendencia utiliza la acción coactiva de la Contraloría para hacer efectivos estos cobros. La Supercom, al no contar con capacidad coactiva, remite a la Contraloría General del Estado las resoluciones sancionatorias para que se proceda con el cobro de multas.
Supercom collects eight fine against media outlets coercively through the Comptroller General of the State
On 23 December 2015, the General Comptroller of the State collected USD 3,540 from Radio Fútbol FM for a fine imposed by the Superintendency of Information and Communication (Supercom), based on resolution No. 033-2015-DNGJPO-INPS, issued on 4 September 2015.
The resolution states that the media outlet failed to comply with the provisions of Article 65 of the Organic Communication Law and Article 7 of the Regulations of the Law, by broadcasting the program ‘Hablando Jugadas’ and disseminating content that did not correspond to the time slot.
In another case, on December 17 2015, the Provincial Delegation of Manabí of the Comptroller General of the State collected USD 5,450.12 for a fine, including interest and costs, imposed on the newspaper «El Mercurio» of Manabí, a province of the Ecuadorian coast, by the Superintendency of Information and Communication (Supercom), after breaching Article 23 of the Organic Communication Law concerning the right to rectification. The process began with a complaint filed by citizen José Macías against the print media outlet and the fine was imposed on 24 December 2014, through resolution No. D 008-2014-DPS-IICZ4P, issued by Supercom. It amounted to 10% of the average turnover of three months, not only because of the complaint filed by Mr Macías, but also for having reoffended on two occasions over a year, breaching that same article.
This is the eighth case in which the Superintendency uses the Comptroller’s coercive action to collect fines. Supercom, which does not have enforcement powers, refers the sanctions to the Comptroller General so that it may proceed to collect the fines.
