El 10 de febrero de 2014, el superintendente de información y comunicación, Carlos Ochoa, anunció, en rueda de prensa, que iniciará un proceso administrativo contra diario Extra por posible reincidencia, así como remitirá el caso a la Fiscalía, por presunto delito de «desobediencia a la autoridad.»
Esto, porque el medio no acató una resolución emitida por este organismo, mediante la cual exigía pedir disculpas públicas y rectificar los titulares de dos publicaciones sobre un accidente de tránsito en donde falleció el exrector y la relacionista pública de la Escuela Superior Politécnica de Chimborazo.
Según Bolívar Torres, asesor jurídico de la Superintendencia de información y comunicación (SUPERCOM), el medio podría haber incurrido en el delito tipificado en el artículo 234 del Código Penal vigente, que señala lo siguiente: “los que, fuera de los casos expresados en este Código, desobedecieren a las autoridades cuando ordenaren alguna cosa para el mejor servicio público en asuntos de su respectiva dependencia y de acuerdo con sus atribuciones legales, serán reprimidos con prisión de ocho días a un mes”.
La última resolución que remitió la Supercom a diario Extra fue la del 27 de enero de 2014. En ella, dispuso que el medio rectifique los titulares: “De la reunión a la tumba” y “Se fue al cielo con título de licenciada”, publicados el pasado 22 y 23 de noviembre de 2013 por considerar que “no son coherentes ni consistentes con el contenido de la noticia”. Asimismo, dispuso que el Director del medio presente disculpas públicas a los representantes de la entidad educativa, con copia al Consejo de Regulación de la Comunicación.
Antes, el 17 de diciembre del 2013, la Supercom ya había remitido al medio un oficio similar. Sin embargo, diario Extra, al recibir la notificación de amonestación y pedido de rectificación, presentó un recurso de reposición y manifestó su protesta por recibir una sanción sin haber sido notificado . Hecho que la entidad de control rechazó y se ratificó en su decisión.
El medio también impugnó la resolución ante el Tribunal Contencioso-Administrativo, encargado de conocer este tipo de procesos y dejó sentada su posición de no acatar la resolución hasta que no exista un pronunciamiento de este organismo. Sin embargo, la Supercom tiene una lectura distinta. Según Ochoa, pese a la existencia de la impugnación, la resolución sigue vigente y el medio debe cumplir con lo dispuesto hasta que no exista un pronunciamiento de un juez que dicte lo contrario.
Supercom initiates administrative process against newspaper and announces possible penal sanction
On february 10th, 2014, the superintendent of information and communication, Carlos Ochoa, announced, at a press conference, that he will begin an administrative process against the newspaper Extra for possible recidivism, and will also sent the case to the Prosecutor, for alleged «disobedience to authority».
This happens because the newspaper did not obey a resolution issued by the organism, which demanded a public apology and rectifying the headlines of two publications about a traffic accident where the ex principal and the public relations specialist of the Polytechnic School of Chimborazo died.
According Bolívar Torres, legal consultant for the Superintendent of information and communication (SUPERCOM), the daily Extra could have committed a violation of the Article 234, of the Penal Code, which states the following: «Who, except in cases specified in this Code, disobey the authorities when they order something for the best public service in matters of their respective departments and in accordance with its legal powers, shall be punished with imprisonment from eight days to one month «.
The last resolution sent by the Supercom to daily Extra, happened on January 27th, 2014. The entity ordered to daily Extra to rectify the headlines: «From the meeting to the grave» and «She went to heaven with a bachelor’s degree», published on 22 and 23 November 2013″ for considering that “they are not coherent or consistent with the content of the news». The entity also ordered to the Director of the journal to present a public apology to the representatives of the educational institution, with a copy to the Regulation Council of Communication.
Earlier, on December 17th, 2013, the Supercom had already submitted a similar letter to the journal. However, Daily Extra, after receiving a notification of warning and request for correction, filed a legal resource of reposition, and expressed his protest for receiving a penalty without notification, but the entity rejected.
The journal also appealed the decision to the Contentious Administrative Tribunal, in charge of this kind of processes and set out their position of not obeying until a judge performs an official pronunciation of the process. However, the Supercom has a different reading. According to Ochoa, despite the existence of the dispute, the resolution remains in force and the journal must comply with it, until a judge dictates the opposite.
