Supercom multa a dos medios en Riobamba

El 8 y 19 de septiembre de 2014, la Superintendencia de la Información y Comunicación (Supercom) sancionó al diario local La Prensa y radio Tricolor de Riobamba – ciudad ubicada a 138 Km de Quito- por no haber difundido el tiraje de dos ediciones y no haber entregado copias de ejemplares o programas.

Diario La Prensa fue sancionado dos veces. La primera, porque la entidad de control determinó que el rotativo incumplió con el artículo 90 de la Ley Orgánica de Comunicación (LOC) al no difundir, en portada, el número total de ejemplares puestos en circulación en las ediciones del 7 de mayo y 20 de julio de 2014, tras una denuncia presentada por el ciudadano Jaime Gonzalo Merizalde, el pasado 25 de julio. La segunda sanción contra este rotativo se dio por no haber entregado las copias solicitadas por el señor Lizardo Enrique Colcha Arévalo, de las publicaciones correspondientes a los días 17, 28, 30 y 31 de mayo y 22 de junio de 2014, en el término de tres días. Esto, a criterio de la Supercom, infringió el artículo 28 de la LOC. El diario ha sido sancionado con una multa de USD 4760.

En diálogo con Fundamedios, Lucy Freire, directora del rotativo comentó que en el primer caso el medio asumió la responsabilidad al no difundir su tiraje, pero en el segundo cuestionó la decisión de la Supercom, pues agregó que si bien no entregaron los ejemplares, enviaron una comunicación que está firmada por la persona que recibió, en donde le indicaban al peticionario que los ejemplares solicitados estaban listos para ser retirados en las oficinas del diario.

A su criterio, la Ley no especifica que estos deban ser entregados a domicilio. Pese a ello, la entidad de control no aceptó sus argumentos. Freire considera que más allá de estas sanciones específicas, hay un problema de fondo y es que, a su criterio, este tipo de denuncias no son de buena fe. “Se tergiversa el sentido de la Ley y comienzan a utilizarla como una herramienta para presionar, amilanar, advertir que si se sigue investigando tal o cual cosa e insistiendo en dar cobertura periodística de algún caso, entonces vamos a seguir teniendo denuncias en la Supercom”, apuntó.

La directora del periódico explicó que estas denuncias se dan como una especie de represalia a las investigaciones publicadas respecto a supuestas irregularidades en torno a la venta de un parque industrial en esa ciudad en donde supuestamente estuvo involucrado el señor Colcha. Para justificar su afirmación aseguró que constantemente tienen pedidos de parte de este ciudadano exigiendo copias de ejemplares .

La sanción contra radio Tricolor, se dio igualmente por no haber entregado copias de los programas emitidos entre el 21 de febrero y 07 de marzo del 2014, solicitadas por el mismo señor Colcha. En este caso, la Supercom determinó la responsabilidad del medio de comunicación y le obligó a pagar una multa equivalente a cuatro remuneraciones básicas mínimas unificadas (USD 1360). Al respecto, durante la audiencia de sustanciación desarrollada el pasado 12 de septiembre, el abogado de la emisora indicó que las grabaciones referidas no fueron entregadas porque el oficio en mención no constaba con la fe de recibido y no estuvo dirigido a nombre del concesionario de dicha emisora.

Supercom fines two communication medias in Riobamba

On the  8th  and 19 September 2014, the Superintendence of Information and Communication (Supercom) sanctioned the local newspaper La Prensa and Radio Tricolor from Riobamba – a city located 138 km from Quito- for not have released two editions of the print run and no have delivered copies of original editios or programs.

Journal La Prensa was suspended twice. First, because the entity of control determined that the newspaper failed to comply Article 90 of the Communication´s Law (LOC) by failing to disseminate, on the cover, the total number of copies on circulation in editions of May 7th and 20th of July 2014, after came a complaint issued by citizen Jaime Gonzalo Merizalde, on July 25th. The second penalty was given against this newspaper for failing to deliver some copies requested by Mr. Lizardo Enrique Colcha Arévalo, copies of publications that corresponded to the 17, 28, 30 and 31st  of May and 22nd of  June 2014, and were supposed to  been delivered on a term of three days. This, in the opinion of the Supercom, infringed Article 28 of the LOC. The newspaper has been fined  with USD 4760.

Speaking to Fundamedios, Lucy Freire, head director of the newspaper, said that in the first case the media assumed responsibility for not disseminate the circulation number, but in the second Mrs. Freire questioned the Supercom´s decision then added that if the originals were not delivered, but the copies were sent and are signed by the person who received them, where was specified that the originals the petitioner requested were ready to be picked up at the newspaper’s offices.

In her point of view, the Communications law does not specify that these should be delivered at the home address. Nevertheless, the control entity did not accept her arguments. Mrs. Freire believes that beyond these specific sanctions, there is a fundamental problem that is, in her opinion, these kind of complaints are not bona fide. «The real meaning of the Law is distorted and began to use it as a tool to press, intimidated, warning to keep investigating this or that and insisting to keep media coverage of a specific case, that is why we will continue to have complaints from the Supercom»  she said.

The executive director of the newspaper said that these claims were given as a sort of reprisal  because of published investigations about alleged irregularities on the sale of an industrial park in the city where allegedly is involved Mr. Colcha. To support her statement, the director said the newspaper consistently have orders of this citizen demanding copies of the originals investigations.

The sanction against Tricolor radio, is also given for not delivered copies of programs broadcasted between February 21st and March 7th 2014, requested by the same Mr. Colcha. In this specific case, the Supercom determined the responsibility to the communication media and forced the radio to pay a fine equivalent to four unified basic minimum wages (USD 1360). In this regard, during the hearing of conduct developed on September 12, Tricolor´s counsel pointed that those recordings were not delivered because the reception document in question did not have the faith of been received and was not addressed on behalf of the radio station agent.
