El 14 de mayo de 2014, la Superintendencia de la Información y Comunicación (Supercom) sancionó a Radio Megaestación FM 92.9 de Santo Domingo de los Tsáchilas –ubicada a 133 Km de Quito- con una multa de cuatro remuneraciones básicas mínimas unificadas (aproximadamente $1360 dólares) por incumplir el artículo 28 de la Ley Orgánica de Comunicación (LOC) al no haber entregado copias del noticiero “Meganoticias”, las cuales fueron solicitadas por la alcaldesa de la ciudad.
La sanción responde a una denuncia presentada el pasado 9 de abril por la Alcaldesa de Santo Domingo, Verónica Zurita Castro, y el Procurador Síndico, Juan Carlos Mariño Bustamante. En ella, los funcionarios aseguran que el medio de comunicación no entregó las copias del programa radial transmitido de 06:00 a 08:00 los días 10, 13, 14, 17, 18, 19 y 20 sin “motivación y fundamentación”, por lo que a su criterio incumplen con el artículo 28 de la LOC. Dicho artículo señala que “toda persona que se sienta afectada por informaciones de un medio de comunicación podrá solicitar fundadamente copias de los programas o publicaciones”, pedido que deberá ser atendido favorablemente “en un término no mayor a 3 días”.
Por su parte, el abogado defensor del medio de comunicación, Jorge López Ochoa, aseguró -durante la audiencia desarrollada en días pasados ante la Supercom- que nunca se negó la entrega de las grabaciones y agregó que el 21 de febrero recibieron un oficio firmado por el Director de Comunicación Institucional de esa municipalidad, al que calificó como “una comunicación bastante escueta”, por no tener la firma de la Alcaldesa o su Procurador Síndico.
En ese sentido, la Supercom determinó que “no le corresponde al medio de comunicación calificar el pedido”, sino que tenía la obligación de atenderlo favorablemente. A criterio de la entidad esto “evidencia la inobservancia e incumplimiento de la referida norma legal por parte del accionado”.En la resolución se señaló que el medio de comunicación tiene tres días término para depositar o transferir la multa y entregar dichas grabaciones.Fuentes de la emisora confirmaron a Fundamedios que apelarán esta decisión .
Cabe recordar que los principales organismos internacionales de protección de la libertad de expresión han señalado que la Ley Orgánica de Comunicación-en vigencia desde junio de 2013- es una Ley que atenta contra los principios esenciales que protegen este derecho humano fundamental. La Ley ha sido demandada por inconstitucional ante la Corte Constitucional por más de 60 personalidades de la comunicación, las artes y la literatura ecuatoriana. Sin embargo, tras casi un año, este organismo aún no resuelve el pedido de inconstitucionalidad que recién fue admitido a trámite el 23 de enero de este año.
Supercom fines a radio station after a denounce made by a local city mayor
On May 14, 2014, the Superintendence of Information and Communication (Supercom) sanctioned Radio mega station FM 92.9 of Santo Domingo de los Tsáchilas-located 133 Km from Quito with a fine that consists of four basic minimum unified salaries (about $ 1360 U.S. dollars) for violating the Article 28 of the Organic Law of Communication (LOC) for not providing copies of the newsletter «Meganoticias», which were requested by the mayor of the city.
The fine responds to a complaint filed on April 9 by the Mayor of Santo Domingo city, Veronica Castro Zurita, and the public Attorney, Juan Carlos Mariño Bustamante. According to the mayor, the media did not provide copies of the radio program broadcast from 6:00 to 8:00 on the following dates 10, 13, 14, 17, 18, 19 and 20 of February «with no motivation and justification for the denial» violating the Article 28 of the LOC. The article states that «any person who feels that has been affected by the information published by the communications media outlets may reasonably request copies of programs or publications,» this must be favorably attended in «a term not exceeding 3 days.»
In the other hand, the defense lawyer of the media outlet, Jorge López Ochoa said during the hearing-developed several days before at the Supercom‘s office- that the recordings were never denied. He also said that on February 21 he received a letter signed by Director of Communications of the municipality, which he described as «a lack of concise communication» for not having the signature of the Mayor or Trustee Attorney.
In that sense, the Supercom determined that «it is not for the media outlet to qualify the request», but it was obligated to answer it favorably. According to the Superintendence, this fact “evidences the neglect and breach of that legal standard by the driven”. The resolution stated that the media outlet has three days term to deposit or transfer the fine and to deliver those copies of the program. Sources of the radio station confirmed to Fundamedios that they will appeal this decision.
It is necessary to recall that the main international bodies for the protection of freedom of expression have indicated that the Communications Law in force since June 2013, is a law which violates the basic principles that protect this fundamental human right. The Law has been sued for unconstitutional before the Constitutional Court for more than 60 personalities of Ecuadorian communication, arts and literature. However, after nearly a year, the Court still does not resolve the unconstitutional order, that has just been declared admitted on 23 January this year.
