El 25 de febrero de 2015, la Superintendencia de la Información y Comunicación (Supercom) ordenó a diario La Hora, edición regional de Loja (sur del Ecuador), publicar una rectificación y disculpas públicas al alcalde de ésta ciudad, Bolívar Castillo, quien denunció al medio de comunicación por supuestamente incumplir con un pedido de rectificación realizado el 21 de enero por una nota periodística referente al uso de toletes eléctricos por parte de la policía de esa municipalidad.
La Supercom resolvió que el diario La Hora incumplió con el artículo 23 de la Ley Orgánica de Comunicación (LOC) sobre la obligación de los medios a rectificar información “cuando existan deficiencias en la verificación, contrastación y precisión de la información”.
La Institución reguladora determinó como medida administrativa la publicación de la rectificación del Alcalde. Sin embargo, puso una condición: que el texto “deberá referirse únicamente a la información que conforme se ha establecido, contiene deficiencias” y, en ningún caso, el medio de comunicación está en la obligación de publicar asuntos que no estén relacionados con los hechos materia de la rectificación que se solicite. También le dio al medio 72 horas, contados a partir de que el peticionario envíe el texto correspondiente para cumplir con la sanción.
El 21 de enero de 2015, diario La Hora, edición regional de Loja, publicó una nota titulada en portada “Control con toletes eléctricos” y en su interior “Municipales Lojanos usan toletes eléctricos” referente a la utilización de estos artefactos en esa ciudad, en donde se mencionó que una persona habría sido quemada por su uso. Esto motivó la denuncia del Alcalde quien acudió a la entidad de control porque, a su criterio, el medio no cumplió con su derecho a la rectificación en los términos establecidos en la Ley.
En la audiencia de sustanciación el abogado del diario La Hora dijo “que la noticia no contó con deficiencias en la verificación, contrastación y precisión de la información, presupuestos fundamentales para proceder con lo que señala el artículo 23 de la LOC . Por lo que, “obviamente que no habría lugar a un derecho a la rectificación”. Afirmó también que el diario no podía publicar la rectificación solicitada ya que el Municipio de Loja sólo adjuntó “un documento que no tiene ni siquiera el membrete del Municipio” y que de acuerdo con la ley se “prohíbe hacer publicaciones de anónimos.
Por su parte, el abogado del Alcalde cuestionó que el medio de comunicación no haya publicado la rectificación solicitada, sino una réplica y afirmó que los toletes a los que se hace alusión en la noticia, ni siquiera han llegado a las bodegas de dicho Municipio.
Supercom forces newspaper to apologize and publish rectification after mayor’s complaint
On February 25 2015, the Superintendence of Information and Communication (Supercom) ordered the Loja (southern Ecuador) regional edition of the newspaper La Hora to publish a rectification and a public apology to the mayor of this city, Bolívar Castillo, who denounced the media outlet for allegedly failing to comply with a request for rectification made on January 21 concerning a news story about the use of electric truncheons by the municipality’s police.
Supercom ruled that La Hora failed to comply with Article 23 of the Organic Communications Law (LOC) on the media’s obligation to rectify information “when deficiencies exist in the verification, cross-checking and accuracy of the information”.
The regulatory institution ordered the publication of the mayor’s rectification as an administrative measure. However, it set one condition: that the text “should only refer to the information that has been determined contains deficiencies”, and that in no case is the outlet obliged to publish information not related to the facts about which the rectification was requested. The newspaper has been given 72 hours, counted from the moment the requester sends the relevant text, to comply with the sanction.
On January 21 2015, Loja’s regional edition of La Hora published a front page article titled “Control with electric truncheons” and inside “Loja’s municipal police use electric truncheons”, concerning the use of these devices in the city. The article stated that a person had allegedly suffered burns as a result of their use. This led to the mayor’s complaint. The authority turned to the control body because, in his opinion, the media outlet did not fulfill its obligation to rectify the information under the terms established by law.
At the substantiation hearing the newspaper’s counsel said that “the news article did not suffer from deficiencies in the verification, cross-checking and accuracy of the information, fundamental assumptions to proceed with what is established by LOC’s Article 23”. Therefore, “there would obviously be no need to rectify it”. He also stated that the newspaper could not publish the rectification requested because the Municipality of Loja only attached “a document that does not even have the municipality’s letterhead” and according to the law “anonymous publications are prohibited”.
Meanwhile, the mayor’s attorney questioned the fact that the outlet has not published the rectification requested, but a response, and stated that the truncheons referred to in the article have not even reached the municipality’s warehouse.
